PURPOSE: APPROVE POLICY FOR INACTIVE ALCOHOL BEVERAGE
LICENSES
INITIATED BY: CITY ADMINISTRATION
WHEREAS, the City of Oshkosh has adopted section 4-5 of the City of Oshkosh
Municipal Code providing that the failure to conduct a license-related business on a
premises for which an alcohol beverage license has been issued for any one year
period shall be a violation of the municipal code; and
WHEREAS, this ordinance has historically been enforced annually at license
renewal time; and
WHEREAS, this practice can result in different treatment of license holders and
may result in longer periods of non-use of alcohol beverage licenses.
NOW, THEREFORE, BE IT RESOLVED, by the Common Council of the City of
Oshkosh that City staff is hereby authorized and directed to review all alcohol beverage
licenses on an ongoing basis for compliance with the provisions of section 4-5 of the
City of Oshkosh Municipal code.
BE IT FURTHER RESOLVED that the City Clerk shall notify licensees in writing
at least 30 days prior to the expiration of the one year period as shown by City records,
that City records show the license holder may be in non-compliance with the City codes
and the license holder may be brought before the Council for purposes of a revocation
or non-renewal hearing.
