WHEREAS, the Common Council of the City of Oshkosh held a public hearing on
the 27th day of March, 2018, at 6:00 p.m. for the purpose of hearing all interested persons
concerning the preliminary resolution and report of the City Manager (Board of Public
Works) on the proposed improvements as listed below, pursuant to the amended initial
resolution adopted February 27, 2018,by the Oshkosh Common Council of the following
named streets:
Concrete Pavement, Asphalt Pavement, Sidewalk, Driveway Aprons, Sanitary
Sewer Laterals (New and Relay), Storm Sewer Laterals (New and Relay), and
Water Laterals (New and Relay):
Court Street from the Fox River to Washington Avenue
Otter Avenue from State Street to the Railroad Tracks
Washington Avenue from North Main Street to Broad Street
Osceola Street from Pearl Avenue to 115' southwest of High Avenue
Jefferson Street from Washington Avenue to 230' north
State Street from Otter Avenue to Washington Avenue

NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh as follows:
1. That the proposed street grade(s), from a datum plane established by the official
United States Coast and Geodetic Survey, as identified and on file in the Department of
Public Works is/are hereby permanently established.
2. The Common Council for the City of Oshkosh hereby orders that new
sidewalk be constructed according to the established grade pursuant to Section 66.0907
of the Wisconsin Statutes and the ordinances of the City of Oshkosh at the following
locations:
Court Street (west side) - Ceape Avenue to 260' S of Ceape Avenue
3. That the report of the City Manager, acting as the Board of Public Works,
pertaining to the construction of the above described public improvements, including
plans and specifications therefor, is hereby adopted and approved with the following
modifications:

4. That the action of the City Manager in advertising for bids and to carry out the
work of such improvements in accordance with the reports of the City Manager and in
accordance with the said resolution heretofore adopted, is hereby approved, ratified and
confirmed.
5. That payment for said improvements be made by assessing the cost to the
property benefited as indicated in said report, except as modified herein.
6. Assessments shown on the report represent an exercise of the police power and
have been determined on a reasonable basis and are hereby confirmed.

7. That the assessments for all projects included in said report are hereby
combined as a single assessment but any interested property owners shall be entitled to
object to each assessment separately or all assessments jointly for any purpose or
purposes.
8. That the assessments may be paid in cash, or in installments pursuant to
Section 25-83 thru 25-89 of the Oshkosh Municipal Code, said deferred payments to bear
interest at the rate of six percent (6%) per annum on the unpaid balance. The City Clerk
shall publish an installment assessment notice in accordance with Section 66.0715(3)(e) of
the Wisconsin Statutes in the official newspaper of the City.
9. The City Clerk is directed to publish this resolution in the OSHKOSH DAILY
NORTHWESTERN, the official newspaper of the City.
10. The City Clerk is further directed to mail a copy of this resolution to every
property owner whose name appears on the assessment roll whose post office address is
known or can with reasonable diligence be ascertained.

A public hearing is scheduled for Tuesday, March 13, 2018, in the Common Council Chambers at
City Hall to consider improvements to your street. Staff will be available beginning at 4:45 p.m. in
Room 310 of City Hall to answer questions about the project and the estimated costs. Residents
may also call the Department of Public Works Engineering Division at (920)236-5065 to have
questions answered.
The City has implemented a way for you to receive project updates via e-mail. The updates will
provide information about access and construction progress. To receive these updates, please send a
blank e-mail to contractl804-subscribe@lists.ci.oshkosh.wi.us. You will receive an e-mail stating your
subscription request has been received. You must reply to the message within five (5) days to
complete the subscription. The City will stop sending updates upon completion of the project. If at
any time you wish to unsubscribe, please send an e-mail to this address, contractl804-

