A GENERAL ORDINANCE OF THE CITY OF OSHKOSH AMENDING SECTION 30-32
OF THE OSHKOSH MUNICIPAL CODE PERTAINING TO ZONING DISTRICTS.
The Common Council of the City of Oshkosh do ordain as follows:
SECTION 1. That Section 30-32 of the Oshkosh Municipal Code pertaining to
Zoning Districts and the map therein described is hereby amended by changing the
district character of the described property, vacant lot in the 400 Block of Monroe Street
from Institutional (I) to Single Family Residential-9 (SR-9).
ALL OF LOT 8 OF BLOCK 54, FORDS ADDITION PLUS PUBLIC RIGHT OF WAY
ADJACENT TO SAID LOTS EXTENDING TO THE CENTERLINE OF MONROE
STREET ALL IN THE 4TH WARD, CITY OF OSHKOSH, WINNEBAGO COUNTY,
WISCONSIN.
SECTION 2. This Ordinance shall be in full force and effect from and after its
passage and publication.
SECTION 3. Publication Notice. Please take notice that the City of Oshkosh
enacted Ordinance #18-267 APPROVE ZONE CHANGE FROM INSTITUTIONAL (I) TO
SINGLE-FAMILY RESIDENTIAL- 9 (SR-9); VACANT PROPERTY 400 BLOCK
MONROE STREET on May 8, 2018. This ordinance changes the zoning of the vacant
property in the 400 Block of Monroe Street from Institutional (I) to Single Family
Residential-9 (SR-9). The full text of the Ordinance may be obtained at the Office of the

BACKGROUND
The subject area included in the zone change request consists of a 6,834 square foot vacant parcel
that was previously used as a playground for St. Mary's School, which has closed. The
surrounding area consists predominately of single and two family uses with sporadic multi-
family uses and a church to the north. The 10 and 20 Year Comprehensive Land Use Plans have
the subject parcel designated for institutional use.
ANALYSIS
The petitioner is requesting a zone change from the existing Institutional (I) District to Single
Family Residential -9 (SR -9) District to combine the subject parcel with the residentially -zoned
vacant parcel to the south for construction of a new single family home. The applicant states
that they currently own the vacant lot to the south and are in the process of purchasing the
subject property from Most Blessed Sacrament Parish and plan to combine the lots, pending
the zone change. The subject Institutional district consists only of the Most Blessed Sacrament
Parish site and is surrounded entirely by Single Family -9 zoning. The proposed zone change
will be consistent with the surrounding zoning and surrounding residential land uses. Staff
will be updating the comprehensive land use recommendations for this area as part of the
ongoing Comprehensive Plan update.
FISCAL IMPACT
Rezoning the property as requested should facilitate its sale to a private party for development
that will transition it from tax exempt to assessable. This will add value to the overall property
tax rolls.

The Plan Commission recommended approval of the zone change at its April 17, 2018 meeting.

ANALYSIS
The petitioner is requesting a zone change from the existing Institutional (I) District to Single
Family Residential -9 (SR -9) District to combine the subject parcel with the residentially -zoned
vacant parcel to the south for construction of a new single family home. The applicant states
that they currently own the vacant lot to the south and are in the process of purchasing the
subject property from Most Blessed Sacrament Parish and plan to combine the lots, pending the
zone change. They do not have plans drawn up for the new single family home at this time.
The subject Institutional district consists only of the Most Blessed Sacrament Parish site and is
surrounded entirely by Single Family -9 zoning. The proposed zone change will be consistent
with the surrounding zoning and surrounding residential land uses.
The 10 and 20 year land use recommendations designate this property as institutional; however,
the adjoining parcels to the south and east are both slated for residential use. The
comprehensive land use map recommendations are a general representation of land use
patterns and are not intended to be parcel specific like zoning. Therefore, staff does not have
concerns with extending the zoning to maintain consistency with adjacent land uses. Staff will
be updating the comprehensive land use recommendations for this area as part of the ongoing
Comprehensive Plan update.
RECOMMENDATION/CONDITIONS
Staff recommends approval of the zone change from Institutional (I) District to Single -Family
Residence District - 9 (SR -9) District as requested.
The Plan Commission approved the zone change from Institutional (I) District to Single -Family
Residence District - 9 (SR -9) District as requested. The following is the Plan Commission's
discussion on this item.
Mr. Slusarek presented the item and reviewed the site and surrounding area. The subject area

Ms. Propp asked if St. Mary's still had ownership of the vacant lot located to the north of 0 (422)
Monroe Street.

Mr. Slusarek verified it was still owned by St. Mary's.
Gerald Jacklin, 408 Monroe Street stated that he is the applicant and feels the zone change
would be beneficial in many ways. Some of the benefits would be an improvement to the
church environment, landscaping and benefits to the city including a tax benefit. He explained
that previously he and his wife purchased 414 Monroe adjacent to 0 (422) Monroe Street. They
bought the property because the house was in disrepair and needed to be demolished. He
stated that their goal is to combine both vacant parcels and build a single family home to help
improve the area.
Cheryl Jacklin, 408 Monroe Street explained more about 414 Monroe St. and how demolishing
the home improved the property. She stated that they have not purchased the 0 (422) Monroe
Street lot yet because they are waiting on the zoning approval. She reiterated that the goal is to
build a single family home that blends with other homes in the neighborhood.
Motion by Bowen to approve a zone change from the existing Institactional (I) District to Single -
Family Residential — 9 (SR -9) District for a portion of the property located at 0 (422) Monroe Street.
Seconded by Perry. Motion carried 7-0.

Parish and was previously used as a [St. Mary's Church] School
Playground. The School closed - so the playground/lot is not
currently being used.
We want to change the zoning from Institutional to SR -9
(Residential). We are in the process of purchasing this lot from
the Church.
Currently, we own the 414 Monroe Lot (which is next to 422
Monroe). Our plans are to build a single family home that
spans Lot 422 Monroe and 414 Monroe Street. Currently, we
do not have site plans.
The 422 Monroe Lot does not have any buildings/fences.
422 Monroe & 414 Monroe are symetrical in size.
