WHEREAS, the City of Oshkosh Municipal Code Section 25-23 requires a passageway of not less than ten(10)feet in the travelled portion of the street to remain open on various streets within the City of Oshkosh, including Oregon Street from West 61h Avenue to West 161h Avenue and intersections of West 91h Avenue/Oregon Street and West South Park Avenue/Oregon Street; and WHEREAS, a variance from the terms of section 25-23 for the purposes of providing a safe work area and reducing congestion during reconstruction Oregon Street during the 2018 construction season will be necessary; and WHEREAS, the timing of the closure is dependent upon progress of the work, weather and other factors, making determination of the specific dates for closure difficult. NOW, THEREFORE the Common Council of the City of Oshkosh do ordain as follows: SECTION 1. That, PTS Contractors, Inc. is hereby granted a variance from the provisions of Section 25-23 of the City of Oshkosh Municipal Code to close Oregon Street from West 61h Avenue to West 161h Avenue and intersections of West 91h Avenue / Oregon Street and West South Park Avenue /Oregon Street for purposes of providing a safe work area and reducing congestion during reconstruction of Oregon Street during the 2018 construction season subject to the following conditions: MARCH 13, 2018 18-133 ORDINANCE FIRST READING CONT'D A. PTS Contractors, Inc. shall be permitted to close Oregon Street from West 61h Avenue to West 161h Avenue and intersections of West 91h Avenue / Oregon Street and West South Park Avenue / Oregon Street as necessary for the reconstruction of Oregon Street pursuant to the terms and conditions of this resolution. S. PTS Contractors, Inc. shall provide at least seven (7) day notice to the Department of Public Works prior to any anticipated closure. C. PTS Contractors, Inc. shall provide all necessary and required signage for the closure of the street and detour of traffic. D. PTS Contractors, Inc. shall work with the Department of Public Works to minimize the effects of the street closure upon emergency services and the public. E. The Director of Public Works is hereby authorized to approve such closure, approve such closure with conditions or take such other action as may be necessary and appropriate in consultation with the Police and Fire Chiefs of the City of Oshkosh to protect the health, safety and welfare of the citizens. SECTION 2. This ordinance shall be in full force and effect from and after its passage, publication and placement of the appropriate temporary signage indicating the closure. SECTION 3. The ordinance allows temporary closures of Oregon Street from West 61h Avenue to West 161h Avenue and intersections of West 91h Avenue /Oregon Street and West South Park Avenue/Oregon Street, for purposes of providing a safe work area and reducing congestion during reconstruction of Oregon Street during the 2018 construction season. Gohde, Assistant Director of Public Workssy DATE: March 8, 2018 RE: Approve Closure of Oregon Street from West 6th Avenue to West 161h Avenue, and the intersections of West 9th Avenue/Oregon Street and West South Park Avenue/Oregon Street BACKGROUND The Common Council awarded Contract 18-05 to PTS Contractors, Inc. (PTS) at their February 27, 2018 meeting. The project includes the full reconstruction of Oregon Street from West 8th Avenue to West 161h Avenue, including relay of storm sewer, sanitary sewer, and water main, and their respective laterals, as well as miscellaneous utility work and patching of Oregon Street from West 8th Avenue to the Fox River. The reconstruction includes the intersections of Oregon Street with 9th Avenue and South Park Avenue. Section 25-23 of the Municipal Code of the City of Oshkosh requires Oregon Street, 91h Avenue, and South Park Avenue to remain open during excavation. The Contract documents allow for construction work on Oregon Street from the Fox River to West 81h Avenue to be completed in five (5) weeks; West 81h Avenue to West South Park Avenue to be completed in sixteen (16) weeks; and West South Park Avenue to West 161h Avenue to be completed in fourteen (14) weeks. The Contract documents allow the closure of West 9th Avenue/Oregon Street and West South Park Avenue/Oregon Street intersections for a period of two (2) consecutive weeks, although at different times. Contract documents require the Contractor shall have at least two (2) of the following intersections open to east -west traffic at all times: West 611, Avenue, West 9th Avenue and West South Park Avenue. The Contract documents further require work be scheduled such, that at a minimum, every other cross -street intersection is open to east -west traffic. The Contract documents require the Contractor to have two (2) ten foot (10') wide lanes open (one (1) in each direction) for east -west traffic at the intersections of West 6th Avenue, West 9th Avenue and West South Park Avenue during EAA Air Venture 2018. However, we recognize that local, non- commercial traffic will identify and use different routes around the construction area. The Contractor is required to maintain access to businesses for the duration of the project. The closure is anticipated to start on March 19, 2018. Advanced warning signs will be placed seven (7) days prior to the closure to warn drivers. ANALYSIS Based on the excavation limits necessary for utility construction, staff determined the intersections of West 91h Avenue and West South Park Avenue with Oregon Street would need to be closed to traffic. The time frame was limited to two (2) consecutive weeks to minimize the impact to the traveling public. Additionally, worker safety and driver safety will be compromised during the construction work if done under traffic. FISCAL IMPACT The closures were included in the Contract documents, so there are no fiscal impacts to this ordinance. RECOMMENDATIONS I recommend approval of the request to close Oregon Street from West 61h Avenue to West 161h Avenue, and the intersections of West 91h Avenue/Oregon Street and West South Park Avenue/Oregon Street.
