HomeMy WebLinkAbout26. 17-524 OCTOBER 24, 2017 17-524 ORDINANCE FIRST READING (CARRIED 6-0 LOST LAID OVER WITHDRAWN ) RULES SUSPENDED TO APPROVE ON FIRST READING PURPOSE: AMEND PARKS ORDINANCE PERTAINING TO FISHING ALONG THE SOUTH SIDE OF THE FOX RIVER RIVERWALK INITIATED BY: PARKS DEPARTMENT A GENERAL ORDINANCE OF THE CITY OF OSHKOSH AMENDING SECTION 19-4(S) PERTAINING TO FISHING ALONG THE FOX RIVER RIVERWALK The Common Council of the City of Oshkosh does ordain as follows: SECTION 1. That Section 19-4(S) of the City of Oshkosh Municipal Code pertaining to fishing along the Fox River Riverwalk be repealed and recreated to read as follows: (S) Fishing is prohibited in the following areas of the Fox River Riverwalk: (1) along the north side of the Riverwalk from Main Street to Jackson Street (2) along the south side of the Riverwalk from the Oregon Street Bridge east 425 feet (3) along the south side of the Riverwalk from the Oregon Street Bridge west 1,950 feet SECTION 2. This ordinance shall be in full force and effect from and after its passage, publication and placement of appropriate signage for section 19-4(S)(1) and (2) and from and after passage, publication, completion of construction and placement of appropriate signage for section 19-4(S)(3) (estimated completion- Fall 2018). SECTION 3. Publication Notice. Please take notice that the City of Oshkosh enacted ordinance #17-524 AMEND PARKS ORDINANCE PERTAINING TO FISHING ALONG THE SOUTH SIDE OF THE FOX RIVER RIVERWALK, (A GENERAL ORDINANCE OF THE CITY OF OSHKOSH AMENDING SECTION 19-4(S) PERTAINING TO FISHING ALONG THE FOX RIVER RIVERWALK) effective on October 24, 2017. The ordinance currently prohibits fishing along the north side of the Riverwalk from Main Street to Jackson Street. The ordinance OCTOBER 24, 2017 17-524 ORDINANCE FIRST READING CONT'D amends the park ordinances pertaining to the Fox River Riverwalk to prohibit fishing along the south side of the Riverwalk from the Oregon Street Bridge east 425 feet and from the Oregon Street Bridge west 1950 feet. The ordinance would become effective immediately for the area east of the Oregon Street Bridge and upon completion of construction for that area west of the Oregon Street Bridge. TO: Honorable Mayor and Members of the Common Council FROM: Ray Maurer, Parks Director DATE: October 19, 2017 RE: Amend Parks Ordinance Pertaining to Fishing along the south side of the Fox River Riverwalk BACKGROUND At its meeting on Tuesday, October 24, 2017, the City Council will have on its agenda an amendment to Section 19-4(S) of the City of Oshkosh Municipal Code, Parks and Recreation, pertaining to fishing along the south side of the Fox River Riverwalk. The ordinance amends the park ordinance pertaining to the Fox River Riverwalk by prohibiting fishing along the south side of the Riverwalk from the Oregon Street Bridge east approximately 425 feet to the Dockside Tavern property and from the Oregon Street Bridge west approximately 1,950 feet to the pedestrian bridge at the former Boatworks property (see attached map). This is similar to the existing ordinance which prohibits fishing along the north side of the Riverwalk from Main Street to Jackson Street in the City Centre area. ANALYSIS The Advisory Parks Board considered this item on Monday, October 9, 2017 and unanimously recommended approval by the Common Council. As the various segments of the Riverwalk have been developed, city staff has had discussions with adjacent property owners regarding rules and regulations that may be necessary to accommodate Riverwalk users as well as the adjacent developments. At the request of the developers of the former Jeld Wen site, and as recommended by the Advisory Parks Board, staff is proposing that fishing be prohibited along these sections of the Riverwalk. Staff is also requesting that Council waive the rules and adopt the amended ordinance at the first reading to help expedite the DNR permitting process and construction of this section of the Riverwalk.
