HomeMy WebLinkAboutItem I STAFF REPORT BOARD OF APPEALS MAY 9T1,2018 ITEM I: 830 S.WESTHAVEN DRIVE GENERAL DESCRIPTION AND BACKGROUND St. Raphael Archangel Congregation-owner/petitioner requests the following variance to permit a monument sign in the minimum front yard setback: Description Code Reference Required Proposed Front yard Setback 30-50(G) 30' minimum 20' The subject 5.6 acre (approx. 244,244 sq. ft.) property is zoned Institutional District (1). The 572'x427' rectangular-shaped lot is located mid-block on the east side of S. Westhaven Drive. The property is developed with a single-story church and associated off-street parking facilities to the south and west of the principal structure. Vehicular access to the parcel occurs via three curb cuts located on S. Westhaven Drive. Adjacent land uses to the subject parcel include single-family residential to the east and north while institutional uses are west and south. ANALYSIS In reviewing a variance request, the following questions should be addressed: When considering an area variance, the question of whether unnecessary hardship or practical difficulty exists is best explained as "whether compliance with the strict letter of the restrictions governing area, set backs, frontage, height, bulk or density would unreasonably prevent the owner from using the property for a permitted purpose or would render conformity with such restrictions unnecessarily burdensome." Are there any unusual or unique physical limitations of the property which create a hardship? Will granting of a variance result in harm to the public interest? The applicant is proposing to install a double-faced internally illuminated monument sign featuring an electronic message center (EMC) section with a 20' front yard setback (see attached site plan and rendering). A variance is requested as the proposed sign will intrude 10' in the minimum 30' required front yard setback. The sign is proposed to be placed approximately 50' south of the existing identification sign per the submitted site plan, Additionally, the sign is proposed to be positioned perpendicular to the street whereas the current identification sign is placed parallel to the street, The overall height of the sign proposed is 8'8" from grade and measures 10'6" at its widest point. The proposed sign design, colors and materials (e.g. brick base) are intended to match the existing principal structure for aesthetic purposes, The principal structure and indoor institutional land use were previously established tinder the R-1 Single Family Residential Zoning District in 1993 that required a 25' STAFF REPORT BOARD OF APPEALS ITEM I -2- MAY 9TH, 2018 front yard setback. Therefore, the current single-faced parallel placed identification sign met the previous zoning standards. However, the property was rezoned to an Institutional District as part of the comprehensive city zoning ordinance and map update in January 2017. The new Institutional District standards require 5' of additional setback for front yard structure placement. While there appears to be room in the existing front yard setback to place a sign and meet current code, it would be strictly limited to a similar single-sided parallel arrangement and be unnecessarily burdensome in this instance. Reason being this placement arrangement does not maximize sign visibility for traffic utilizing S. Westhaven Drive. and creates on-street hesitation for motorists attempting to identify the facility. The established development pattern and proximity to the existing parking lot are unique physical limitations of the property and create a degree of hardship. For example, if the proposed sign was required to meet the 30' minimum front yard setback and be placed in a perpendicular manner it would have to be located in the existing off- street parking lot. This would eliminate parking stalls for patrons and reduce visibility of the sign during times of attendance because of adjacent parked cars. Overall, the proposed location is a safe and practical alternative that would cause no harm to the public interest as vision concerns would be eliminated and be consistent with other signage in the surrounding area from a placement and scale standpoint.
