PURPOSE: APPROVE GENERAL DEVELOPMENT PLAN AND
CONDITIONAL USE PERMIT FOR A DOG DAYCARE AND
OVERNIGHT BOARDING AT 2575 STATE ROAD 44

PLAN COMMISSION RECOMMENDATION: Approved w/conditions
WHEREAS, the applicant submitted a Conditional Use Permit for the planned
development of a dog daycare and boarding use at 2575 State Road 44; and
WHEREAS,the Plan Commission finds that the General Development Plan for the
proposed planned development of the property at 2575 State Road 44 is consistent with
the criteria established in Section 30-387(6) of the Oshkosh Zoning Ordinance.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that a Conditional Use Permit for the planned development of a dog daycare
and boarding use at 2565 State Road 44 and the General Development Plan for said
development, per the attached is hereby approved with the following conditions:
1. Driveway shall be located a minimum of 175' from the State Road 44 right-of-
way line.
2. Building elevations to comply with the city's exterior design standards in Section
30-243.

BACKGROUND
The subject site consists of an approximate 2.47 acre parcel located at the northeast corner of
W. Waukau Avenue and State Road 44 and has a zoning designation of BP -PD Business Park
with a Planned Development Overlay. The property is presently a vacant parcel. The
applicant requests approval of a General Development Plan and Conditional Use Permit for a
dog daycare and boarding use at 2575 State Road 44.
ANALYSIS
The petitioner is proposing to construct a 7,200 square foot building with 6,000 square foot
outdoor play area that will occupy a dog daycare, boarding, grooming facility and retail
business. The daycare will employ 3-6 people and will be open from 5:45 am to 9:00 pm. The
grooming business will employ 2 additional people. The facility will accommodate 120 dogs
for the daycare facility and 130 for boarding. The outdoor play area will be a pea gravel
surface enclosed by a slated chain link fence.
One access drive is proposed off of W. Waukau Ave. The drive is currently proposed
approximately 80' from the State Road 44 right-of-way line. The drive location will need to be
modified to meet the required 175' separation from the right-of-way line with State Road 44.
The applicant provide a code compliant conceptual sign plan.
The concept drawings provided by the applicant indicate a splitface CMU and EFIS building.
As proposed the structure does not appear to meet the ordinance standards for commercial
buildings. Finalized building elevations will need to comply with the City's Exterior Design
Standards (Section 30-243).

FISCAL IMPACT
Approval of the GDP and CUP will result in the development of a new commercial building
with an estimated value of approximately $1 - $1.5 million that will be added to the overall
property tax rolls.
RECOMMENDATION
The Plan Commission recommended approval of a general development plan and conditional
use permit with conditions at its January 2, 2018 meeting.

Ave. and State Road 44. Commercial Animal Boarding/Daycare requires a Conditional Use
Permit in the BP District.

ANALYSIS
Use/Site Design
The petitioner is proposing to construct a 7,200 square foot building with 6,000 square foot

The daycare will employ 3-6 people and will be open from 5:45 am to 9:00 pm. The grooming
business will employ 2 additional people. The facility will accommodate 120 dogs for the daycare
facility and 130 for boarding. The outdoor play area will be a pea gravel surface enclosed by a
slated chain link fence.
The proposed use is consistent with the City's 2005-2025 Comprehensive Commercial Land -Use
Plan recommendation as Commercial Animal Boarding/Daycare are permitted through the
Conditional Use process. The proposed use is not out of character with the surrounding area as
there are current commercial uses in the immediate vicinity.
Access/Parking
The applicant is proposing one access drive off of W. Waukau Ave. The current drive is proposed
at approximately 80' from the State Road 44 right-of-way line. The drive location will need to be
modified to meet the required 175' separation from the right-of-way line with State Road 44.
Commercial Animal Boarding / Daycare requires 1 parking space per every 1,000 square feet of
gross floor area. The proposed site plan indicates eighteen parking stalls including two handicap
spaces. The propose site plan meets the ordinance requirements for parking. A finalized site plan
including locations of drive location and parking layout will need to meet Zoning Code
requirements and will be analyzed during the Specific Implementation review process.
Signage
A conceptual signage plan has been submitted with the application. The plan indicates a 63 sq. ft.
building sign on the primary commercial building. The plan also indicates a 15' tall free standing
monument sign, with a sign area approximately 75 sq. ft. The conceptual signage plan meets the
BP district requirements for signage. A finalized signage plan including exact size and locations
of signs will need to meet Zoning Code requirements and will be analyzed during the Specific
Implementation review process.
Landscaping
A landscaping plan was not submitted as part of the CUP/GDP request. A finalized landscaping
plan including quantities and location of plant materials will need to meet Zoning Code
requirements and will be analyzed during the Specific Implementation review process.

