PURPOSE: AMEND FIRE CODE TO UPDATE REFERENCES TO THE STATE
ADMINISTRATIVE CODE FOR FLAMMABLE AND
COMBUSTIBLE LIQUIDS
INITIATED BY: OSHKOSH FIRE DEPARTMENT
A GENERAL ORDINANCE OF THE CITY OF OSHKOSH AMENDING SECTION 13-
2(A)(2) AND (3) OF THE OSHKOSH MUNICIPAL CODE PERTAINING TO ADOPTION
OF STATE FLAMMABLE AND COMBUSTIBLE LIQUIDS CODES
The Common Council of the City of Oshkosh do ordain as follows:
SECTION 1. That Section 13-2(A)(2) and (3) of the Oshkosh Municipal Code
pertaining to the adoption of State Flammable and Combustible Liquids Codes are hereby
amended to change the reference to SPS 310 to Flammable and Combustible Liquids Code
ATCP 93, Wis. Admin. Code in accordance with updates to the State Administrative Code.
SECTION 2. This ordinance shall be in full force and effect from and after its
passage, and publication.
SECTION 3. Publication Notice
Please take notice that the City of Oshkosh enacted ordinance #18 -XXX AMEND FIRE
CODE TO UPDATE REFERENCES TO THE STATE ADMINISTRATIVE CODE FOR
FLAMMABLE AND COMBUSTIBLE LIQUIDS (A GENERAL ORDINANCE OF THE
CITY OF OSHKOSH AMENDING SECTION 13-2(A)(2) AND (3) OF THE OSHKOSH
MUNICIPAL CODE PERTAINING TO ADOPTION OF STATE FLAMMABLE AND
COMBUSTIBLE LIQUIDS CODES) on April 24, 2018, to amend the reference to Flammable
and Combustible Liquids Code ATCP 93, Wis. Admin. Code in accordance with updates
to the State Administrative Code.

RE: Amend Fire Code to update References to the State Administrative Code for
Flammable and Combustible Liquids
BACKGROUND
The City of Oshkosh adopts certain provisions from the State of Wisconsin Administrative Code
pertaining to regulations for flammable and combustible liquids. These codes have been
removed from the Department of Safety and Professional Services (SPS) to the Department of
Agriculture, Trade and Consumer Protection (ATCP). While the Municipal Code contains
provisions automatically adopting updates, it is advisable to amend the code to reference the
updated provisions for clarity.
ANALYSIS
The proposed ordinance updates references to the regulations for flammable and combustible
liquids to the current administrative code provisions.
FISCAL IMPACT
There is no fiscal impact with the adoption of this ordinance.
RECOMMENDATION
Staff recommends adoption of the ordinance.