The public hearing covers the proposed improvements, which include the following: paving,
utilities, sidewalks, and/or driveway approaches and the levy of special assessments that partially
cover the cost of the improvements. Assessments are not due until the project is certified as complete
and these charges can be paid by any one (1) of the plans as outlined by the City Clerk's information
on payment plan options. Based upon the City of Oshkosh special assessment policy, the assessable
portions of the project have been identified and are outlined on the attached assessment
worksheet(s). The estimated distance for construction on side streets is estimated high to allow
adequate area for the new construction to be transitioned to the existing pavement. The quantities

and costs are estimates and will be adjusted to the actual quantity installed. Unit costs will be
adjusted according to the assessment policy based on bid prices. The estimated quantities for
sidewalk include up to six (6) additional squares of sidewalk to allow for private utility lateral
construction. Only squares actually removed and replaced to repair defective sidewalk or facilitate
the private utility lateral construction will be billed to the property owner. Additional sidewalk
squares removed will not be billed to the property owner if the Construction Access Agreement
previously mailed to them was signed and returned by the property owner.
Property owners who have not returned the Construction Access Agreement will only have partial
sidewalk squares removed and patched. These property owners will be sent orders to replace the
patched sidewalk with permanent concrete sidewalk in 2019. These property owners will be
financially responsible for replacing all patched concrete sidewalk, all defective sidewalk, and all
sidewalk that does not meet the Americans with Disabilities Act (ADA) standards. Sidewalk
squares needing replacement only to meet ADA standards will not be billed to the property
owner if the property owner returns the Construction Access Agreement before commencement of
the street reconstruction project. - If needed, please contact the Department of Public Works
Engineering Division at (920)236-5065 or attend the meeting listed above to get a copy of the
agreement form. The enclosed assessment information assumes the Construction Access Agreement
was signed and returned by the property owner.
Enclosed with this letter is updated information about lead water services and a program to replace
lead services on private property. Please review this information in Attachment 1B, in addition to
this letter. The enclosed assessments do not include replacing the private lead water service line.
The final assessment cost will not increase above the estimated total without another public hearing.
Questions in regard to payment of Special Assessments can be answered by calling the City Clerk's
office at (920)236-5011. Questions in regard to the construction project in general can be answered by
calling the Department of Public Works Engineering Division at (920)236-5065.
The sequence of construction has not yet been scheduled with a contractor. Signage will be placed
approximately one (1) week before construction will begin to notify people. Each street identified in
this year's paving program has been designated a specific time frame in which the contractor will
need to complete their work on that street. The construction time frames vary from five (5) to
fourteen (14) weeks depending upon the amount of work and the complexity of the work associated
with a specific street. All work within this contract is scheduled to be completed by the end of
November 2018. Wisconsin Public Service and other utility companies will be relocating some of
their facilities prior to the City contractor beginning work. This work is not part of the above time
frame.

