AGREEMENT � 5 �) This AGREEMENT, made on the ::0 day of e� 2017, by and between the CITY OF OSHKOSH, party of the first part, hereinafter referred to as CITY, and KL ENGINEERING, 5400 King James Way, Suite 200, Madison, WI 53719, party of the second part, hereinafter referred to as the CONSULTANT, WITNESSETH: The CITY and the CONSULTANT, for the consideration hereinafter named, enter into the following AGREEMENT for OSHKOSH AVENUE AREA TRAFFIC IMPACT ANALYSIS. ARTICLE I. PROTECT MANAGER A. Assignment of Project Manager. The CONSULTANT shall assign the following individual to manage the PROJECT described in this AGREEMENT: Kelly Greuel, P.E., PTOE — Senior Project Manager B. Changes in Project Manager. The CITY shall have the right to approve or disapprove of any proposed change from the individual named above as Project Manager. The CITY shall be provided with a resume or other information for any proposed substitute and shall be given the opportunity to interview that person prior to any proposed change. ARTICLE II. CITY REPRESENTATIVE The CITY shall assign the following individual to manage the PROJECT described in this AGREEMENT: James Rabe, P.E., CPESC — Director of Public Works ARTICLE III. SCOPE OF WORK The CONSULTANT shall provide the services described in the CITY'S Request for Proposal. The CITY may make or approve changes within the general Scope of Services in this AGREEMENT. If such changes affect CONSULTANT's cost of or time required for performance of the services, an equitable adjustment will be made through an amendment to this AGREEMENT. L\ Engineering\ Tracy Taylor\Oshkosh Corp \KL Agreement_11-22-17.docx Page ] of 6 v All reports, drawings, specifications, computer files, field data, notes, and other documents and instruments prepared by the CONSULTANT as instruments of service shall remain the property of the CITY. ARTICLE IV. STANDARD OF CARE The standard of care applicable to CONSULTANT's services will be the degree of skill and diligence normally employed by professional consultants or consultants performing the same or similar services at the time said services are performed. CONSULTANT will re -perform any services not meeting this standard without additional compensation. ARTICLE V. OPINIONS OF COST, FINANCIAL CONSIDERATIONS, AND SCHEDULES In providing opinions of cost, financial analyses, economic feasibility projections, and schedules for the PROJECT, CONSULTANT has no control over cost or price of labor and materials; unknown or latent conditions of existing equipment or structures that may affect operation or maintenance costs; competitive bidding procedures and market conditions; time or quality of performance by operating personnel or third parties; and other economic and operational factors that may materially affect the ultimate project cost or schedule. Therefore, it is understood between the parties the CONSULTANT makes no warranty the CITY's actual project costs, financial aspects, economic feasibility, or schedules will not vary from CONSULTANT's opinions, analyses, projections, or estimates. ARTICLE VI. RECORD DRAWINGS Record drawings, if required, will be prepared, in part, on the basis of information compiled and furnished by others. CONSULTANT is not responsible for any errors or omissions in the information from others the CONSULTANT reasonably relied upon and are incorporated into the record drawings. ARTICLE VII. CITY RESPONSIBILITIES The CITY shall furnish, at the CONSULTANT's request, such information as is needed by the CONSULTANT to aid in the progress of the PROJECT, providing it is reasonably obtainable from City records. To prevent any unreasonable delay in the CONSULTANT's work, the CITY will examine all reports and other documents and will make any authorizations necessary to proceed with work within a reasonable time period. TIME OF COMPLETION The work to be performed under this AGREEMENT shall be commenced and the work completed within the time limits as agreed upon in the CITY's Request for Proposal. The CONSULTANT shall perform the services under this AGREEMENT with reasonable diligence and expediency consistent with sound professional practices. The CITY agrees the CONSULTANT is not responsible for damages arising directly or indirectly from any delays for causes beyond the CONSULTANT's control. For the purposes of this AGREEMENT, such causes include, but are not limited to, strikes or other labor disputes, severe weather disruptions or other natural disasters, failure of performance by the CITY, or discovery of any hazardous substances or differing site conditions. If the delays resulting from any such causes increase the time required by the CONSULTANT to perform its services in an orderly and efficient manner, the CONSULTANT shall be entitled to an equitable adjustment in schedule. ARTICLE IX. COMPONENT PARTS OF THE AGREEMENT This AGREEMENT consists of the following component parts, all of which