NOW, THEREFORE, the Common Council of the City of Oshkosh do ordain as follows: SECTION 1. The proper City officials are hereby authorized and directed to comply with the following requirements of Section 66.0217(9)(a) and 66.0307(10) of the Wisconsin Statutes and the City Clerk shall give written notice to the Secretary of State. The Plan identifies 4 areas of the town that will be "attached" to the city in phases commencing in 2013 with the first phase, Zone A attachments, and ending in 2043 with the Zone D attachments. The currently proposed Zone B attachments are comprised of 127 parcels totaling 100.64 acres. \►SIIIIIIIARMI Zone B includes 133 parcels of land totaling 100.64 acres that consists of 21 separate legal descriptions per the attached maps. The majority of the property to be attached are single family uses (36) at approximately 40 acres. This was slightly complicated given that the updated zoning ordinance created new and expanded zoning classifications. For example, the old ordinance had one single family zoning district and the new code has 4 different single family zoning classifications. Thus if a single family residence to be attached is attaching in a neighborhood of SR -3 then it is being proposed to be attached as an SR -3. If the property was commercially zoned with a C-2 General Zoning District, then it would proposed to be attached as a SMU Suburban Mixed Use Zoning District. The Zone B area contains 21 separate attachment areas in a large area generally bounded on the north by Emmers Lane, south by STH 91, on the east by 141, and on the west just west of Oakwood Road. The areas being attached along Washburn Street will likely transition at some point to commercial uses and zoning. Most of the single family parcels are already developed and the largest vacant piece on the south side of Witzel Avenue has some development options from multiple family, to mixed use, to potentially single family. The emergency service and other city service providers have been contacted relative to the proposed Zone B attachments and have not expressed any concerns relative to service provisions. Properties currently being served by private on-site waste disposal systems will be required to convert to city service if available. There are several properties in the northern portion of the attachment that are and will remain in the Algoma Sanitary District. FISCAL IMPACT No unnecessary or unusual services are anticipated to have to be provided to the newly attached properties over and above what is already being provided to the adjacent areas located within the City. Some properties that are not currently "hooked up" to city services will need to connect in the City's required timeframes. RECOMMENDATION Staff recommends approval of the Intermediate Attachment Ordinance pursuant to the terms of the duly adopted and State approved Cooperative Plan between the City of Oshkosh and Town of Algoma. The Agreement specifically identifies geographic zones of the Town that will attach in four phases which commenced in 2013 with Zone A which were areas of the Town east of Interstate 41. In 2018, Zone B, which includes your property or a portion of your property, is scheduled to attach to the City. The Zone B area includes sections of the Town west of Interstate 41 to the western City limits as they were in 2003. The Intermediate Attachment Ordinance will be heard by the Oshkosh Common Council at its October 101h and October 24th meetings and will be effective as of 12:01 a.m. on March 1, 2018. Stat. sec. 66.0307 to be submitted to the Wisconsin Department of Administratioin for approval; and WBE"AS, the intergovernmental agreement is in the Public interest; . . NOW, THERFORB, BE IT RBSOt D, by the Town Board of the Town of Algoma, Winnebago County, Wisconsin as follows: 1. The intergovernmental agreement, a copy of which is attached, is approved -and the Town Chairperson and Town Clerk are authorized to execute the intergovernmental agreement as well as any other documeats related thereto or required .thereby in a form approved by the Town Attorney. 4 2. pat-ticipation in the preparation of a cooperative plan is authorized as provided in Wig. Stat. -sec. 5fi.0307(4)(a).. 3. The Town Attorney, and all necessary staff are authorized and directed to paAicipa'te in the preparation of a cooperative plan which coiotains all of the applicable provisions set forth in the intergovernmental agreement and any further provisions deemed necessary by Town and City attorneys under Wis. Stat. sec. 66.0307. (f) Any territory within the Expansion Area not attached to the City as a Voluntary Attachment shall be attached to the City as an intermediate or"Final Attachment In accordance with the time frames and procedures governing such Attachments set forth below. 1:0.02 Procedure for Intermediate Attachment. Geographic zones within the Expansion Area may be attached by an Intermediate Attachment Ordinance adopted by a majority vote of the City of Oshkosh Common Council as follows: (a) zone A. At any time between January 1, 2012 and October 31,'2012, the City may adopt an Intermediate Attachment Ordinance attaching the territory in Zone A. The attachment shall be effective as of 12.01 a.m, on Marcie 1, 2013. (b) Zone B. At any time between January 1, 2017 and October 31, 2017, the City may adopt an Intermediate Attachment Ordinance attaching the territory In zone B and, if not previously attached, -the territory In Zone A. The attachment shall be effective as of 1.2:01 a.m. on March 1, 2018, (c) Zone C. At any time between January 1, 2022 and October 31, 2022, the City may adopt an intermediate Attachment Ordinance attaching the territory in Zone C and, if not previously attached, the territory In Zones A and B. The attachment shall be effective as of 12.01 a.m. on March 1, 2021 (d) Intermediate Attachment Ordinances may designate temporary or permanent zoning classifications for each parcel of land as prescribed in Wis. Stat. § 62.23(7)(d). The City Clerk shall file, record, or send Intermediate Attachment Ordinances in the same manner as described under paragraph 10.01(b) above. (e) Intermediate Attachment Ordinances shall Include all territory within each geographic zone as Identified in Exhibit A and as scheduled to be attached per paragraphs (a), (b) and (c) of this section. (f) intermediate attachment Ordinances shall not require the consent of owners, residents or electors. 10.03 Procedure for Final Attachment. All, but not part, of the territory within the expansion area of the Town on March 1, 2043 may be attached to the City by a Final Attachment Ordinance adopted by a majority vote of the City of Oshkosh Common Council as follows: 11