A specific description of the project construction consists of the following elements: concrete
pavement with curb and gutter; asphalt pavement; relay or installation of specific segments of water
and sanitary sewer mains and their associated laterals at various locations along the project; relay or
installation of storm sewer and storm sewer laterals, as needed, along the project to accommodate the
drainage needs for the street and the adjacent properties; new concrete driveway aprons will be
constructed; and the existing concrete sidewalk will be repaired, as needed. Gaps in the sidewalk
system will be completed with construction of new sidewalk. It is recommended that no salt or
harsh chemicals be put on the new sidewalk for one (1) year. If you know of any underground wires
and/or piping (examples: invisible electric fence, conduit for exterior lighting, irrigation system, etc.)
on your property which are located near the sidewalk, right-of-way, or driveways, please contact the
Engineering Division as soon as possible. Any private improvements within the right-of-way, brick
pavers, shrubs, lights, etc. will be removed by the contractor during construction and will not be
replaced. In the event you wish to replace certain items, a permit must,be obtained from the
Department of Public Works prior to your beginning the work. Prior to the completion of the
project, all disturbed areas will be topsoiled, seeded, and covered with erosion mat. The property
owner is responsible for watering the newly vegetated areas. The matting placed over the seed is
biodegradable. Please do not remove the mat because it serves as mulch for the new grass. Please
set your lawn mower to the highest setting when mowing the new grass areas until the new grass
areas are well established.
As part of the construction, a storm lateral is proposed to be installed for each residential lot on the
project. An eight -inch (8") diameter surface drain with a slotted drain cover will be placed into your
yard. The storm sewer lateral and drain will allow you to direct drainage and/or sump pump hoses
to this location. This drain is connected to the storm sewer system and drains directly to local
streams and lakes. The lateral is to be used for "clear water" only. "Clear water" is typically
groundwater discharged by a sump pump or runoff from precipitation (i.e. rainfall or snow melt).
Do not place pet waste, yard waste, or other waste material into the storm sewer system. In the
event conditions on the property prevent the installation of the drain (example: a substantial
retaining wall), a drain will not be installed, but the storm sewer lateral will be installed
underground to the property line. You will be receiving additional information about the storm
sewer lateral and drain, including a telephone number for contact to coordinate the lateral's and
drain's final location. The drain is part of your private lateral and it will be yours to maintain. The
drain will have a fabric filter installed as a part of the construction. Please leave the filter in place
until the grass surrounding the drain is well established. The fabric will prevent dirt and debris from
filling the pipe until the grass is established. The previous two (2) paragraphs assume the
Construction Access Agreement was signed and returned by the property owner.
Commercial parcels and parcels with parking lots will have a larger diameter storm sewer lateral
stubbed onto the property. This lateral can be used to meet City code when construction work is
done on the parcel.
During construction, there will be periods of time when access to residential properties will be
restricted. There will only be a few instances when this situation will occur. Typically, short access
restrictions occur during the underground utility installation and longer restrictions occur during the
placement of concrete pavement and driveways. To minimize the inconvenience, the contractor will

provide a one-week notice prior to the access being restricted for concrete work. Per the Police
Department, a Construction Parking Permit is not required to park on a street overnight, if you
park within two (2) blocks of the street under construction (see enclosed information). On -street
parking will not be permitted with the construction area. All "No Parking" areas and/or posted
time zones must be obeyed. Vehicles parking overnight must be parked on the house address
side of the street that corresponds to the current date before midnight. On odd calendar dates, the
vehicles should be parked on the odd address side of the street. On even calendar dates, vehicles
should be parked on the even address side of the street. Provisions will be made with the Fire
Department and the Sanitation Division so fire protection and City garbage/recycling collection will
continue at all times. Please ensure your City -collected garbage/recyclables are at the curbside by
7:00 a.m. on your regular collection day. Crews schedule collection of garbage/recyclables in
construction areas at the start of each day. If rural -type mailboxes exist on your street, the contractor
will remove them during construction. This removal will make it necessary for you to pick up your
mail at the Post Office. The contractor will be responsible so as not to damage the mailboxes. Upon
completion of the paving work, the contractor will reset the mailboxes.
For commercial properties, the contractor is required to maintain access. Business owners are
encouraged to provide the City's Engineering Division with contact information, which will be
shared with the contractor. Communication between you, the City, the City's contractor, and your
customers and delivery personnel will help the project proceed as quickly as possible.
Although terrace trees may need to be removed at specific locations, they will be preserved as much
as possible. Property owners at locations where a tree needs to be removed will receive advance
notice of the removal and replacement options. Roots and branches may be cut to allow for paving
operations. Cutting and pruning will either be done by, or under the direction of, the City Forester.

