The Common Council of the City of Oshkosh do ordain as follows: SECTION 1. That Section 30-32 of the Oshkosh Municipal Code pertaining to Zoning Districts and the map therein described is hereby amended by changing the district character of the described property located at 1603, 1607 and 1611 Ashland Street from Urban Industrial (UI), to Single Family Residential 9 District (SR-9). SECTION 2. This Ordinance shall be in full force and effect from and after its passage and publication. Commission Site Plan ?.rap TemoaW\Plan C=65slhon Site Ran flap Tomplwomd TO: Honorable Mayor and Members of the Common Council FROM: Darryn Burich Director of Planning Services DATE: January 18, 2018 RE: Approve Zone Change from Urban Industrial (UI) to Single Family Residential 9 District (SR -9); 1603, 1607 And 1611 Ashland Street (Plan Commission recommends approval) BACKGROUND The applicant requests a zone change from the existing Urban Industrial District (UI) to Single Family Residential 9 District (SR -9). 1603, 1607 and 1611 are all currently residential properties. 1603 and 1611 are single family homes and 1607 is a duplex the petitioner would like to convert to a single family home. The properties are located at the southwest corner of Ashland Street and Harrison Street. The subject parcels total approximately 0.51 acres or 22,419 sq. ft. ANALYSIS The petitioner is requesting a zone change from the existing Urban Industrial District (UI) to Single Family Residential 9 (SR -9) for their recently purchased home located at 1607 Ashland Street. The applicant would like to convert the existing duplex to a single family home and add addition to the rear of the home. Upon applying for permit they discovered the home was zoned UI. In reviewing the immediate area staff identified that a total of three (3) residential homes were zoned UI. It is the staff's opinion that all three (3) properties should be considered for a zone change in order to create a consistent land use pattern for the block. The three subject parcels are all located at the south end of Ashland Street, at its intersection with Harrison Street. Residential homes are located immediately to the west and north of the subject parcels. The intersection of Ashland Street and Harrison Street create a physical separation of the subject parcels from the more intense land uses to the south. The 10 and 20 year land use recommendations designate this area as commercial; however, these parcels are adjacent to existing SR -9 parcels which contain residential homes. The comprehensive land use map recommendations are a general representation of land use patterns and are not intended to be parcel specific like zoning. The Plan Commission approved of the zone change from Urban Industrial District (UI) to Single Family Residential 9 (SR -9) as requested. The following is the Plan Commissions discussion on this item. Mr. Lyons presented the item, reviewed the sites and surrounding area as well as the land use and zoning classifications in this area. He stated the applicant would like to convert the existing duplex to a single family home and add an addition to the rear of the home. In reviewing the area staff identified a total of three residential homes that were zoned UI. In order to create a consistent land use pattern for the block, staff believes all three properties should be considered for a zone change to SR -9. Residential homes adjacent to the three properties are zoned SR -9 and staff is recommending the zoning be extended to maintain consistency with the adjacent land uses. Ms. Propp questioned if there were other single family or duplex properties on Harrison Street that did not have the appropriate zoning. Mr. Lyons responded that these three residential properties were the only ones not zoned consistent with the SR -9. I understand that to change the property back to two-family use the structure would need to meet the current code requirements pertaining to the new use. This may require remodeling the entire structure to comply with code requirements such as the following: • Fire blocking , Installation of Headers • Insulation • Fire separation Requirements • Draft stopping • Electrical, Plumbing, Heating Updates • Smoke Detection • Parking Regulations • Code Compliant Exiting (interior and exterior stairways) I am also aware that if the two-family use of the property discontinues, the two-family use may never be reestablished again due to Zoning Regulations including the following: • Minimum Lot Standards per the Zoning Ordinance, Chapter 30 o Width:60'minimum o Depth: 100'minimum o Area: 7,200 square feet minimum There may be additional code requirements that would be required when converting back to a two- family use. The property is currently a duplex —1 bedroom and 1 bath upper and 1 bedroom and 1 bath lower. I want to change the zoning to allow for a single family home on this property. The change would provide for a 3 bedroom and 2 bath house. I purchased the property as an investment property and my plans are to build a 12'x 25' addition onto the west side of the house.
