DECEMBER 12, 2017 17-590 ORDINANCE FIRST READING (CARRIED 6-0 LOST LAID OVER WITHDRAWN ) PURPOSE: APPROVE COMPREHENSIVE LAND USE MAP AMENDMENT FOR A PORTION OF LAKE SHORE MUNICIPAL GOLF COURSE GENERALLY LOCATED NORTH OF OSHKOSH AVENUE AND WEST OF PUNHOQUA STREET FROM PARK, RECREATION AND OPEN SPACE TO COMMERCIAL INITIATED BY: CITY ADMINISTRATION, PETITIONER PLAN COMMISSION RECOMMENDATION: Approved AN ORDINANCE TO AMEND THE COMPREHENSIVE PLAN OF THE CITY OF OSHKOSH, WISCONSIN The Common Council of the City of Oshkosh, Wisconsin, do ordain as follows: SECTION 1. City Administration requests a map amendment to the Recommended 10 Year and 20 Year Comprehensive Plan Land Use maps from a park, recreation and open space land use designation to a commercial land use designation for property generally located north of Oshkosh Avenue and West of Punhoqua Street, City of Oshkosh, Winnebago County, Wisconsin. SECTION 2. The Plan Commission recommended approval of said amendment. SECTION 3. The City has held a public hearing on this Ordinance, in compliance with the requirements of Section 66.1001(4)(d), Wisconsin Statutes. SECTION 4. The Common Council of the City of Oshkosh hereby approves amending the Comprehensive Plan Land Use Maps changing the land use designation on the property generally located north of Oshkosh Avenue and West of Punhoqua Street from park, recreation and open space to commercial. This ordinance amends the Comprehensive Land Use Maps, changing the land use designation generally located north of Oshkosh Avenue and West of Punhoqua Street from park, recreation and open space to commercial. TO: Honorable Mayor and Members of the Common Council FROM: Darryn Burich Director of Planning Services DATE: December 7, 2017 RE: Approve Comprehensive Land Use Plan Map Amendment for a Portion of Lake Shore Municipal Golf Course Generally Located North of Oshkosh Avenue and West of Punhoqua Street from Park, Recreational and Open Space to Commercial (Plan Commission recommends approval) BACKGROUND The subject area consists of approximately 35 acres of the Lakeshore Municipal Golf Course, located within the City of Oshkosh, north of Oshkosh Avenue and west of Punhoqua Street. The parcels are bordered by proposed commercial to the south, remaining park space to the east and west and Lake Butte des Morts to the north. The subject area is located on the northeast transitional area of the I-41 corridor characterized by a mixture of commercial/retail uses to the west and residential to the east and south. The subject area is the proposed site for a new global corporate headquarters for Oshkosh Corporation. ANALYSIS The City's 2005-2025 Comprehensive Plan contains a 10 -Year and 20 -Year Land Use Map that is intended to be used as a general reference tool for determining appropriate future land use and growth patterns on a broader scale. Sections of the Comprehensive Plan and mapping portions need to be periodically revised to conform to changes in land use patterns or market demands. In November, the Common Council approved the possible sale of a portion of Lakeshore Municipal Golf Course to Oshkosh Corporation for the development of a new global headquarters and the proposal for this site was selected by the company from a pool of candidates. The current institutional land use designation was used for the publicly owned golf course and the City's Comprehensive Plan Land Use needs to be updated to change the designation to commercial land use to allow the development of a global corporate headquarters. The subject site designated for the land use amendment is the property to be purchased by Oshkosh Corporation and will remain separated by Park, Recreation and Open City Hall, 215 Church Avenue P.O. The re -designation of the 35 acres of Lakeshore Municipal Golf Course will aid in the development of the global headquarters while still maintaining 65 acres for redevelopment into active or passive parklands creating broader community benefit and open up areas of public use. FISCAL IMPACT Changing the land use maps as proposed helps to facilitate a multimillion dollar development of the subject area that will result in construction of the new global headquarters for Oshkosh Corporation. As part of the development, city streets and public infrastructure will need to be extended and will be constructed at the City's expense. RECOMMENDATION The Plan Commission recommended approval of the land use amendment at its December 5, 2017 meeting. The subject area is designated for Park, Recreation and Open Space land use designation; the applicant is requesting a change to a commercial land use designation. Part of the update entailed refining the 20 -Year Recommended Land Use Map and the creation of a 10 -Year Land Use Map. The Land Use section of the plan states that, "the maps are used to give the community a better idea of how land in the city will be used in the future. The future land use maps were created using a variety