The Common Council of the City of Oshkosh do ordain as follows: SECTION 1. That Section 30-32 of the Oshkosh Municipal Code pertaining to Zoning Districts and the map therein described is hereby amended by changing the district character of the described property, Outlot 1 of Certified Survey Map 7330 from Institutional (I) to Corporate Business Park with Planned Development (CPS -PD) SECTION 2. This Ordinance shall be in full force and effect from and after its passage and publication. This ordinance changes the zoning of Outlot 1 of CSM 7330 from Institutional (I) to Corporate Business Park with Planned Development (CPS -PD). TO: Honorable Mayor and Members of the Common Council FROM: Darryn Burich Director of Planning Services DATE: March 21, 2018 RE: Approve Zone Change from Institutional (I) to Corporate Business Park with Planned Development (CPB -PD); Outlot 1 of Certified Survey Map 7330 (Plan Commission Recommends Approval) BACKGROUND The approximate 0.70 acre parcel which was created during the dedication of the N. Koeller St. extension right-of-way. The surrounding area consists primarily of parkland to the north and west across the N. Koeller St. extension right-of-way, proposed commercial development to the south and right-of-way for the proposed N. Westfield St. extension to the east. Staff recommends that the zoning be extended to maintain consistency with adjacent land use to the south. ANALYSIS Staff is requesting a rezone from the current Institutional (I) designation to the Corporate Business Park with a Plan Development Overlay (CBP-PD) designation. This rezone creates consistency with the zoning of the adjacent properties to the southeast along Oshkosh Avenue. The adjacent property owner was approved for a General Development Plan at the March 13, 2018 Common Council meeting. That property owner will be dedicating 24' of additional right-of-way along Oshkosh Avenue and 80' of right-of-way for the extension of N. Westfield Street. The developer will be dedicating 21' for Oshkosh Avenue and 20' for N. Westfield Street above and beyond the normal dedication requirements at the request of the City. Preliminary,�discussions have taken place regarding a potential land swap between the developer and the City of Oshkosh. The developer would dedicate the required right-of-way and in turn the City would dispose of Outlot 1 to the developer. The final determination of any potential land swap will need to be approved by the appropriate regulating bodies. The Outlot will be physically separated from the former Lakeshore Municipal Golf course and would not be suitable for development as a 0.70 acre Institutional zoned parcel. Should the City decide to proceed with a land swap with the adjacent developer it will simplify and streamline the process of incorporating the parcel into the larger development plans for the area. GENERAL INFORMATION Applicant/Owner: Department of Community Development/City of Oshkosh Action Requested: The petitioner is requesting a rezoning of Outlot 1 of Certified Survey Map (CSM) 7330, generally located north of Oshkosh Avenue, south of the unnamed street on the south side of the former Lakeshore Golf Course, from their current designations of Institutional (I) to the proposed designation of Corporate Business Park District with a Planned Development Overlay (CBP-PD). Applicable Ordinance Provisions: The Zoning Ordinance does not establish criteria relative to appropriateness of changing zoning from one classification to another but relies on the Comprehensive Plan and good planning principles. Property Location and Type: The approximate 0.70 acre subject site consists of one parcel which was created during the dedication of the N. Koeller St. extension right-of-way. Outlot 1 is an approximate 30,422 sq. ft. area on the south side of newly established right-of-way. The surrounding area consists primarily of parkland to the north and west across the N. Koeller St. extension right-of-way, proposed commercial development to the south and right-of-way for the proposed N. Westfield St. extension to the east. The 10 and 20 year land use recommendations designates this area as Park, Recreation and Open Space; however, this parcel is adjacent to existing CBP-PD parcels which contains proposed commercial development. The comprehensive land use map recommendations are a general representation of land use patterns and are not intended to be parcel specific like zoning. Therefore, staff is recommending that the zoning be extended to maintain consistency with adjacent land uses. Staff will be updating the comprehensive land use recommendations for this area as part of the ongoing Comprehensive Plan update. RECOMMENDATION/CONDITIONS Staff recommends approval of a zone change from Institutional District (I) to Corporate Business Park with a Plan Development Overlay (CBP-PD) as requested. Item — Rezone Outlot 1 CSM 7330 The Plan Commission approved of the zone change as requested. The following is the Plan Commission's discussion on this item. Mr. Lyons presented the item and reviewed the site and surrounding area. The approximate 0.70 acre subject site consists of one parcel which was created during the dedication of the N. Mr. Bowen wanted to verify that this was not a land swap but just a rezone. Mr. Lyons verified it was only a rezone. He said that any future land swap would have to go through the proper procedures. Motion by Hinz to approve the rezone Outlot 1 of Certified Survey Map (CSM) 7330 from Institutional (I) to Corporate Business Park with a Planned Development Overlay (CBP-PD) Seconded by Kiefer.