As per Sections 27-27, 27-28, and 27-29 of the Municipal Code of the City of Oshkosh, there is no parking on
City streets, 2 AM to 5 AM, unless the owner of vehicle was granted permission or has purchased a City
parking permit.
If your street or sidewalk is under construction, it is NOT necessary to obtain a parking permit if you
park your car within two blocks of the street under construction. All City ordinances and parking
rules/guidelines must be followed, and all posted parking restrictions, including time zones and no
parking areas, must be obeyed.
You will need to follow the odd -even rules. On odd days of the week, the vehicle should be parked on
the side of the street with odd -numbered houses. On even days of the week, the permit holder should
park on the side of the street with even -numbered houses. Each night, the car should be parked on the
opposite side of the street as the night before. NOTE: Odd and even dates are figured before midnight.
If parking is only allowed on one side of the street, the Odd -Even rule DOES apply. Vehicles can only
park on the side of the street that does not have restricted parking and are only allowed to park overnight
on the appropriate Odd -Even days.
In the case of a declared Snow Emergency, parking on City streets is restricted to one side of the street
using the Odd -Even rule with dates figured from noon on the calendar date to noon on the following
calendar date. It is the responsibility of the vehicle owner/operator to find appropriate parking in the
event of a snow emergency. Vehicles in violation of snow emergency parking will be towed at the
owner's expense.
Disabled vehicles are not allowed to park overnight at anytime and should be moved within 24 hours.
Motor busses, truck tractors, semi -trailers and motor trucks designed, used, or maintained primarily for
the transportation of property as defined in Municipal Code 27-26(3) are not permitted to park overnight
on City streets.
All street parking is subject to the following guidelines:
• May not park in signed / designated "No Parking" areas.
• Vehicles may not stop or park in a designated "Fire Lane".
• No parking within 10 feet of a fire hydrant (an official traffic sign may indicate a greater distance
is required).
• No parking in loading zones.
• No parking within 4 feet of an alley or private roadway or driveway.
• No parking within 15 feet to the near limits of a crosswalk.
Failure to follow the above rules could result in parking citations being issued. Individuals wishing to
appeal a parking citation may do so by completing a Request to Review Parking Citation form which is
available at the Oshkosh Police Department Telecommunications Desk, on the Police Department website
(oshkoshpd.com) or on the City of Oshkosh website.

Lead Service Line Replacement Information
The purpose of this document is to inform property owners of the potential existence of a lead water
service line at your property and a City program available to help you replace it. Lead service lines
and home plumbing are potential sources of lead in drinking water. Lead is harmful to human
health, particularly the health of small children. For this reason, the City of Oshkosh (City) uses
corrosion control treatment at the water filtration plant to minimize the potential for lead in the City's
drinking water.
As part of a proposed 2018 construction project adjacent to/near your property, the City will replace
or perform maintenance on the water main and the City -owned portion of the water service line to
your home. The City owns and is responsible for maintaining the water service line up to the curb
stop (the first valve) off the water main. For a vast majority of residential properties, the curb stop
is typically located in the terrace or in the sidewalk adjacent to the street. The water service line from
inside your building out to the curb stop is owned and maintained by the property owner.

Based on available information, the City believes your water service line may be constructed of lead.
To determine if your water service line is lead, you may contact a certified plumber, the City's Water
Utility at (920)232-5330, or perform a self -inspection. To perform the self -inspection, simply take a
metal tool, like a coin, and scratch the surface of the pipe protruding from the floor or wall prior to
the water meter. If the pipe is easy to scratch and the scratched area is a shiny grey color, the pipe is
made of lead. The figure below provides basic guidance for performing a self -inspection:

