DECEMBER 12, 2017 17-595 RESOLUTION (CARRIED 6-0 LOST LAID OVER WITHDRAWN ) PURPOSE: APPROVE FINAL PLAT KNOWN AS THIRD ADDITION TO CASEY'S MEADOW SOUTH INITIATED BY: CHET WESENBERG PLAN COMMISSION RECOMMENDATION: Approved w/ conditions BE IT RESOLVED by the Common Council of the City of Oshkosh that the final plat known as Third Addition to Casey's Meadow South, generally located north of Sawyer Creek, south of West 91h Avenue, east of Clairville Road and north of West 201h Avenue, per the attached, is hereby approved with the following conditions: 1. A terrace tree plan will be submitted and approved by the Forestry Division and Department of Community Development prior to Final Plat acceptance by the City. 2. A street lighting plan will be submitted and approved by the Electric Division and Department of Public Works prior to Final Plat acceptance by the City. TO: Honorable Mayor and Members of the Common Council FROM: Darryn Burich Director of Planning Services DATE: November 22, 2017 RE: Approve Final Plat Known as Third Addition to Casey's Meadow South (Plan Commission recommends approval) BACKGROUND The applicant is requesting approval of a final plat containing 20 single family lots and right- of-way identified as the Third Addition to Casey's Meadow South. The 6.569 acre plat is zoned SR -5 Single Family Residence - 5 District. An overall preliminary development and final plat (20 lots) was approved for this development in 2005 followed by the First Addition (12 lots) in 2008 and Second Addition (24 lots) in 2012. The proposed plat is located north of Sawyer Creek, South of W. 9t" Avenue, east of Clairville Road, and north of W. 20thAvenue and creates extensions of Casey Trail and Cloe Jude Drive and a new street, Wyatt Way, with lots located on both sides of the proposed right-of-way. ANALYSIS The owner is proposing to subdivide this area consistent with the preliminary plat approved in 2005 involving 105 lots of which 56 lots have been final platted to date. All lots meet or exceed minimum lot requirements for the underlying zoning district and front on a public street. The plat is consistent with the City's Comprehensive Plan and temporary cul-de-sac easements are in place at the ends of Casey Trail and Wyatt Way to provide a turnaround area until the subdivision develops to the west at which time the easements will be released. A terrace tree plan and streetlight plan have not yet been submitted but will be reviewed and approved by various city departments to ensure that the plans will not conflict with public and private utilities. The developer has chosen to pay parkland dedication fees in lieu of land dedication. The Department of Public Works has reviewed the plat and does not have any concerns with the parcel configuration and grading, drainage and erosion control plans have been conditionally approved. The Fire and Police Departments and the Oshkosh Area School District have not expressed any concerns with being able to serve the additional housing units and city staff will work with the developer to enter into a developer's agreement for construction of public infrastructure. No expansion of other city services appears necessary to service the newly platted area and as the lots develop with homes will have a positive impact on the overall assessed property values. The plat creates extensions of Casey Trail and Cloe Jude Drive and a new street, Wyatt Way with lots to be located on both sides of the proposed rights-of- way. West Vacant Land f SR -5 Single Family Residential - 5 Comprehensive Plan Land Use Recommendation Land Use 10 Year Recommendation Residential 20 Year Recommendation Residential ANALYSIS The owner is proposing to subdivide this area consistent with the previous preliminary plat approved by the City in 2005. The original preliminary plat involved 41.05 acres and 105 lots, of which 56 lots have been final platted to date. All lots meet or exceed minimum lot requirements for the SR -5 District and all lots front on a public street. The lot configurations differ slightly from the preliminary plat in regard to lot widths for the proposed parcels along the north side of Wyatt Way. These alterations are minor, the basic configuration is similar and the lots still meet minimum requirements of the SR -5 District (60 feet wide, 100 feet deep, and 7,200 square feet in area). The City's Comprehensive Land Use Plan identifies this area as appropriate for residential development and approval of this plat is consistent with the Plan's recommendation. Temporary cul-de-sac easements have been placed at the southwest ends of Casey Trail and Wyatt Way. This is to provide a turnaround area for emergency, Public Work's and other large vehicles. As the subdivision develops to the west, the easements will be released as they are no longer needed. The developer has chosen to pay parkland dedication fees in lieu of land dedication which would have totaled 22,000 square feet. The payment fee is $200 per lot at plat acceptance ($4,000 total) and an additional $200 per lot at building permit issuance. A terrace tree plan and streetlight plan have not been submitted at this time. The developer will work with the Department of Public Works, the Forestry Division and City Electrician