PURPOSE: APPROVE CONDITIONAL USE PERMIT FOR A FREIGHT
TERMINAL DEVELOPMENT AT 3010 BRADLEY STREET

PLAN COMMISSION RECOMMENDATION: APPROVED W/ CONDITIONS
BE IT RESOLVED by the Common Council of the City of Oshkosh that a
conditional use permit is hereby granted for a semi freight terminal at 3010 Bradley Street,
per the attached, with the following conditions:
1) Driveway entrance will be changed to a 40-foot/70-foot opening;
2) Photometric plan shall be revised to match the site/landscape plan.
3) Truck operation only allowed on paved surfaces.

BACKGROUND
The subject site is a vacant parcel located on the east side of Bradley Street approximately 500
feet north of W. Waukau Avenue. The 7.85 acre property has a HI Heavy Industrial District
zoning designation while the 10 and 20 year Comprehensive Land Use Plans recommend
industrial development for the site. The proposed development is bounded by industrial uses
to the north and west, a cemetery to the south and an active railroad to the east.
ANALYSIS
The applicant is proposing to develop a freight terminal for semi tractors and trailers which is
permitted with approval of a conditional use permit in the underlying zoning district and is
compatible to existing uses in the area. The facility will operate intermittently 24 hours per
day, seven days a week with 100 trips to and from the site per week with the possibility of
future expansion. The proposed development consists of a 39,000 square foot asphalt paved
area which meets the minimum setback requirements of the underlying zoning district. The
parking area is north of the existing rail spur and has a concrete dolly pad for use of the semi
trailers' stand pads. The plan depicts a 6 -foot tall fence along a portion of the site and a dense
mature tree row along another portion providing an effective sound and visual buffer. Access
to the site is proposed to be from Bradley Street, and in this initial phase, there are no
employees present therefore no designated parking areas are required but there is ample
paved area if the need arises. Signage plans have not yet been submitted but will need to meet
code standards and lighting plans appear to meet code requirements. A landscaping plan has
been submitted which is minimal due to the small scale scope of this development and
provides an ample vegetative buffer between this development and properties to the south.
Storm water management plans have not yet been submitted but will be required to meet code
standards during the site plan review process.

FISCAL IMPACT
Approval of the CUP as requested to permit the use should not require additional city services
to serve the area as this is an infill city site. The additional truck traffic may, however,
exacerbate deterioration of Bradley Street which is already in poor condition and will require
improvement in the future and which is not currently in the 5 year CIP.
RECOMMENDATION
The Plan Commission recommended approval of the conditional use permit with conditions at
its October 17, 2017 meeting.

The applicant is requesting a Conditional Use Permit for development of a semi freight terminal
at 3010 Bradley Street for Karl's Transport, Inc.
Applicable Ordinance Provisions:
Conditional Use Permit standards are found in Section 30-382 of the Zoning Ordinance.
Property Location and Background Information:
The subject site is a vacant parcel located on the east side of Bradley Street approximately 500 feet

ANALYSIS
Use
The applicant is proposing to develop a freight terminal for semi tractors and trailers. The use is
permitted via conditional use permit within the HI zoning district and is compatible to existing
uses in the area. The facility will operate intermittently 24 hours per day, seven days a week with
approximately 100 trips to and from the site per week.
The applicant states that there is a possibility of a future expansion including a terminal building
and additional semi truck and trailer parking areas. At that time the owner will need to apply for
an amendment to the Conditional Use Permit if this request is approved by the Common Council.
Site Design
The proposed development consists of a 250 -foot by 156 -foot, 39,000 square foot asphalt paved
area setback 50 feet from the right-of-way and 24 feet and 78.6 feet from the north and south
property lines, respectively. The east edge of the surface is shown to be +/- 590 feet. The paved
area meets minimum setback requirements (30 -foot front, 20 -foot side 25 -foot rear) of the HI
district. The parking area also has a 10 -foot concrete dolly pad running east -west for use of the
semi trailers' stand pads. The parking area is also north of the existing rail spur. Staff is unsure if
the spur is functional or not, or if the owner intends to make use of the spur if it is functional.
The plan shows a proposed 6 -foot tall chain-link fence at the 50 -foot setback along the front of the
property and along the north property line. The submitted narrative states this is mainly for
security reasons. A security gate will allow access from Bradley Street. The south property line is
lined with a dense, mature cedar tree row running over 700 feet from the front towards the back
of the property. This and the 78 -foot southern setback act as a very effective sound and visual
buffer from the cemetery use to the south.
Access and Circulation
Access to the site is proposed to be a Class III entrance from Bradley Street just south of center of
the site. The submitted plan shows a 37.5 -foot opening at the property line and 68 feet at the road
surface whereas the Access Control Ordinance requires a 40-foot/70-foot opening. This issue will
be discussed at site plan review.
Parkin
The proposed use only requires off-street parking for employees on-site at the maximum shift. In
this initial phase it is expected no employees will be present therefore no designated parking
areas are required. Staff has no concerns with this as there is ample paved area available if the
need arises on a short-term, temporary basis.
Signage and Lighting
The applicant's submittal does not include a sign package. Any signage will need to meet the
requirements allowed in the HI District.