are as fully a part of this AGREEMENT as if herein set out verbatim, or if not attached, as if hereto attached: 1. CONSULTANT's Proposal dated November 17, 2017 and attached hereto In the event any provision in any of the above component parts of this AGREEMENT conflicts with any provision in any other of the component parts, the provision in the component part first enumerated above shall govern over any other component part which follows it numerically except as may be otherwise specifically stated. ARTICLE X. PAYMENT A. The Agreement Sum. The CITY shall pay to the CONSULTANT for the performance of the AGREEMENT the total sum as set forth below, adjusted by any changes hereafter mutually agreed upon in writing by the parties hereto: • Time and Materials Not to Exceed $37,744 (Thirty Seven Thousand Seven Hundred Forty Four Dollars). • Attached fee schedule(s) shall be firm for the duration of this AGREEMENT. 1:\ Engineering \Tracy Taylor\Oshkosh Corp\ KL Agreement_11-22-17.docx Page 3 of 6 B. Method of Payment. The CONSULTANT shall submit itemized monthly statements for services. The CITY shall pay the CONSULTANT within thirty (30) calendar days after receipt of such statement. If any statement amount is disputed, the CITY may withhold payment of such amount and shall provide to CONSULTANT a statement as to the reason(s) for withholding payment. C. Additional Costs. Costs for additional services shall be negotiated and set forth in a written amendment to this AGREEMENT executed by both parties prior to proceeding with the work covered under the subject amendment. D. Indirect Costs. Indirect costs such as computer time, printing, copying, cell phone charges, telephone charges, and equipment rental shall be considered overhead and shall not be invoiced separately to the PROJECT. E. Expenses. Expenses may be billed with up to a maximum of 10% mark-up. All invoices with expenses shall include supporting documentation of the expense. Failure to include the supporting documentation will result in the reduction of payments by the amount of those expense(s) not including documentation. ARTICLE XI. HOLD HARMLESS The CONSULTANT covenants and agrees to protect and hold the City of Oshkosh harmless against all actions, claims, and demands which may be to the proportionate extent caused by or result from the intentional or negligent acts of the CONSULTANT, his/her agents or assigns, his/her employees, or his/her subcontractors related however remotely to the performance of this AGREEMENT or be caused or result from any violation of any law or administrative regulation, and shall indemnify or refund to the CITY all sums including court costs, attorney fees, and punitive damages which the CITY may be obliged or adjudged to pay on any such claims or demands within thirty (30) days of the date of the CITY's written demand for indemnification or refund for those actions, claim, and demands caused by or resulting from intentional or negligent acts as specified in this paragraph. Subject to any limitations contained in Sec. 893.80 and any similar statute of the Wisconsin Statutes, the CITY further agrees to hold CONSULTANT harmless from any and all liability, including claims, demands, losses, costs, damages, and expenses of every kind and description (including death), or damages to person or property arising out of re -use of the documents without consent where such liability is founded upon or grows out of the acts or omission of any of the officers, employees or agents of the City of Oshkosh while acting within the scope of their employment. ARTICLE XIII. TERMINATION A. For Cause. If the CONSULTANT shall fail to fulfill in timely and proper manner any of the obligations under this AGREEMENT, the CITY shall have the right to terminate this AGREEMENT by written notice to the CONSULTANT. In this event, the CONSULTANT shall be entitled to compensation for any satisfactory, usable work completed. B. For Convenience. The CITY may terminate this AGREEMENT at any time by giving written notice to the CONSULTANT no later than ten (10) calendar days before the termination date. If the CITY terminates under this paragraph, then the CONSULTANT shall be entitled to compensation for any satisfactory work performed to the date of termination. This document and any specified attachments contain all terms and conditions of the AGREEMENT and any alteration thereto shall be invalid unless made in writing, signed by both parties and incorporated as an amendment to this AGREEMENT. ARTICLE XIV. RE -USE OF PROJECT DOCUMENTS All reports, drawings, specifications, documents, and other deliverables of CONSULTANT, whether in hard copy or in electronic form, are instruments of service for this PROJECT, whether the PROJECT is completed or not. The CITY agrees to indemnify CONSULTANT and CONSULTANT's officers, employees, subcontractors, and affiliated corporations from all claims, damages, losses, and