PURPOSE: RELEASE EASEMENT AT 1319 BAYSHORE DRIVE
INITIATED BY: CITY OF OSHKOSH
PLAN COMMISSION RECOMMENDATION: Approved
BE IT RESOLVED by the Common Council of the City of Oshkosh that the proper
City officials are hereby authorized and directed to release the easement located in the
vacated right of way,per the attached, and the proper City officials are hereby authorized
and directed to execute any and all documents necessary for purposes of same.

BACKGROUND
The subject property is a residential lot located at 1319 Bay Shore Drive and is approximately
21,180 square feet in area. The property contains a 5,755 square foot two story single-family
residential structure which was built prior to 1931 according to the City of Oshkosh Assessor's
website. The surrounding area consists predominately of single family uses. The subject
property as well as the surrounding area are zoned SR-3-LRO Single Family Residential 3
District with a Lakefront Residential Overlay.
ANALYSIS
The petitioner is requesting the release of an approximately 6 -foot wide by 30 -foot deep
easement located east of the existing home on the property. The subject easement is located in
vacated right-of-way along the east property line where the petitioner is planning to place an
addition to the east of the existing home that would extend into the easement area. The City
no longer has a need for the easement rights as the right-of-way has been vacated and the
Department of Public Works will work with the property owners to have appropriate
documents signed and recorded at the Winnebago County Register of Deeds.
FISCAL IMPACT
Release of the easement will not result in the expansion of any city services but will add
additional property tax value to the community by allowing an addition to be made onto an
existing home.

RECOMMENDATION
The Plan Commission recommended approval of the release of the easement at its December 5,
2017 meeting.

Plan Commission meeting of December 5, 2017
GENERAL INFORMATION

Action Requested:
The petitioner is requesting the release of an approximately 6 -foot wide by 30 -foot deep easement
located east of the existing home on the lot.
Applicable Ordinance Provisions: N/A
Property Location and Type:

Staff does not have concerns with the release of the easement as the City no longer has a need for
the easement rights as the right-of-way has been vacated. The Department of Public Works will
work with the property owners to have appropriate easement documents prepared, signed and
recorded at the Winnebago County Register of Deeds.
RECOMMENDATION/CONDITIONS
Staff recommends approval of the release of the easement as requested.
The Plan Commission approved of the easement release as requested. The following is the Plan
Commission's discussion on this item.
Mr. Slusarek presented the item and reviewed the site and the area of the easement proposed to be
released. He explained the reason for the request which was to allow the property owner to
construct an addition to the home that would extend into the easement area. He also reviewed the
site plan depicting the proposed addition and easement area to be released.
There was no discussion on this item.
Motion by Vajgrt to approve the release of an easement for property located at 1319 Bayshore Drive.
Seconded by Bowen. Motion carried 6-0-1. (Abstained-Borsuk)
