Snell, Special Events Coordinator DATE: October 5, 2017 RE: Approve Charges for Extraordinary Services for Special Events for 2018 BACKGROUND On March 9, 2010, the Common Council adopted a Special Events, Marches, and Public Assemblies Ordinance which allows the City to recover certain costs related to extraordinary services provided to specific special events. The ordinance provided that the Common Council would establish a list of standard fees and charges by hourly rates or flat fees on an annual basis by Resolution. The ordinance also provided that the Council may specify certain tasks that may or may not be subject to extraordinary service charges. In January 2017, City staff proposed the Special Events Fee Schedule for 2018. Staff had identified the most common items and equipment used to support special events and found that some of the personnel and equipment had not been billed in past years. The proposed special events fee schedule reflect the City's actual personnel costs for 2017 and a 10% Administrative Overhead Charge. The Administrative Overhead Charge was recommended to recover a portion of the costs for the Administrative staff working in the capacity of planning, organizing, and coordinating special events. In addition, the proposal included the cost of personnel at regular time be charged back to the event; this was not the case for some departments in the past. In response to concerns related to the proposed changes, the Common Council requested additional review. City Staff then created a Special Events stakeholder working group, including representatives of events as well as citizens not currently working with events to provide a broader perspective on this issue. The group met biweekly from April through July. Many topics were discussed throughout the meetings, including the actual cost of special events to the City of Oshkosh and the effects on the City budget and personnel as well as how the City have determined staff costs, ways in which the city might recover the cost of Special Events and the value of special events to the City of Oshkosh and its citizens. Both Chief Smith and Chief Franz joined the group to discuss their concerns related to unreimbursed costs and staffing. The group came to focus on establishing a set of principles to guide the formulation of the schedule of costs. City Manager Mark Rohloff attended the last meeting with the group to hear the suggestions the group had reached consensus on. City staff reported to the Common Council during the Common Council Workshop on Tuesday, September 12, 2017. The Common Council directed staff to move forward with the following recommendations in a proposal of charges for Extraordinary Services for Special Events for 2018. These recommendations formed the basis for the specific costs included in the schedule. Calculation of Staff Hours Health Insurance will only be included in regular time calculations for staff costs. Overtime rates will not include health insurance costs. Staff Costs Bill all the costs for public safety employees providing services to a special event, whether those employees are on regular or overtime hours. Examples of personnel costs not previously billed include: Community Service Officers (CSO), Special Operations Sergeant, and Fire Command Staff (e.g. Battalion Chiefs) on regular time dedicated to specific events. Equipment Costs The City will now propose to recover the cost of equipment designated and used for special events using the current Federal Emergency Management Agency (FEMA) schedule of equipment rates. Staff's proposal is to recover the cost with an incremental approach to allow event organizers time to adequately budget for these increased costs. We will bill 100% of the rates provided, however, these charges will be offset with a 75% in-kind contribution by the city for the 1St year. This in-kind contribution will reduce to 50% in the second year, and 25% in the third year. The fourth year will recover 100% costs related to equipment. Utilities The City will charge back event organizers utility costs that meet the following conditions: large event, multi -day event, single day event with significant utility usage. Continue Practice of Waiving Extraordinary Services Fees for Block Parties & Parades The Council has previously waived all costs related to community -wide parades and residential neighborhood block parties. The Council recognizes that neighborhood block parties promote many of the values of community policing and encourage relationships which provide many other benefits to the City as a whole. In addition, traditional neighborhood block parties do not have a "sponsor" nor are they commercial in nature, so raising the funds for these types of events can be problematic for neighborhoods. Similarly, Council waived costs related to parades, recognizing the traditionally non-commercial nature of parades as well as their community -wide appeal. Staff is recommending that this practice be continued. Staff believes the value of continuing to promote these types of activities outweighs the costs which may fall upon the City as a whole from these events. FISCAL IMPACT The proposed resolution includes the charges for extraordinary services for special events that may be incurred by an event organizer. The Special Events fee schedule has been updated to reflect the City's anticipated personnel costs for 2018 and the 2017 FEMA schedule of equipment rates. Based on previous event logistics staff anticipates an estimated $384,150.81 in special event revenue for 2018, taking into consideration the stepped approach to equipment billing.