costs, including, but not limited to, litigation expenses and attorney's fees arising out of or related to the unauthorized re -use, change, or alteration of these project documents. ARTICLE XV. SUSPENSION, DELAY, OR INTERRUPTION OF WORK The CITY may suspend, delay, or interrupt the services of CONSULTANT for the convenience of the CITY. Significant redevelopment, including potentially a large office building and multiple commercial projects, are proposed within the study area. This redevelopment is expected to drastically alter the vehicular traffic in the corridor. The work shall consist of traffic data collection; an analysis of the traffic access to, through, and within the Oshkosh Avenue corridor; as well as recommendations for potential street layout alterations, roundabout alterations, intersection design, and traffic signal system timing. Additionally, there are new streets being proposed, and recommendations as to the geometric design of those streets is desired. Questions regarding this Request for Proposals shall be emailed to Kelly Nieforth (knieforthCa',ci.oshkosh..wi.us) by 12:00 noon on Thursday, November 9, 2017, with the subject heading of "Oshkosh Avenue Corridor TIA". The questions and appropriate responses will be distributed to all parties receiving this Request for Proposals by 12:00 noon on Monday, November 13, 2017. Enclosed with this letter is the Scope of Services, Map of the Study Area, a sample Professional Services Agreement, and the City of Oshkosh Insurance Requirements. The information contained within these enclosures shall become part of the Agreement with the Consultant selected to perform the Services. Project Background The City of Oshkosh, Wisconsin currently has multiple developments proposed for the Oshkosh Avenue (State Highway 21) corridor on the City's west side between Interstate 41 and the Fox River. The proposed developments and the additional traffic that is anticipated will drastically alter the current traffic conditions. The enclosed map depicts the anticipated study area. The proposed uses along or near Oshkosh Avenue include a four-story office building with approximately 450 employees that will be built on 35 acres of a former golf course with limited existing public infrastructure. Along Oshkosh Avenue, approximately 13 acres of land will be redeveloped for commercial uses. Proposed uses include a hotel, restaurants, a convenience store, a strip mall, and an office building. Construction for the projects is anticipated to commence in the summer of 2018. The City is proposing to extend multiple roads and install public utilities, including sanitary, water, and storm sewer and storm water management to serve the area. At this time, the City is seeking a proposal from a qualified engineering firm ("the Consultant") to provide services for a traffic impact analysis. The Consultant will take a global look at the current and projected corridor traffic, note the weaknesses in the network, and develop alternatives and recommendations to address those weaknesses. II. Scope of Services The City is seeking the services of a qualified consulting firm to provide a complete traffic impact analysis (TIA) for the corridor in accordance with the 2017 Wisconsin Department of Transportation (WDOT) Traffic Impact Analysis Guidelines, updated May 2017. (http://wisconsindot.gov/dtsdMaiiu,ils/traffic-ops/manuals-and.-standards/tiaguide.pdf). The WDOT is not anticipated to be involved in approving the TIA, as Oshkosh Avenue is under the City of Oshkosh permit authority. It is expected the Consultant will perform any necessary data collection. A list of City -provided items to be provided is included below. Draft alternatives are due by January 19, 2018. The final report is due by February 16, 2018. I:\Engineering\Tracy Taylor\Oshkosh Corp\ Oshkosh Ave TIA Scope of Services_11-3-17.docx Page 1 of 5 Additional Scoping information: • The City's objective is to determine what improvements are necessary along Oshkosh Avenue to serve the proposed development immediately and for the next 30 years. • Oshkosh West High School is located to the south of the area and student traffic impacts the Oshkosh Avenue corridor. • The developments are anticipated to occur over a two (2) year period. Initially the office building is anticipated to have 450 employees, with up to an additional 200 employees possible over an undefined timeline. • The hotel is anticipated to have between 50 and 100 rooms. • Determine if private access to Oshkosh Ave should be allowed or prohibited. • The desired level of service (LOS) upon completion of the redevelopment projects is A or B with no lower than LOS C in 30 years. • The City prefers not to reconstruct/reconfigure the roundabout at the intersection of Koeller Street and Oshkosh Avenue. • Along Oshkosh Avenue, additional right-of-way (ROW) will only be available on the north side. • The City currently