A lighting plan was submitted. Light levels do meet code requirements, however the dolly pad
layout differs from the site plan. Staff recommends the lighting plan be revised to be consistent
with the site plan.
Landscaping
A landscaping plan for the site has been submitted with the application. Due to the small-scale
scope of this development, minimal landscaping is required. Staff does not have concerns with
this as there is ample vegetative buffer along the south property line screening the proposed use
to the properties to the south.
Storm Water Management
A storm water management plan has not been submitted. Plans will be required and reviewed
during the site plan review process.
RECOMMENDATION/CONDITIONS
Staff recommends approval of the proposed Conditional Use Permit for a freight terminal at 3010
Bradley Street with the following conditions:
1) Driveway entrance will be changed to a 40-foot/70-foot opening;
2) Photometric plan shall be revised to match the site/landscape plan.
The Plan Commission approved the conditional use permit as requested with conditions
noted. The following is the Plan Commission's discussion on this item.
Mr. Nau presented the item and reviewed the site and surrounding area as well as the land use
and zoning classifications in this area. He discussed the proposed use of the site, the hours of
operation and the potential future expansion possibilities. He reviewed the site plan and
discussed the setbacks, dolly pad, fencing, landscaping, and access to the site, parking, signage
and lighting. He noted that the access will need to be slightly expanded to meet code
requirements, that there was no designated employee parking as there will not be any employees
on site, and signage plans will need to meet code requirements when submitted. The lighting
plans need to be slightly revised and minimal landscaping is required. Storm water management
plans have not yet been submitted but will be reviewed and approved by the Department of
Public Works. He also reviewed the conditions recommended for this request.
Mr. Thoms questioned if the fencing around the site should be required to have screening and if
there should be a condition addressing storm water management.
Mr. Nau responded that this is an industrial use of a transit station within an industrially zoned
district and as it is not a storage use, screening is not required. He further stated that storm water
management plans will be reviewed during the site plan review process and the site will be
required to meet code requirements and therefore an additional condition addressing this is not
necessary.

Mr. Burich added that this request is a conditional use permit and we cannot use this process to
impose additional storm water management plans on the applicant other than what is required
by code standards.
Mr. Borsuk questioned what area of the site would be improved and whether it would be paved.
Mr. Nau displayed on the site plan the area to be paved with asphalt or concrete and the location
of the dolly pad.
Mr. Thorns continued discussion on storm water management requirements for the site.
Lucinda Porter, 81 Myrna Jane Drive, stated that she was on the cemetery board and that they
had concerns with the conditions of the existing road and the impact the additional truck traffic
would have on it. She also discussed her concerns with the increase in traffic on Waukau Avenue
due to this use.
Jeff Rustick, Schuler & Associates, petitioner for this request, stated that they were working with
the Department of Public Works on storm water management plans for the site and that an
impervious pavement design was being developed.
Mr. Borsuk questioned if the owner would have any issue with trucks only being allowed to be
parked on paved surface areas.
Mr. Rustick responded that this would not be an issue.
Mr. Borsuk requested to add a condition to the request to address that the trucks would only be
allowed on paved surfaces.
Motion by Borsuk to approve a conditional use permit for a freight terminal development at 3010
Bradley Street with the following conditions:
1) Driveway entrance will be changed to a 40 footOO foot opening;
2) Photometric plan shall be revised to match the site/landscape plan.
3) Truck operation only allowed on paved surfaces.

Mr. Kiefer inquired about the concerns regarding the traffic issues and the condition of the
roadway.
Mr. Burich responded that road reconstruction is under the direction of the Department of Public
Works and that they determine conditions and the schedule for when a road is to be
reconstructed.

Mr. Hinz commented that he thought the zoning ordinance has regulations that address that
vehicles could not be stored on unpaved surfaces so he did not feel the additional condition was
necessary.
Mr. Burich confirmed that this was correct.

CONDITIONAL USE NARRATIVE
FOR KARL'S TRANSPORT BRADLEY STREET FREIGHT TERMINAL
The proposed use of the currently vacant property is a freight terminal where semi
tractors and trailers will be parked and picked up for Karl's Transport. The paved yard
will be approximately 40,000 square feet and will be set back approximately 50 feet fiom
the Bradley Street right-of-way.
The facility would be accessed intermittently 24 hours per day with
approximately 100 trips to and from the yard per week. Noise levels will be under 50
decibels. The proposed use is compatible with the industrial zoning of the area and will
not hinder the use of any adjacent properties. A chain link fence is proposed on the west
yard along Bradley Street and on the north side of the site adjacent to the existing
businesses to provide security. It is proposed to use the existing dense cedar tree line
planted along the south property line as a visual screen from the cemetery property. On
the east, the existing vegetation at the railroad track provides screening from properties to
the east.
