HomeMy WebLinkAbout19. 18-78 JANUARY 23, 2018 FEBRUARY 13, 2018 18-49 18-78 ORDINANCE FIRST READING SECOND READING (CARRIED 6-0 LOST LAID OVER WITHDRAWN ) PURPOSE: REPEAL ORDINANCE PERTAINING TO PROHIBITED AREAS FOR ANIMALS INITIATED BY: CITY ADMINISTRATION A GENERAL ORDINANCE OF THE CITY OF OSHKOSH REPEALING SECTION 6-11 OF THE OSHKOSH MUNICIPAL CODE PERTAINING TO PROHIBITED AREAS FOR ANIMALS WHEREAS, the City of Oshkosh Municipal Code contains two separate provisions pertaining to bringing or permitting animals to be within city parks; and WHEREAS, the provisions of Chapter 19 of the Code pertaining to Parks regulations have been updated after review and input by the Advisory Parks Board, making the provisions in Chapter 6 inconsistent and outdated. The Common Council of the City of Oshkosh do ordain as follows: SECTION 1. That Section 6-11 of the Oshkosh Municipal Code pertaining to Prohibited Areas for Animals is hereby repealed. SECTION 2. This ordinance shall be in full force and effect from and after its passage, and publication. SECTION 3. Publication Notice Please take notice that the City of Oshkosh enacted ordinance #18-78 (A GENERAL ORDINANCE OF THE CITY OF OSHKOSH REPEALING SECTION 6-11 OF THE OSHKOSH MUNICIPAL CODE PERTAINING TO PROHIBITED AREAS FOR ANIMALS) on February 13, 2018. The ordinance repeals outdated and inconsistent provisions of the current municipal code pertaining to animals within city parks. Lorenson, City Attorney DATE: January 18, 2018 RE: Repeal Ordinance Pertaining to Prohibited Areas for Animals BACKGROUND The City of Oshkosh Municipal Code contained two separate provisions pertaining to bringing or permitting animals to be within City parks, one contained in Chapter 6 which generally covers animals and one contained in Chapter 19 which generally covers parks. Chapter 19 was updated after review and input from the Parks Advisory Board. As a result, the provisions in Chapter 6 have become inconsistent and outdated. Staff is proposing to delete the provisions in Chapter 6 so that all park provisions are located in one place within the code, Chapter 19. ANALYSIS The proposed ordinance repeals provisions pertaining to bringing or permitting animals within City parks which are inconsistent with updated provisions contained in Chapter 19 of the Municipal Code. FISCAL IMPACT There is no anticipated fiscal impact to the proposed ordinance. RECOMMENDATION Staff recommends approval of the proposed ordinance. y Submitted, Approved: Lorenson Mark A.
