PLAN COMMISSION STAFF REPORT MARCH 20,2013 ITEM 11: REZONE OUTLOT I OF CERTIFIED SURVEY MAP (CSM) 7330 FROM INSTITUTIONAL (1) TO CORPORATE BUSINESS PARK WITH A PLANNED DEVELOPMENT OVERLAY(CBP-PD) GENERAL INFORMATION Applicant/Owner: Department of Community Development/City of Oshkosh Action Requested: The petitioner is requesting a rezoning of Outlot 1 of Certified Survey Map (CSM) 7330,generally located north of Oshkosh Avenue, south of the unnamed street on the south side of the former Lakeshore Golf Course, from their current designations of Institutional(1) to the proposed designation of Corporate Business Park District with a Planned Development Overlay(CBP-PD). Applicable Ordinance Provisions: The Zoning Ordinance does not establish criteria relative to appropriateness of changing zoning from one classification to another but relies on the Comprehensive Plan and good planning principles. Property Location and Type: The approximate 0.70 acre subject site consists of one parcel which was created during the dedication of the N.Koeller St. extension right-of-way. Outlot I is an approximate 30,422 sq.ft. area on the south side of newly established right-of-way. The surrounding area consists primarily of parkland to the north and west across the N.Koeller St.extension right-of-way, proposed commercial development to the south and right-of-way for the proposed N.Westfield St. extension to the east. The 10 and 20 year land use recommendations designates this area as Park, Recreation and Open Space;however, this parcel is adjacent to existing CBP-PD parcels which contains proposed commercial development. The comprehensive land use map recommendations are a general representation of land use patterns and are not intended to be parcel specific like zoning. Therefore, staff is recommending that the zoning be extended to maintain consistency with adjacent land uses. This rezone creates consistency with the zoning ofthe adjacent properties tothe southeast along Oshkosh Avenue. The adjacent property owner was approved for uGeneral Development Plan at the March l3, 2OI8 Common Council meeting. That property owner will be dedicating 24' ofadditional rieht-of-wuy along Oshkosh Avenue and 80' of right-of-way for the extension of N. Westfield Street. The developer will be dedicating 21' for Oshkosh Avenue and 20' for N.Westfield Street above and beyond the normal dedication requirements utthe request ofthe City. Preliminary discussions have taken place regarding apotential land swap between the developer and the City ofOshkosh. The developer would dedicate the required right-of-way and in turn the City would dispose of OutloLltothe developer. The final determination nfany potential land swap win need tnbc approved by the appropriate regulating bodies. Staff iobnsupport ofthe rezoning for two reasons. Staff recommends approval of a zone change from Institutional District(1) to Corporate Business Park with a Plan Development Overlay(CBP-PD) as requested.
