PURPOSE: AUTHORIZE A COMMITTEE TO PLAN AND ORGANIZE A
UNITY IN COMMUNITY EVENT TO BE SPONSORED BY THE
CITY OF OSHKOSH
INITIATED BY: MAYOR CUMMINGS
WHEREAS, the City of Oshkosh Mayor (Steve Cummings) requests the Common
Council to authorize formation of a Unity in Community Committee and to act as Chair of
the Committee to plan and to organize a Unity in Community Celebration; and
WHEREAS, the City of Oshkosh Mayor (Steve Cummings) requests the Common
Council to establish an account to support the Unity in Community event, to seek other
funding through sponsorship dollars from the community and to authorize spending from
such account; and
WHEREAS, the City's Special Event Ordinance exempts from the requirement of
obtaining a Special Event Permit special events that are organized by the City of Oshkosh
and provides that departments/divisions in those instances may otherwise determine their
level of participation; and
WHEREAS, the Mayor has requested a waiver of rental fees for the Leach
Amphitheater and extraordinary services charges to the Unity in Community Event
resulting in the need to provide a fund transfer to reimburse departments/divisions for fees
and the costs of extraordinary services provided (such fees are estimated to be$1,268);and
WHEREAS, the Special Event Ordinance permits the Council to waive fees and costs
for providing Extraordinary Services based upon relevant and lawful criteria upon
consideration of the following criteria, as well as other criteria which may be relevant on a
case by case basis:
1. The Special Event's benefit to the quality of life to the City as a whole;

2. The Special Event's financial benefit to the City as a whole;
3. The Special Event is of interest to a smaller segment of the City's population
which the City seeks to encourage;
4. The tradition of the event in the City;
5. The cultural and/or historical significance of the Special Event;
6. Whether or not the Special Event provides services or functions that are
traditionally organized or sponsored by other Cities or governments;
7. Whether or not the Special Event organizers are making good faith efforts to
minimize adverse effects on the health, safety, and welfare of the community
and as a result minimizing the need for City employee involvement;
8. The effect of the Special Events on the neighborhood(s) surrounding the site
of the event;
9. The financial burden the Special Event places on the City's taxpayers as a
whole;
10. The financial condition of the event organizer(s).
WHEREAS, the Mayor requests and recommends waiving of the fees in this case
based upon the encouragement of interest in the unique cultural aspects of different groups
within the Oshkosh Community; the cultural significance of the proposed event, the good
faith efforts of those proposing the event to minimize any adverse effects and to promote
unity, health, safety and welfare of all those members of the community; the anticipated
minimal financial burden associated with the proposed event and the otherwise limited
financial resources available for the first year of this proposed new community-wide event.
• NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh
authorizes the City of Oshkosh Mayor(Steve Cummings) to form and to act as the Chair to
the Unity in Community Committee; to plan and organize the Unity in Community
Celebration Saturday, May 5, 2018 at the Leach Amphitheater in accordance with the
requirements for special events as specified in the City of Oshkosh Municipal Code and the
attached application, with the following exceptions/conditions:
A. The Unity in Community Celebration will be an event organized and sponsored
by the City of Oshkosh. The Unity in Community committee will organize and
conduct the event on behalf the City of Oshkosh.

S. The Unity in Community Committee will obtain separate event insurance to
cover the event which meets the insurance requirements of the Special Events
ordinance.
C. That an account is hereby established for the purpose of organizing and
conducting the Unity in Community Event and that the Committee shall have the
authority to authorize expenditures from such account in support of the event.
D. That the Unity in Community Event meets sufficient criteria as established in the
Special Events Ordinance and that Special Event Fees and Costs for
Extraordinary Services in support of the Unity in Community Event, including
the rental fee for Leach Amphitheater, are hereby waived to that Event and the
Finance Director is hereby authorized and directed to transfer funds to reimburse
departments/divisions for fees and the costs of extraordinary services provided
to the Event.
