HomeMy WebLinkAbout21. 18-134MARCH 13, 2018 FIRST READING (CARRIED PURPOSE: INITIATED BY 18-134 ORDINANCE LOST LAID OVER WITHDRAWN ) APPROVE CLOSURE OF OTTER AVENUE FROM STATE STREET TO BROAD STREET, WASHINGTON AVENUE FROM NORTH MAIN STREET TO BROAD STREET, CEAPE AVENUE AT THE INTERSECTION OF COURT STREET, WAUGOO AVENUE AT THE INTERSECTION OF COURT STREET AND MODIFY THE TRUCK ROUTES TO INCLUDE IRVING AVENUE FROM NORTH MAIN STREET TO BOWEN STREET DEPARTMENT OF PUBLIC WORKS A GENERAL ORDINANCE OF THE CITY OF OSHKOSH AUTHORIZING A VARIANCE TO SECTION 25-23 OF THE OSHKOSH MUNICIPAL CODE PERTAINING TO STREETS TO REMAIN OPEN TO TRAFFIC DURING THE COURSE OF EXCAVATION WORK AND MODIFYING SECTION 27-14 OF THE OSHKOSH MUNICIPAL CODE PERTAINING TO TRUCK ROUTES TO ESTABLISH A TERMPORARY TRUCK ROUTE ON IRVING AVENUE FROM NORTH MAIN STREET TO BOWEN STREET. WHEREAS, the City of Oshkosh Municipal Code Section 25-23 requires a passageway of not less than ten (10) feet in the travelled portion of the street to remain open on various streets within the City of Oshkosh, including Otter Avenue from State Street to Broad Street, Washington Avenue from North Main Street to Broad Street, Ceape Avenue at the intersection of Court Street, Waugoo Avenue at the intersection of Court Street and modify the truck routes to include Irving Avenue from North Main Street to Bowen Street; and WHEREAS, a variance from the terms of section 25-23 for the purposes of providing a safe work area and reducing congestion during reconstruction will be necessary; and WHEREAS, the timing of the closure is dependent upon progress of the work, weather and other factors, making determination of the specific dates for closure difficult. MARCH 13, 2018 18-134 ORDINANCE FIRST READING CONT'D NOW, THEREFORE the Common Council of the City of Oshkosh do ordain as follows: SECTION 1. that the successful bidder for Contract 18-04 (hereinafter "the Contractor") is hereby granted a variance from the provisions of Section 25-23 of the City of Oshkosh Municipal Code to close Otter Avenue from State Street to Broad Street and Washington Avenue from North Main Street to Broad Street, Ceape Avenue at the intersection of Court Street, Waugoo Avenue at the intersection of Court Street for purposes of providing a safe work area and reducing congestion during reconstruction during the 2018 construction season subject to the following conditions: A. The Contractor shall be permitted to close Otter Avenue from State Street to Broad Street and Washington Avenue from North Main Street to Broad Street, Ceape Avenue at the intersection of Court Street, Waugoo Avenue at the intersection of Court Street during the 2018 construction season in accordance with the terms and conditions of this Resolution. B. The Contractor shall provide at least seven (7) day notice to the Department of Public Works prior to any anticipated closure. C. The Contractor shall provide all necessary and required signage for the closure of the street and detour of traffic. D. The Contractor shall work with the Department of Public Works to minimize the effects of the street closure upon emergency services and the public. E. The Director of Public Works is hereby authorized to approve such closure, approve such closure with conditions or take such other action as may be necessary and appropriate in consultation with the Police and Fire Chiefs of the City of Oshkosh to protect the health, safety and welfare of the citizens. SECTION 2. That Section 27-14 of the City of Oshkosh Municipal Code is hereby amended as follows: To temporarily designate Irving Avenue from North Main Street to Bowen Street as a truck route for the 2018 construction season SECTION 3. This ordinance shall be in full force and effect from and after its passage, publication and placement of the appropriate temporary signage indicating the closure and temporary truck route designations as necessary and appropriate. The ordinance allows the temporary closure of Otter Avenue from State Street to Broad Street and Washington Avenue from North Main Street to Broad Street, Ceape Avenue at the intersection of Court Street, Waugoo Avenue at the intersection of Court Street and temporarily modifies the truck routes to include Irving Avenue from North Main Street to Bowen Street, for purposes of providing a safe work area and reducing congestion during reconstruction of Ceape Avenue, Waugoo Avenue, Washington Avenue and Otter Avenue during the 2018 construction season. Gohde, Assistant Director of Public WorksSty DATE: March 8, 2018 RE: Approve Closure of Otter Avenue from State Street to Broad Street, Washington Avenue from North Main Street to Broad Street, Ceape Avenue at the intersection of Court Street, Waugoo Avenue at the intersection of Court Street, and Modify the Truck Routes to Include East Irving Avenue from North Main Street to Bowen Street. BACKGROUND The Common Council will be asked to award Contract 18-04 at their March 27, 2018 meeting. The project includes the full reconstruction of Court Street from Ceape Avenue to Washington Avenue; Otter Avenue from State Street to the railroad tracks; and Washington Avenue from North Main Street to Broad Street, including relay of storm sewer, sanitary sewer, and water main, and their respective laterals. Section 25-23 of the Municipal Code of the City of Oshkosh requires Washington Avenue from North Main Street to Hazel Street and all one-way streets (including Ceape Avenue, Waugoo Avenue, and Otter Avenue) to remain open during excavation. The contract documents allow for construction work on Court Street from Ceape Avenue to Washington Avenue to be completed in twelve (12) weeks; Otter Street from State Street to Broad Street to be completed in twelve (12) weeks; and Washington Street from North Main Street to Broad Street to be completed in fourteen (14) weeks. It is anticipated the Contractor will need to temporarily convert some of the one-way streets to two-way streets in order to accommodate traffic within this area during construction. This is not uncommon, given the multitude of one-way streets in this area. The contract documents require Otter Avenue to remain open to traffic until work on Court Street is substantially complete. The contract documents further require either Washington Avenue or Waugoo Avenue, or both, to be open for the weekend of April 28th and for July 4th, in order to accommodate previously -scheduled special events. The contract documents further require Waugoo Avenue to be open when Ceape Avenue is closed. East Irving Avenue is not a designated truck route; however, staff is requesting Common Council temporarily allow truck traffic on this portion of East Irving Avenue for the duration of this construction project. We recognize that local, non-commercial traffic will identify and use different routes around the construction area. Access to businesses will be maintained for the duration of the project. The closures are anticipated to start at various times throughout the construction. Advanced warning signs will be placed seven (7) days prior to the closure to warn drivers. ANALYSIS Based on the excavation limits needed for utility construction, staff determined the intersection of Court Street and Ceape Avenue, and the intersection of Waugoo Avenue and Court Street would need to be closed to traffic. The time frame was limited as much as possible to minimize the impact to the traveling public. Additionally, worker safety and driver safety will be compromised during the construction work, if done under traffic. East Irving Avenue is required to be a truck route for the duration of the construction due to the lack of truck routes in the area. The nearest other east/west truck route available during construction would be East Murdock Avenue. East Irving Avenue was reconstructed with a thicker pavement to allow for temporary use as a truck route. FISCAL IMPACT The closures are included in the contract documents, so there are no fiscal impacts to this ordinance. RECOMMENDATIONS I recommend approval of the request to close Otter Avenue from State Street to Broad Street, Washington Avenue from North Main Street to Broad Street, Ceape Avenue at the intersection of Court Street, Waugoo Avenue at the intersection of Court Street, and to modify the truck routes to include East Irving Avenue from North Main Street to Bowen Street.
