PURPOSE: APPROVE SPECIFIC IMPLEMENTATION PLAN AMENDMENT
FOR PLACEMENT OF AN ELECTRIC VEHICLE CHARGING
STATION AT 2415 WESTOWNE AVE

WHEREAS, Council previously approved a Planned Development in 2000 for a
Festival Foods grocery store followed by a Planned Development Amendment in 2006 to
allow a store addition; and
WHEREAS, the applicant would like to install an electric vehicle charging station
along the periphery of the existing parking lot adjacent to North West Haven Drive
utilizing the established parking stalls; and
WHEREAS, the Plan Commission finds that this amendment to install an electric
vehicle charging station to the previously approved general and specific implementation
plan at 2415 Westowne Avenue, is consistent with the criteria established in Section 30-
387(6) of the Oshkosh Zoning Ordinance.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that the amendment request to install an electric vehicle charging station to the
previously approved general and specific implementation plan at 2415 Westowne
Avenue, per the attached, is hereby approved with the following conditions:
1) Base standard modification to allow the proposed 288 sp. Ft. EMC to exceed the
100 sq. feet maximum allowed.

BACKGROUND
The existing development located at the southeast corner of Westowne Avenue and N.
Westhaven Drive consists of one 7.875 acre parcel. The subject site is currently developed as a
Festival Foods grocery store that was approved as a Planned Development in 2000 (Resolution
00-262) followed by a Planned Development amendment in 2006 (Resolution 06-90) to allow a
store addition. The property has a SMU-PD Suburban Mixed Use District zoning designation
with a Planned Development Overlay. The development is bounded by medical facilities to
the south and west and commercial/retail uses to the north and east.
ANALYSIS
The applicant is proposing to install a Tesla supercharging station along the periphery of the
existing parking lot adjacent to N. Westhaven Drive utilizing established parking stalls. The
charging stations currently are only compatible with Tesla electric vehicles and will be
identified with signage and will be available 24 hours per day, seven days per week. The
stations do not emit any hazardous pollutants and produce minimal noise that will not
negatively impact the surrounding area. Six charging stations are initially proposed with two
additional stations potentially to be constructed if needed. The charging stations will be
located immediately behind the parking lot's curb with the related equipment to be located
within the green space in the setback area requiring a base standard modification. Three
existing trees will be removed which will be replaced elsewhere on the property with approval
by the Department of Community Development. The loss of the stalls should not have a
detrimental effect to the site as it currently has more parking stalls then required by code.
Signage is proposed in front of each charging stall designating its use which appears to meet
code requirements and will be verified during the site plan review process. Landscaping is

proposed to screen the equipment from the right-of-way in the form of arborvitae and shrubs
as a vegetative screening is more aesthetically pleasing than fencing. The applicant will be
required to seek verification from private utility providers to ensure that the root systems from
the plantings will not create issues with their underground facilities. The proposed
development will not have any impact on storm water management requirements or existing
access and circulation of the parking lot. The development introduces a new kind of
infrastructure to the community and will be compatible with adjacent uses.
FISCAL IMPACT
The installation of the charging stations to the site is more of an accessory use and will not
require or have any impact on city service provisions.
RECOMMENDATION
The Plan Commission recommended approval of the specific implementation plan
amendment with conditions at its October 3, 2017 meeting.

GENERAL INFORMATION

The applicant requests approval of a Specific Implementation Plan amendment to allow
placement of a Tesla supercharging station within the existing Festival Foods parking lot located
at 2415 Westowne Avenue.
Applicable Ordinance Provisions:
Planned Development standards are found in Section 30-387 of the Zoning Ordinance.
Property Location and Background Information:
The existing development located at the southeast corner of Westowne Avenue and N.
Westhaven Drive consists of one 7.875 acre parcel. The subject site is currently developed as a
Festival Foods grocery store, off-street parking/loading areas, dumpster enclosure and landscape
areas. The development was approved as a Planned Development in 2000 (Resolution 00-262)
followed by a Planned Development amendment in 2006 (Resolution 06-90) to allow a store
addition.
The property has a SMU-PD Suburban Mixed Use District zoning designation with a Planned
Development Overlay. The 10 and 20 year Comprehensive Land Use Plans recommend
commercial development for the subject site. The development is bounded by medical facilities to
the south and west and commercial/retail uses to the north and east.