Plastic Copper Magnets will ONLY stick to steel.
They will NOT stick to lead or copper.
Recent studies have shown that replacing only a portion of a lead service line can increase the risk
of lead exposure from drinking water to the occupants. As a result, the City has implemented new
policies and procedures to reduce the risk of lead exposure to its residents. The Municipal Code of the
City of Oshkosh requires full Lead Service Line Replacement (LSLR), replacement of both the public
and privately -owned lead service lines, within six (6) months of work on a lead water service line.
To minimize exposure to this risk during construction, the City will be providing a pitcher and two
(2) filter cartridges, certified for lead removal by NSF International, to each living unit on a parcel
with a lead service line replacement. Because water utility revenue generated from user rates cannot
be used to fund private lead service line replacement, the City applied for, and received, a principal
forgiveness loan from the Wisconsin Department of Natural Resources to help reduce the cost to
private property owners. The LSLR policy describes how the requirements of the Municipal Code
are implemented. On June 13, 2017, the Common Council approved a "Pilot Program Lead Service
Line Replacement Policy". This policy provides guidelines for cost sharing for the private -side
LSLR. Generally, the policy provides a 50% cost share, to a maximum of $1,500. For income -
qualified property owners, the cost share is increased. Please note the reimbursement funds can only
be used for costs associated with private homes, K-12 Schools, and licensed day cares. It does not
cover costs for replacing private lead service lines to commercial or business properties, except in
instances where a building contains both a business and a residence.
While preparing the update to the Municipal Code of the City of Oshkosh, City staff contacted
plumbers/utility contractors to provide an estimate of what the cost to replace a private -side LSLR
might be. Staff anticipated costs of approximately $2,500 - $3,000 per private -side LSLR, based on
the feedback received from the plumbers/utility contractors.

The City has published a Request for Qualifications for plumbers/utility contractors interested in
becoming prequalified to perform private -side LSLR. The list of prequalified plumbers/utility
contractors is available on the Water Utility page of the City's website (www.ci.oshkosh.wi.us). To
get to the Water Utility's page, on the home page, click on the pull-down menu labeled
"Departments", then click on "Public Works", then click on "Water Utility", and then click on
"Plumbers/Utility Contractors Prequalified for the Lead Service Lateral Replacement Program".
Property owners should attempt to obtain at least two (2) quotations from the plumbers/utility
contractors on that list and contract directly with the plumber/utility contractor to have the private -
side lead water service lateral replacement completed.
The City is encouraging the property owners to complete the private -side LSLR prior to the start of
the construction. This will allow the final restoration to occur with the construction project and
minimize the chances of damaging the new concrete and restored turf areas.
Funding for private -side LSLR is being provided by the U.S. Environmental Protection Agency.
Therefore, in some cases, the federal Davis -Bacon wage rate requirements will apply to the
plumbing/utility contracting firm performing this work.
The federal Davis -Bacon wage rate requirements will apply in the following circumstance:
• The property is owned by a business entity (trust, LLC, etc.); will be using a plumbing/utility
contracting firm that has employees (who are not owners of this firm); and an owner of that
plumbing/utility contracting firm did not perform one�hundred percent (100%) of the work.
Davis -Bacon wage rate requirements will not apply in the following circumstances:
• The property is owned by an individual or individuals.
• The property is owned by a business entity (trust, LLC, etc.) and an owner of the plumber or
utility contractor completing the work completes one hundred percent (100%) of the work.
• The total cost of the LSL replacement is less than $2,000.
The City of Oshkosh will assist in determining property ownership and whether or not the Davis -
Bacon wage rate requirements apply.
The plumber/utility contractor must obtain a copy of the Davis -Bacon wage rate determination
that is in effect when they sign the contract for the work that requires compliance with the Davis -
Bacon wage rates.
The cost-sharing reimbursements through the grant will be available to the residents that utilize the
plumbers/utility contractors on the prequalified list of plumbers/utility contractors. In order to
qualify for the cost sharing, the following requirements must be met:
• Complete the Water Service Line Inspection. The inspection must be done by a licensed
plumber or City Water Utility. The Water Utility will complete the survey for no charge.
• Property owner should attempt to obtain at least two (2) estimates for the private -side LSLR
from the City's list of prequalified plumbers/utility contractors.