of resources. These resources include the existing land use map and special area plans, aerial photography, land use maps of adjoining communities, soils and environmentally sensitive areas map (which help to understand development limitations), utility and facility service area maps, and existing and future transportation corridors. The maps show the general location and type of land uses within the city and on the city's periphery. The maps are to be used as a basis for making general land use decisions relative to the City's land use control regulations. Land use designations will be evaluated in terms of their consistency with these maps and other applicable elements of this Plan and all other applicable Ordinances". These land use maps are intended to be used as a general reference tool for determining appropriate future land use and growth patterns. When creating these maps, recommended uses were determined on a broader scale rather than a parcel by parcel basis. Staff realizes that sections of the Comprehensive Plan, including mapping portions, need to be updated or revised periodically to conform to changes in land use patterns, or in this case, to accommodate logical requests. On November 8, 2017, the City of Oshkosh adopted resolution 17-534 for the possible sale of a portion of Lake Shore Municipal Golf Course to Oshkosh Corporation for a new global headquarters. On November 22, 2017 Oshkosh Corporation announced they had selected Oshkosh from a pool of candidates to build their new corporate headquarters. Looking at the current 10 and 20 -Year Land Use Maps in the Comprehensive Plan, the institutional designation was used for the publicly owned Lakeshore Municipal Golf Course. In order for the City of Oshkosh and Oshkosh Corporation to begin the development process, the Comprehensive Plan Land Use will need to be updated to allow the development of a global corporate headquarters. Staff is proposing to change the designation to commercial land use. The subject properties represent the approximate area Oshkosh Corporation is negotiating to purchase from the City of Oshkosh. The subject area will remain separated by Park, Recreation & Open Space uses to the north, east, and west. The properties immediately to the south (along Oshkosh Avenue) are currently pending a comprehensive plan land use amendment from residential land uses to commercial land uses. Staff supports the proposed change from Park, Recreation and Open Space land use designation to commercial land designation for the development of a new global headquarters for Oshkosh Corporation. The re -designation of approximately 35 acres of the existing Lakeshore Municipal Golf Course will aid in the development of the global headquarters, while still maintaining approximately 65 acres for redevelopment into a combination of active or passive parklands which will create a broader community benefit and open up areas of public use. This would tentatively include plans to extend the riverwalk to connect Rainbow Park and USH 41 Tribal Heritage Trail and install trails within the remaining parkland. RECOMMENDATION/CONDITIONS Staff recommends approval of an amendment to the Comprehensive Land Use Map. Item — Comp Land Use Map Arndrnt-Portion of Lake Shore Municipal Golf Course The Plan Commission approved of the Comprehensive Land Use Map amendment as requested. The following is the Plan Commission's discussion on this item. Mr. Lyons presented the item and reviewed the site and surrounding area as well as the land use and zoning classifications in this area. He reviewed the area requested for the land use map amendment for use by Oshkosh Corporation for the site of the new global corporate headquarters. He reviewed the City's Comprehensive Plan and zoning maps for this area and discussed the pending land use map amendment area for the Oshkosh Corporation site and the adjacent lots on Oshkosh Avenue which was recommended for approval by the Plan Commission and is in process of review and approval by the Common Council. Mr. Thoms inquired if the intention was that both areas would be the same under the new proposed zoning ordinance and this action would make the land use designation consistent with an amendment to the City's Comprehensive Plan. Mr. Burich responded that the land use designation would be consistent with both areas and there would be a zoning ordinance change coming forward at the next meeting. Ms. Propp questioned if the properties to the left of the proposed land use amendments were already zoned and designated as commercial in the City's Comprehensive Plan. Mr. Lyons responded affirmatively and stated that the land use amendment would extend the commercial designation through the remaining parcels up to Mary Jewel Park making it consistent with the other properties. Motion by Thoms to approve a Comprehensive Land Use Plan Map Amendment for a portion of Lakeshore Municipal Golf Course. Seconded by Vajgrt. Motion carried 7-0.