to ensure the plans will not conflict with public and private utilities. The Department of Public Works has reviewed the final plat and does not have any concerns with the parcel configuration. The grading and drainage plan and erosion control plan have been conditionally approved by the Department of Public Works and are currently reviewing revisions. The Department of Public Works and City Attorney will work with the developer to enter into a developer's agreement for construction of public infrastructure. The Fire and Police Departments, and Oshkosh Area School District have been notified of this request and have not expressed any concerns with being able to serve the additional housing units. RECOMMENDATION/CONDITIONS Staff recommends approval of the final plat for the Third Addition to Casey's Meadow South with the following conditions: 1. A terrace tree plan will be submitted and approved by the Forestry Division and Department of Community Development prior to Final Plat acceptance by the City. 2. A street lighting plan will be submitted and approved by the Electric Division and Department of Public Works prior to Final Plat acceptance by the City. The Plan Commission approved of the final plat for the Third Addition to Casey's Meadow South as requested with conditions noted. The following is the Plan Commission's discussion on this item. ITEM—Final Plat — Third Addition to Casey's Meadow South Mr. Nau presented the item and reviewed the site and surrounding area as well as the land use and zoning classifications in this area. He discussed the approval of the previous plats in this vicinity and that this addition to the plat was consistent with the Comprehensive Plan. He reviewed a copy of the proposed final plat which is consistent with the approved preliminary plat and meets the requirements for lot sizes and dimensions. He also discussed the road connections for the newly developed lots and stated that the developer has opted to pay the park land dedication fee in lieu of the land dedication. He discussed the terrace tree and street lighting plans which will be submitted at a later date and the storm water management plans are in the process of being reviewed by the Department of Public Works. The Oshkosh Police and Fire Departments as well as the school district have no concerns with providing services to the development and he reviewed the conditions recommended for this request. Mr. Kiefer questioned if there were any concerns with the lack of park land in this area and that the Westhaven Park was the only park land in this vicinity. Mr. Burich discussed the lack of park land in this area and that the Parks Department did not feel the need for park space in this location. He stated that staff will have to work with the Parks Department to acquire land in the future to meet the need for recreational space in this vicinity. Mr. Thorns questioned who starts the process to map areas for park purposes. Mr. Burich responded that it would be the Advisory Park Board that would initiate the process and determine the areas to be mapped for park development and the Commission would approve the mapping in conjunction with the Park Board. He continued discussion in relation to the plat for Bristol Square and the Ripple and Oregon development which both opted to dedicate park land area instead of the fee. Mr. Kiefer discussed that there was an attempt to develop plans for the Sawyer Creek area park space and it was currently in process however the Carl Traeger site was more frequently used as park area now however that was school district property and not a public park space. Mr. Thoms discussed the issue that the city is approving pockets of development without approving the associated amenities to go with them. Mr. Burich explained that there is some difficulty to completing mapping of areas for park purposes and that the city needs to be more aggressive regarding this matter. He felt that we should consider holding a joint session with the Advisory Park Board regarding this issue. Ms. Propp commented that she felt that the city has low park dedication fees in lieu of the land dedication and that the fees should be increased to a higher amount. She did not feel that the city makes parks a high priority as far as development. Mr. Burich explained that the park land dedication fee is not an impact fee. The payment in lieu of land dedication was also not able to be collected for some time due to a change in state regulations. Mr. Borsuk commented that the point of view was to collect funds in lieu of land dedication for some time now and the Advisory Park Board needs to work on developing appropriate park land with ITEM—Final Plat — Third Addition to Casey's Meadow South neighboring property owners and developers in the future. Mr. Bowen questioned if it would be possible to have the preliminary plat included in the staff report for future final plats to avoid confusion on what was previously approved. Motion by Vajgrt to approve a final plat for the third addition to Casey's Meadow South with the following conditions: 1. A terrace tree plan will be submitted and approved by the Forestry Division and Department of Community Development prior to Final Plat acceptance by the City. 2.