• Work must be completed within one hundred eighty (180) days of the public -side portion of
the lead water service lateral being replaced.
• Property owner will sign an agreement with plumber/utility contractor to perform the
private -side LSLR and will pay the plumber/utility contractor directly. Property owner will
submit a copy of the invoice identified as paid by the plumber/utility contractor.
• Upon completion of the work, a reimbursement form must be filled out and signed by both
the property owner and plumber/utility contractor who completed the work. This form must
be submitted to the City to qualify for the cost share. This reimbursement form can be found
on the City's website, also on the Water Utility's page.
• Upon final inspection and approval by the City of Oshkosh Plumbing Inspector, the City will
send the property owner a reimbursement check for fifty percent (50%) of the total cost of the
private -side LSLR, up to the maximum of $1,500.
• Property owners who are at or below eighty percent (80%) of the median income based on
family size, as established by the U. S. Department of Housing and Urban Development for
a given year, would be eligible for additional assistance in paying for the private -side LSLR.
This additional assistance may cover up to seventy five percent (75%) of the private -side
LSLR. The property owner will still be responsible for the remaining twenty five percent
(25%) of the cost of the private -side LSLR.
• Property owners who are at or below fifty percent (50%) of the median income based on
family size, as established by the U. S. Department of Housing and Urban Development for
a given year, would be eligible for additional assistance for paying one hundred percent
(100%) of the cost of the private -side LSLR. Once the private -side LSLR work is completed,
the City will issue a two-party check to the property owner and the Licensed Plumber/Utility
Contractor up to the total amount of the LSLR.
Once the private -side LSLR has been completed, please submit the necessary paperwork listed above
to City Hall in order to receive your cost-sharing reimbursement. You may submit the
documentation in one (1) of the following ways:

WHEREAS, the Common Council previously adopted Initial Resolution No. 18-33
on January 23, 2018 for Special Assessments Contract 18-04 including Court Street from
the Ceape Avenue to Washington Avenue, Otter Avenue from State Street to the railroad
tracks, Washington Avenue from North Main Street to Broad Street, and Osceola Street
from Pearl Avenue to 115' southwest of High Avenue; and
WHEREAS, it is necessary to amend the Initial Resolution to include Court Street
from the Fox River to Ceape Avenue, Jefferson Street from Washington Avenue to 230
feet north of Washington Avenue, and State Street from Otter Avenue to Washington
Avenue.
BE IT RESOLVED BY the Common Council of the City of Oshkosh as follows:
1. The Common Council hereby declares its intention to exercise its police power
under Section 66.0703 and 66.0705 of the Wisconsin Statutes to levy special assessments
upon property within the following described areas for benefits conferred upon such
property by improving the following:

2. The total amount assessed against such district shall not exceed the total cost

3. The assessments against any parcel may be paid according to the provisions of
Section 25-83 through 25-89 of the Oshkosh Municipal Code.
4. The governing body determines that the improvements constitute an exercise
of the police power for the health, safety, and general welfare of the municipality and its
inhabitants.
5. The Board of Public Works is directed to prepare a report consisting of:
(a) Final plans and specifications for said improvements.
(b) An estimate of the entire cost of the proposed work or improvements.
(c) An estimate as to each parcel of property within the assessment
district of:
(1) The assessment of benefits to be levied for each improvement.
(2) The damages to be awarded for property taken or damages
by each improvement.
(3) The net amount of benefits over damages or the net amount
of damages over benefits for each improvement.
(4) The total assessment against each parcel

Upon completion of such report, the Board of Public Works is directed to file a copy
thereof in the City Clerk's Office for public inspection.
6. Upon receiving the report of the Board of Public Works, the City Clerk is
directed to give notice of a public hearing on such reports as specified in Section
66.0703(7)(a) of the Wisconsin Statutes. The hearing shall be held before the Common
Council at the Council Chambers, Room 406 in the City Hall at a time set by the Clerk in
accordance with the Wisconsin Statutes. The assessment against any parcel may be paid
in cash, paid with the first property tax installment, or in ten (10) installments if the total
amount of the assessment is greater than five hundred dollars ($500.00) or fifteen (15)
installments if the total amount of the assessment is greater than one thousand dollars
($1000.00).
7. The installation of said street improvements shall be accomplished according
to the provisions of Section 25-3 through 25-11 of the Oshkosh Municipal Code.