ANALYSIS
Use
The applicant is not proposing any change of the principal use of the property, but requests
approval to install a Tesla supercharging station along the periphery of the existing parking lot
adjacent to N. Westhaven Drive. The applicant intends to provide six charging stations utilizing
existing parking stalls. The stalls will be identified with signage stating the stalls are reserved for
vehicle charging only.
At this time, the charging stations are only compatible- with Tesla electric vehicles. The vehicles
are able to inform the driver of charger locations and allow owners to plan trips accordingly. The
stations can provide a 50% charge in 20 minutes, 80% in 40 minutes and 100% in approximately
75 minutes. During that time, the applicant states the vehicle owners can visit walkable areas
while waiting for their car to charge. The stations are available for use 24 hours per day, seven
days per week.
Per the applicant's narrative, the charging stations do not emit any noise or hazardous pollutants.
The station's transformer does produce minimal noise but will not negatively impact the
surrounding area.
Site Design
The six charging stations are proposed to be installed near the northwest corner of the property,
utilizing six existing parking stalls beginning eight stalls south of the northwestern -most stall
along N. Westhaven Drive. The submitted site plan does show two additional charging stations
north of the planned six. Staff recommends approval of placement of a total of eight stations with
the, two additional stations to be constructed as needed.
Equipment to be installed includes three Tesla supercharger cabinets, six Tesla charging stations,
one switchgear assembly and one utility transformer. The equipment is shown to be placed
within green space between the public sidewalk and parking lot curbing. The parking lot is
located at the required 25 -foot setback meaning the equipment will be placed within the setback
area. The biggest encroachment into the setback is the utility transformer which is proposed to be
placed 12 feet from the right-of-way line, while the switchgear assembly and supercharger
cabinets provide a 13.16 foot setback. The charging stations are shown to be located immediately
behind the parking lot's curb.
The reduced setbacks require a base standard modification which staff is supportive of. The site
has taken full advantage of the buildable area for the off street parking area making conforming
placement of the equipment impractical. Also, the proposed equipment is not unlike equipment
placed by Wisconsin Public Service, AMT, or other service providers. Staff feels the
encroachment of the equipment can be visually softened via intensive landscaping.
Item — SMAmendment — 2415 Westowne Avenue — Tesla Charging Station
The submitted site plan indicates that three existing trees will be removed to accommodate the
proposed equipment. Staff understands the need for the removal, but recommends new trees of
the same species are placed elsewhere on the property per approval by the Department of
Community Development.
Access and Circulation
No changes to the existing access and circulation are being proposed.
Parkin
The site currently has 363 off-street parking stalls whereas 242 stalls are required by code. The
loss of the six stalls for Festival Food's general customers should not have a detrimental effect to
the site.
Signage and Lighting
The applicant's submittal includes a sign package including type of signage and signage
locations. Six 1 -foot by 1.5 -foot parking signs are proposed to be positioned in front of each
charging stall to identify that the parking space is reserved for Tesla vehicle charging. In
addition, the six charging posts will have an LED -illuminated sign displaying the Tesla name.
The signage appears to meet code requirements and will be verified during the site plan review
process.
Landscaping
A landscaping plan for the site has been submitted with the application. The main focus of the
landscaping is to screen the proposed charging station equipment from the public right-of-way.
The initial concept called for construction of a six-foot tall solid wood fence to serve as screening.
The applicant revised their plan and designed an all -season vegetative screen. This is
accomplished by placement of a row of 11 six-foot tall (when planted) American Arborvitae
flanked by 24 -inch shrubs on both ends. Staff is of the opinion that the vegetative screen is more
appropriate and aesthetically pleasing than the fence option.
During review, staff noticed the close proximity of the row of arborvitae to existing underground
private utilities. Research did not find any private utility easements located along N. Westhaven
Drive, and staff has concerns that the arborvitae's root system may interfere with the utilities as
they mature. Staff proposes as a condition that the applicant seek verification from the private
utility or utilities that the proposed placement of the arborvitae does not create a future nuisance
to their facilities.
Storm Water Management
The Department of Public Works reviewed the request and stated the proposed project will not
have any impact on the site's storm water management requirements.