owns properties on the north side of Oshkosh Avenue at the Sawyer Street intersection with the anticipation of an intersection realignment. • It is important to note that there is a lift bridge over the Fox River immediately east of the intersection of Sawyer Street and Oshkosh Avenue. The presence of this bridge is anticipated to impact potential alternatives for this intersection. • Bicycle Facilities on Oshkosh Ave are not anticipated. It is anticipated the trail system within the park will accommodate bicycles. Consultants should include a minimum of six (6) meetings in their proposal. Four (4) of those meetings are anticipated to be with City staff (project kickoff, alternatives review, and pre -final report review). Two (2) of the meetings are anticipated to be late afternoon/early evening meetings with citizen boards and/or the Common Council. Additional meetings may be held utilizing a web -based video conference call. If Consultant believes additional meetings will be required, please note that in your proposal, and include them in your cost calculations. III. City -Provided Information The City will provide the following information to the eventual Consultant that is selected to perform the services. Traffic crash reports for the intersections within the study area. Mapping of the study area in a ESRI ArcGIS shapefile format to include the following layers: o parcel lines. o ROW lines. o pavement edge. o road centerline. o sidewalk edge. o building footprint. IV. Proposal Requirements Each proposal shall follow the format described herein: 1. Transmittal letter that will include the name, title, address, and phone number of the primary Consultant contact for the proposal. 2. Statement of Qualifications a. Qualification summary of the Consultant b. Qualification summary of and list of the staff intended for the project. c. Description of similar projects. 3. References a. Descriptions of up to three (3) similar assignments completed by the project manager. Include the name of the client, contact person, and telephone number. 4. Project approach a. Provide a detailed write-up of your approach to meet the scope of work. b. Provide a list of tasks to be performed. c. Provide a project schedule. 5. A discussion of proposed additions or modifications to the work scope included in this request. 6. Conflict of Interest: Consultant shall include a list of all current contracts within the City of Oshkosh. This includes contracts for any work, not just traffic -related work. The City will review the current project work to determine if any of the projects present a potential conflict of interest. If the City determines that a conflict of interest exists, that Consultant will be removed from consideration. 7. Fee Proposal: Proposed consultant fees for this project must be submitted. The fee schedule shall reflect the total estimated fee for this project, as described by the Consultant. Proposed resources for each task must be identified, including hours and wage rates for Consultants and subconsultants. Elements that will be evaluated include: a. Availability of resources from the Consultant and subconsultant(s) for the project. b. Estimated hours and fees to complete individual work elements. c. Estimated total fee for the project based on hourly rates, including a not -to exceed cap. d. RFP SUBMISSION Only complete responses will be considered. Responses shall be provided in a sealed envelope marked "City of Oshkosh — Oshkosh Avenue Proposal". A total of five (5) hardcopies (plus a PDF file) of the response shall be provided. PROPOSALS MUST BE RECEIVED NOT LATER THAN 12:00 NOON ON FRIDAY NOVEMBER 17, 2017. The City of Oshkosh reserves the right to accept or reject any or all proposals, to waive any irregularities, informalities, or defects in any proposal, to accept any proposal in whole or in part which shall be deemed in the best interests of the City of Oshkosh, and to negotiate with the successful proponent. The City of Oshkosh will conduct the review, screening, and selection of a professional consultant to provide the services required. The Consultant is encouraged to suggest or incorporate additions or modifications to the scope into the proposal that will enhance or clarify the study. The City will choose a consultant by Wednesday, November 22, 2017 and the agreement will be awarded at the November 28, 2017 Oshkosh Common Council meeting. The Oshkosh Common Council reserves the right to accept or reject any or all proposals, to waive any irregularities, informalities or defects in the proposals, to accept any proposal in whole or in part which it shall deem to be in the best interest of the City of Oshkosh. After final report preparation and presentation, all work papers used in the development of the study shall become the property of the City of Oshkosh and shall be delivered to the Director of Public Works. If electronic versions of the information