PLAN COMMISSION MINUTES
January 16, 2018
PRESENT: David Borsuk, Ed Bowen, Thomas Fojtik, Michael Ford, John Hinz, Thomas Perry,

Chairperson Fojtik called the meeting to order at 4:00 pm. Roll call was taken and a quorum declared
present.
The minutes of January 2, 2018 were approved as presented. (Vajgrt/Hintz)
I. ZONE CHANGE FROM URBAN INDUSTRIAL DISTRICT (UI) TO SINGLE
FAMILY RESIDENTIAL 9 DISTRICT (SR-9) FOR THREE PROPERTIES LOCATED
AT 1603, 1607 AND 1611 ASHLAND STREET
The applicant and City of Oshkosh requests a zone change from the existing Urban Industrial District
(UI) to Single Family Residential 9 District (SR-9).
Mr. Lyons presented the item, reviewed the sites and surrounding area as well as the land use and
zoning classifications in this area. He stated the applicant would like to convert the existing duplex to a
single family home and add an addition to the rear of the home. In reviewing the area staff identified a
total of three residential homes that were zoned UI. In order to create a consistent land use pattern for
the block, staff believes all three properties should be considered for a zone change to SR-9. Residential
homes adjacent to the three properties are zoned SR-9 and staff is recommending the zoning be
extended to maintain consistency with the adjacent land uses.
Ms. Propp questioned if there were other single family or duplex properties on Harrison Street that did
not have the appropriate zoning.
Mr. Lyons responded that these three residential properties were the only ones not zoned consistent
with the SR-9.
Motion by Vajgrt to approve a zone change from Urban Industrial District (UI) to Single Family
Residential 9 District (SR-9) for three properties located at 1603, 1607 and 1611 Ashland Street.
Seconded by Hinz. Motion carried 7-0.

II. APPROVAL OF COVENANTS FOR THE OSHKOSH AVIATION BUSINESS PARK
Mr. Bowen arrived at 4:04 pm.
Staff requests approval of the private covenants for the Oshkosh Aviation Business Park. The
purpose of the covenants are to provide an additional layer of protection over and above the
restrictions in the Zoning Ordinance and also help to implement the original vision for the park to
be that of an economic development cluster devoted to aviation related commercial and industrial
uses.
Mr. Burich presented an overview of the Aviation Business Park Covenants. He stated the
covenants generally mirror the zoning ordinance but are more restrictive on the use, which must
be aviation or aerospace related or supportive of aviation or aerospace uses. Mr. Burich discussed
the sign requirements in the Business Park as well as outdoor storage and display, maintenance,
repurchase, enforcement and special exceptions.
Mr. Fojtik questioned who initiates covenants in the business parks.
Mr. Davis responded that the City and the Industrial Development Committee initiated the
covenants. He stated the City has adopted covenants for the Southwest Industrial Park, however
the Aviation Business Park covenants is being adopted separately because of the focus on aviation.
Mr. Burich stated without having the Aviation Business Park covenants it would be difficult to
enforce the desire to target aviation related uses.
Ms. Propp questioned how a commercial kitchen could be an aviation related use .
Mr. Davis responded that if the business caters to a specific aviation business it would be allowed.
Mr. Burich stated the business would need to make their case that they are an aviation related
business, or catering to an aviation related business which would need to be approved through a
conditional use permit.
Mr. Bowen questioned under what circumstances a communications tower would be permitted
and how a communications tower is defined.
Mr. Burich stated the permitted uses mirrored what is written in the zoning ordinance for heavy
industrial.
Mr. Lyons read the definition of the communications tower from the City of Oshkosh Zoning
Ordinance.

Mr. Burich stated a communications tower would likely not meet the height regulations with it
adjacent to the airport and the tower would need to be aviation related for it to be permitted in the
business park.
Motion by Vajgrt to approve the covenants for the Oshkosh Aviation Business Park.
Seconded by Borsuk. Motion carried 8-0.
There being no further business, the meeting adjourned at approximately 4:21pm. (Vajgrt/Hinz)