Stormwater Management
No storm water management plan has been submitted at this time. The applicant has been
advised to discuss storm water management requirements with the Department of Public Works.
A finalized storm water management plan will need to comply with the City's storm water
management ordinance and will be analyzed during the Specific Implementation review process.
Bum
The concept drawings provided by the applicant indicate a splitface CMU and EFIS building. As
proposed the structure does not appear to meet the ordinance standards for commercial
buildings. Finalized building elevations will need to comply with the City's Exterior Design
Standards (Section 30-243). Including, Commercial buildings shall be predominately clad in Class
I materials. Class H and Class III materials may be used as accents and trim not to exceed 50
percent of the total building fagade. Class IV materials are prohibited. Class I materials include
brick, brick veneer, stone, stone veneer, and glass (curtain/storefront). Class II materials include
split face or decorative block, EIFS, and stucco.
Refuse Enclosure
The submitted plan does indicate a location for a dumpster enclosure. Final location and
materials will be analyzed during the Specific Implementation review process.
RECOMMENDATION/CONDITIONS
Staff recommends approval of the Planned Development for a General Development Plan and a
Conditional Use Permit for a dog daycare with overnight dog boarding as proposed with
following conditions:
1. Driveway shall be located a minimum of 175' from the State Road 44 right-of-way line.
2. Building elevations to comply with the city's exterior design standards in Section 30-243.
The Plan Commission approved of the general development plan and Conditional Use Permit as
requested with conditions noted. The following is the Plan Commission's discussion on this item.
Mr. Lyons presented the item and reviewed the site and surrounding area as well as the land use
and zoning classifications in the area. He discussed the entrances, parking area, and driveway
access for the development and reviewed the conceptual site plan. A final landscape plan will be
submitted as part of the Specific Implementation Plan. He stated the building elevations do not
meet the City's Exterior Design Standards of a minimum of 50% Class I materials on a front or
street facing facade and will need to be addressed in the Specific Implementation Plan. Final
plans for all aspects of the development will be reviewed at the time of the Specific
Implementation Plan submittal. He also reviewed the conditions recommended for this request.
Mr. Borsuk inquired if the applicant would change the orientation of the building so the front of
the building faced State Road 44 and the parking was in the rear.

Melissa Fairchild, petitioner, responded she would like the building to face State Road 44 if
possible.
Ms. Propp questioned if the applicant was able to comply with the change in building materials.
Ms. Fairchild responded she would comply with the change in building materials but noted that
it would add to the overall cost.
Motion by Vajgrt to approve a General Development Plan and Conditional Use Permit for a dog
daycare and overnight boarding at 2575 State Road 44 with the following conditions:
1. Driveway shall be located a minimum of 175' from the State Road 44 right-of-way line.
2. Building elevations to comply with the city's exterior design standards in Section 30-243.

• Specific treatment and location of -recreational and open space areas, including designation of
any such areas to be classified as common open space.

Submittal Requirements (from page 2 of the conditional use permit)
Narrative of the proposed conditional use and project:
• We are proposing to build a 7,200 square foot building with 6,000 square foot outdoor play area
that will occupy a dog daycare, boarding, grooming facility and retail business franchise known
as Tallwaggers Doggy Daycare.
• The property is currently vacant and therefore has no current/existing use.
• There are no current structures on the property.
• Dog daycare will require 3 to 6 employees from 5:45am to 9:OOpm depending on the day of the
week and time of day. Grooming will require 2 additional employees daily. Our facility will
comfortably accommodate 120 dogs daily for daycare and 130 dogs for boarding. The more
dogs scheduled to be in our facility, the more staff we will have on site to take care of them.
• The outside play areas will be fenced in with vinyl slatted chain link that will be buried
underground and 7 feet high or top capped depending on city's preference. The outside surface
will be covered in pea gravel for easy cleaning and maintenance. Outside dogs will be
supervised at all times.
• 1 foot of pea gravel will be installed on top of a 1 foot deep bed of crushed gravel to ensure
proper drainage.
• Overnight dogs are kept in individual suites to sleep through the night, which they do because
they are tired from daycare. The building will be concrete block so noise is never an issue.
Hours of operation are 6am to 6pm. Employees stay to clean and supervise boarding dogs until
9pm. All dog waste is picked up immediately. Individual bags are taken to dumpsters 4 times a
day or more if necessary. Dumpsters are emptied on a weekly basis. Odor has never been an
issue at any other franchise location.
• The dumpster area will be built out of concrete block to match the building.
• The parking lot will have 18 stalls with 2 handicap spaces.
• The building will be lit up with security lights overnight and will comply with the City's
recommendation. No "flood lights" will be used.
• Signage will consist of a 15 ft tall by 10 ft wide lit monument sign placed by the road at the city's
preference and a 14 ft wide by 4.5 ft tall lit logo sign on the building over the entry door.
• Surrounding land: To the north across highway 44 is an industrial metal treating service. To the
south across highway 91 is an apartment building. To the east is a packing supply store and to
the west across the intersection of the highways and a small vacant lot is an office condo. None
of these businesses should be disturbed by the dog daycare.
• The current highways and intersection will be adequate to handle the increased traffic created
from the dog daycare. Traffic will mostly be generated early morning and late afternoon.