exist, it shall be provided to the City in electronic form. VI. EVALUATION CRITERIA Staff will evaluate the proposals. If there is no clear choice, a short list of consultants will be invited for an interview. The proposals and oral interview results shall be the basis of selection. VII. GENERAL NOTES ASSIGNMENT: The Consultant shall not assign the agreement or subcontract any portion of the work without the written consent of the City of Oshkosh, nor shall the firm assign any monies due or to become due to them hereunder, without previous consent of the City. DURATION OF SERVICES: The services for this proposal are non-recurring and will terminate upon completion of the final report. CANCELLATION OF RFP: This RFP may be cancelled or any or all bids or proposals may be rejected in whole or in part. Proposals that do not comply with all criteria set forth in this RFP are subject to disqualification. Late responses will not be considered. PAYMENT: The City will develop a payment schedule based upon important milestones being accomplished. The payment schedule will be negotiated with the selected Consultant. OPINIONS OF COST, FINANCIAL CONSIDERATIONS, AND SCHEDULES In providing opinions of cost, financial analyses, economic feasibility projections, and schedules for the PROJECT, CONSULTANT has no control over cost or price of labor and materials; unknown or latent conditions of existing equipment or structures that may affect operation or maintenance costs; competitive bidding procedures and market conditions; time or quality of performance by operating personnel or third parties; and other economic and operational factors that may materially affect the ultimate project cost or schedule. Therefore, it is understood between the parties the CONSULTANT makes no warranty the CITY's actual project costs, financial aspects, economic feasibility, or schedules will not vary from CONSULTANT's opinions, analyses, projections, or estimates. ARTICLE VI. RECORD DRAWINGS Record drawings, if required, will be prepared, in part, on the basis of information compiled and furnished by others. CONSULTANT is not responsible for any errors or omissions in the information from others the CONSULTANT reasonably relied upon and are incorporated into the record drawings. ARTICLE VII. CITY RESPONSIBILITIES The CITY shall furnish, at the CONSULTANT's request, such information as is needed by the CONSULTANT to aid in the progress of the PROJECT, providing it is reasonably obtainable from City records. To prevent any unreasonable delay in the CONSULTANT's work, the CITY will examine all reports and other documents and will make any authorizations necessary to proceed with work within a reasonable time period. 1:\Engineering\Tracy Taylor\Oshkosh Corp\Current Agreement Form_11-3-17.docx Page 2 of 6 ARTICLE VIII. TIME OF COMPLETION The work to be performed under this AGREEMENT shall be commenced and the work completed within the time limits as agreed upon in the CITY's Request for Proposal. The CONSULTANT shall perform the services under this AGREEMENT with reasonable diligence and expediency consistent with sound professional practices. The CITY agrees the CONSULTANT is not responsible for damages arising directly or indirectly from any delays for causes beyond the CONSULTANT's control. For the purposes of this AGREEMENT, such causes include, but are not limited to, strikes or other labor disputes, severe weather disruptions or other natural disasters, failure of performance by the CITY, or discovery of any hazardous substances or differing site conditions. If the delays resulting from any such causes increase the time required by the CONSULTANT to perform its services in an orderly and efficient manner, the CONSULTANT shall be entitled to an equitable adjustment in schedule. ARTICLE IX. COMPONENT PARTS OF THE AGREEMENT This AGREEMENT consists of the following component parts, all of which are as fully a part of this AGREEMENT as if herein set out verbatim, or if not attached, as if hereto attached: 1. CONSULTANT's Proposal dated and attached hereto In the event any provision in any of the above component parts of this AGREEMENT conflicts with any provision in any other of the component parts, the provision in the component part first enumerated above shall govern over any other component part which follows it numerically except as may be otherwise specifically stated. ARTICLE X. PAYMENT A. The Agreement Sum. The CITY shall pay to the CONSULTANT for the performance of the AGREEMENT the total sum as set forth below, adjusted by any changes hereafter mutually agreed upon in writing by the parties hereto: • Time and Materials Not to Exceed $ ( Dollars). • Attached fee schedule(s) shall be firm for the duration of this AGREEMENT. l:\Engineering\Tracy Taylor\Oshkosh Corp\Current Agreement Form_11-3-17.docx Page 3 of 6 B. Method of Payment. The CONSULTANT shall submit itemized monthly statements for services. The CITY shall pay the CONSULTANT within thirty (30) calendar days after receipt of such statement. If any statement amount is disputed, the CITY may withhold payment of such amount and shall provide to CONSULTANT a statement as to the reason(s) for withholding payment. C. Additional Costs. Costs for additional services shall be negotiated and set forth in a written amendment to this AGREEMENT executed by both parties prior to proceeding with the work covered under the subject amendment. D. Indirect Costs. Indirect costs such as computer time, printing, copying, cell phone charges, telephone charges, and equipment rental shall be considered overhead and shall not be invoiced separately to the PROJECT. E. Expenses. Expenses may be billed with up to a maximum of 10% mark-up. All invoices with expenses shall include supporting documentation of the expense. Failure to include the supporting documentation will result in the reduction of payments by the amount of those expense(s) not including documentation. ARTICLE XI. HOLD HARMLESS The CONSULTANT covenants and agrees to protect and hold the City of Oshkosh harmless against all actions, claims, and demands which may be to the proportionate extent caused by or result from the intentional or negligent acts of the CONSULTANT, his/her agents or assigns, his/her employees, or his/her subcontractors related however remotely to the performance of this AGREEMENT or be caused or result from any violation of any law or administrative regulation, and shall indemnify or refund to the CITY all sums including court costs, attorney fees, and punitive damages which the CITY may be obliged or adjudged to pay on any such claims or demands within thirty (30) days of the date of the CITY's written demand for indemnification or refund for those actions, claim, and demands caused by or resulting from intentional or negligent acts as specified in this paragraph. Subject to any limitations contained in Sec. 893.80 and any similar statute of the Wisconsin Statutes, the CITY further agrees to hold CONSULTANT harmless from any and all liability, including claims, demands, losses, costs, damages, and expenses of every kind and description (including death), or damages to person or property arising out of re -use of the documents without consent where such liability is founded upon or grows out of the acts or omission of any of the officers, employees or agents of the City of Oshkosh while acting within the scope of their employment. If the CONSULTANT shall fail to fulfill in timely and proper manner any of the obligations under this AGREEMENT, the CITY shall have the right to terminate this AGREEMENT by written notice to the CONSULTANT. In this event, the CONSULTANT shall be entitled to compensation for any satisfactory, usable work completed. B. For Convenience. The CITY may terminate this AGREEMENT at any time by giving written notice to the CONSULTANT no later than ten (10) calendar days before the termination date. If the CITY terminates under this paragraph, then the CONSULTANT shall be entitled to compensation for any satisfactory work performed to the date of termination. This document and any specified attachments contain all terms and conditions of the AGREEMENT and any alteration thereto shall be invalid unless made in writing, signed by both parties and incorporated as an amendment to this AGREEMENT. ARTICLE XIV. RE -USE OF PROTECT DOCUMENTS All reports, drawings, specifications, documents, and other deliverables of CONSULTANT, whether in hard copy or in electronic form, are instruments of service for this PROJECT, whether the PROJECT is completed or not. The CITY agrees to indemnify CONSULTANT and CONSULTANT's officers, employees, subcontractors, and affiliated corporations from all claims, damages, losses, and costs, including, but not limited to, litigation expenses and attorney's fees arising out of or related to the unauthorized re -use, change, or alteration of these project documents. ARTICLE XV. SUSPENSION, DELAY, OR INTERRUPTION OF WORK The CITY may suspend, delay, or interrupt the services of CONSULTANT for the convenience of the CITY. City staff has coordinated with the Wisconsin Department of Transportation (WDOT) Northeast Region to inform them we were seeking proposals to conduct this Traffic Impact Analysis for the Oshkosh Avenue corridor. WDOT has indicated they would like to be involved in a review and commenting role on this analysis due to the proximity to Interstate 41 and other roadways under WDOT jurisdiction near the study area. It has been noted the intersections east of Westfield Street are not immediately impacted by the proposed development, and questions were raised as to why these intersections were included in the scope of work. The City has included those intersections within this study area in order to have long-range planning guidelines as we continue to perform work within the corridor. For that reason, they have been included within the scope of work for this analysis. We will start by developing a comprehensive understanding of the City of Oshkosh's goals, then pursue an efficient project approach designed to meet these objectives, all while thoroughly completing the appropriate level of technical analysis and WisDOT standard documentation. The fundamental goal of KL's project approach is to provide the City of Oshkosh with: • A high level of comprehension of the existing transportation network's operations characteristics • A full understanding of the traffic impact resulting from the Oshkosh Avenue redevelopment • Sound recommendations based on thorough analysis and practical solutions KL Engineering's project team was selected based on delivering the appropriate expertise for evaluating the multifaceted transportation elements within the Oshkosh Avenue project, and experience in delivering Traffic Impact Analysis documents. Establishing Goals and Priorities We would recommend utilizing the planned kickoff meeting to determine specific objectives and goals of the traffic study. For this meeting, KL would provide a detailed agenda, including questions and potential alternatives for consideration. This would allow us to ensure that our scope of services is focused on reaching the City's goals and priorities for the project, while confidently adhering to the project schedule. Having a detailed scoping discussion will also provide an opportunity to engage our efforts to coordinate with WisDOT staff throughout the project. We also expect that our efforts will be shaped by several key project factors such as: Oshkosh Corporation's development plans, established long range plans, private development projects, and others. Our camera -based traffic counting process provides for several unique data collection opportunities. Video footage is not only used as a cost-effective strategy for processing large amounts of traffic data; it also becomes an asset throughout the project as concrete documentation of traffic conditions, material for public outreach and involvement, and a tool for calibration of traffic models. Understanding Oshkosh Avenue Priorities Through coordination with Oshkosh and WisDOT staff early in the project, we expect to establish a solid understanding of the goals and priorities that are important to key stakeholders. Our team understands the expected priorities include access to and mobility along Oshkosh Avenue, relating to the proposed Oshkosh Corporation and other development. We will also plan to establish an understanding of Oshkosh's priorities and the relative importance of additional factors such as safety, right-of-way impacts, business impacts, and construction schedule. Identifying Challenges and Opportunities Like any traffic study project, the analysis of Oshkosh Avenue will be dependent on several unique factors, specific to the project area. In this case, we expect to focus on multiple challenges near and slightly beyond the project limits that will significantly impact the operations on Oshkosh Avenue. Specific examples of these unique challenges include multiple daily peak traffic patterns along the corridor, driven by the presence of Oshkosh West High School to the south of the project; and the irregular geometry of the Sawyer Street intersection which, combined with its proximity to the lift bridge over the Fox River, requires creative solutions to intersection improvement concepts. Additionally, traffic exiting the Oshkosh Avenue corridor to the west is significantly affected by lane geometry at the Omro Road and Washburn Street roundabout. The lack of lane continuity for westbound traffic in this area has the potential to affect long-term operations within the Oshkosh Avenue corridor, and will be carefully considered within our study. Finally, our team will ensure that the safety of the existing transportation network is thoroughly evaluated, and that any findings will be used productively when evaluating future alternatives. /(,(. City of Oshkosh I Oshkosh Avenue Area Traffic Impact Analysis Page 8 Evaluation of Future Alternatives Establishing Future Traffic Conditions Concurrent with our team's effort to evaluate existing conditions of the Oshkosh Avenue corridor, we will also pursue the necessary information to establish appropriate background conditions for the 30 -year outlook of the study. We expect to coordinate our efforts with WisDOT and the East Central Wisconsin Regional Planning Commission to understand regional traffic patterns. Additionally, we will work with the City of Oshkosh and Oshkosh Corporation to establish accurate parameters for its proposed development, and we will work directly with local community development groups to identify realistic expectations for the type and scale of other private developments in the project area. Once the appropriate development parameters are identified, our team will project trip generation patterns for these properties and assign the trips to the transportation network. Our methodology for these tasks is based on accepted industry practices and in accordance with WisDOT requirements, as well as a thorough evaluation of existing traffic patterns and conditions. We will also be conscious of the traffic generation and assignment for the Omro Road & Koeller Street roundabout to identify whether the intersection can remain with its current geometry. Multimodal Considerations A key part of our analysis and alternative development will be to accommodate all modes of transportation. Consideration of transit routes along Oshkosh Avenue, pedestrian sidewalks/crosswalks and ADA requirements, and bicycle accessibility will be important to incorporate into recommendations for potential corridor improvements. With the current baseball diamond and possible other sport facilities that may be constructed in the redevelopment area, it will be critical to enhance mobility for all users. We will also collaborate with the Go Transit team as part of any recommendations to make sure improvements line up with any possible future transit needs. Intersection Evaluations Critical to the TIA will be evaluations of individual intersections along the Oshkosh Avenue corridor. These intersections include Omro Road & Koeller Street, Oshkosh Avenue & Westfield Street, Oshkosh Avenue & Sawyer Street, and the potential connection of Koeller Street and the Westfield Street extension. Our team understands the challenges associated with developing improvement concepts for the intersection of Oshkosh Avenue with Sawyer Street. In addition to its proximity to the lift bridge affecting the geometry east of the intersection, the challenge of providing a convenient connection to areas north of Oshkosh Avenue should be addressed at this intersection. As part of this project, we have the opportunity to reshape this intersection and create a community focal point. The extensive intersection design experience of our project team will be an asset throughout the development of future concepts for this intersection. The intersections of Westfield Street with Oshkosh Avenue and Koeller Street will also be critical to the outcomes of the TIA. Because the potential Koeller Street intersection with the Westfield Street extension is a new intersection, it will be necessary to thoroughly evaluate design concepts and capacity at this location. The Oshkosh Avenue intersection with Westfield Street will feature major geometry changes including the addition of a fourth approach. This will require careful consideration of how future traffic conditions will compare to the current expectation of drivers, corridor consistency, impacts due to the high school, and how the intersection is used today. M City of Oshkosh I Oshkosh Avenue Area Traffic Impact Analysis Page 9 Overall Corridor Evaluation Our traffic study will initially evaluate a broad range of concepts for improvements to the Oshkosh Avenue corridor, including typical section modifications, direct or indirect access strategies, and other non - intersection features along the roadway. Once a select number of potentially effective strategies have been identified, we will evaluate the feasibility of these concepts and their compatibility with intersection - related recommendations. These corridor improvements could include a two-way left -turn lane (TWLTL), or a raised median with turn lanes. A crucial component of our project approach will be to strategically overlay the timeline of expected development with the timeline of recommended improvements. This will provide the opportunity to make reasonable and timely recommendations based on the projected needs of the Oshkosh Avenue corridor, to allow for a phased implementation of recommendations. Project Deliverables KL Engineering has successfully prepared both abbreviated and full Traffic Impact Analysis documents to WisDOT for several projects in recent years. Our project team includes trained preparers of these documents who are experienced with the most recent version of the TIA guidelines. We will also proudly deliver successful coordination with City staff throughout the project, as well as a professional and supportive presence at public meetings. We recognize that the City of Oshkosh is interested in obtaining the study's conclusions and recommendations in a timely manner, to coordinate with ongoing planning and development efforts. Therefore, we are prepared to begin work on the Traffic Impact Analysis immediately upon authorization, and will work with the City to meet all intermediate project benchmarks, ultimately resulting in the on-time delivery of the final product. Possible challenges to the schedule that may require additional time would be winter weather issues that delay traffic data collection, holidays, and WisDOT coordination.