RECOMMENDATION/CONDITIONS
Staff believes that the development meets the standards set forth in Section 30-387 of the Zoning
Ordinance and will have a positive impact on surrounding lands, introduces a new kind of
infrastructure to the community, and will not be detrimental to neighboring properties or the
community as a whole. Staff also feels that the proposal reflects the city's development and
planning policies, enhances the appearance of the area and is architecturally compatible with
nearby and adjacent structures lending a positive contribution to the physical appearance of land
uses and buildings in the community.
Staff recommends approval of the proposed Specific Implementation Plan amendment for the
proposed vehicle charging station and finds that the proposed amendment is consistent with
Section 30-387(C)(6)a-h with the following conditions:
1) Base standard modification to allow placement of utility equipment not less than 12 feet
from the right-of-way of N. Westhaven Drive whereas 25 feet is required;
2) The three trees identified to be removed shall be replaced with the same or similar species
on the site as approved by the Department of Community Development;
3) A total of eight charging stations may be constructed, six with the initial phase and two
additional stations as needed;
4) Verification that the location of the proposed vegetative screen will not interfere with
existing private underground utilities.
The Plan Commission approved of the Specific Implementation Plan amendment as requested
with conditions noted. The following is the Plan Commission's discussion on this item.
Mr. Nau presented the item and reviewed the site and surrounding area as well as the land use
and zoning classifications in this area. He discussed the previous planned development
approvals for the site and this amendment was consistent with the City's Comprehensive Plan.
He discussed the charging stations to be added in the existing parking lot and displayed on the
site plan the location of the parking stalls to be utilized for this purpose. He discussed the use of
the stations and how they would function and reviewed the site plan and the existing conditions
of the parking lot. The installation of these charging stations would result in the removal of three
existing trees which would be replaced in other areas on the site. He reviewed the layout of the
stalls and related equipment and discussed the base standard modification required for the
placement of the related equipment within the setback area. He also discussed the access,
circulation, and number of parking stalls on the site and indicated that this installation would not
have any negative impact on the site. He explained that there would be signage and lighting on
the parking stalls to identify the designated use and he reviewed the landscape plan for screening
purposes. He discussed that landscaping would be utilized in place of fencing for screening
purposes and reviewed photos of the charging stations and examples of their installation with the
landscape hedgerow for reference. He explained the concerns with the close proximity of the
landscaping to private underground utilities which is addressed in the conditions recommended
for this request. He stated that the installation of the stations would have no affect on storm
water management requirements and he reviewed the conditions recommended for this request.

Mr. Thorns questioned what the reason was for the 25 foot setback requirement for the placement
of the utility equipment such as a safety issue or if it had some other relevance.
Mr. Nau responded that the setbacks were in place for a combination of reasons such as
impervious surface, preservation of green space along the right-of-way, and stacking ability in
some cases depending on its location.
Mr. Thorns then questioned why we were willing to approve a reduced setback in this case and
not for other utility structure placements.
Mr. Burich discussed setbacks requirements in more detail and that it was more relevant to the
placement of building structures than for this type of use.
Mr. Thorns also questioned if the Fire Department had reviewed this request and had any
concerns regarding the placement of these utility cabinets that close to the right-of-way as it could
present a safety issue.
Mr. Burich responded that the Fire Department reviews all requests and did not express any
concerns regarding the placement of the utility equipment within the setback area.
Mr. Nau added that Wisconsin Public Service has transformers located on Westowne Avenue
within the right-of-way with no screening so this issue should not be a concern for this request.
Mr. Bowen discussed the requirement of landscape screening for the charging stations and the
relocation of trees to allow for the use and that license agreements may apply in this
circumstance. His concern was what would happen if the lease agreement is terminated for this
use and what would happen to the landscaping screening installed for a use that is no longer
present on the site.
Mr. Burich replied that a condition could be placed on the request to require that if the use is
terminated, that the landscaping would have to be restored to its previous condition.
Motion by Vajgrt to approve a specific implementation plan amendment for placement of an electric
vehicle charging station at 2415 Westowne Avenue with the following conditions:
1) Base standard modification to allow placement of utility equipment not less than 12 feet fi-om the
right-of-way of N. Westhaven Drive whereas 25 feet is required;
2) The three trees identified to be removed shall be replaced with the same or similar species on the site
as approved by the Department of Community Development;
3) A total of eight charging stations may be constructed, six with the initial phase and two additional
stations as needed;
4) Verification that the location of the proposed vegetative screen will not interfere with existing
private underground utilities.
Mr. Thoms felt that a condition could be added to the request to require the removal of the utility
box if the use is discontinued.

After further discussion, a condition was not added to address the removal of equipment or
restoration of landscaping if the use was terminated.
Seconded by Borsuk.
Mr. Borsuk felt that the use would be more beneficial if it utilized a universal plug in that would
be able to charge other vehicles other than Tesla automobiles.
Mr. Nau explained that it is not an issue that can be addressed by Tesla as other vehicles could
use these charging stations if automobile manufacturers would be willing to change to universal
charging systems that would be applicable to any electric vehicle.

Our office represents Tesla and this letter is to inform you of Tesla's proposal to install a supercharging
station in an existing parking lot at the site location listed above. The supercharging station includes the
following equipment items: (3) Tesla Supercharger Cabinets, (&) Tesla Charging Stations; (1) Switchgear
Assembly and (1) Utility Transformer.
Tesla's proposal does not add or remove any parking spaces from the existing parking lot, only
designating/enables current parking spaces for electric vehicles, This project requires no change to the
current vehicular or pedestrian traffic pattern, therefore there will be no impact to pedestrian or vehicular
safety. There will be no demand for public services or facilities for this project at this location.
The electric charging stations do not emit any noise or hazardous environmental pollutants. The transformer
does create minimal noise however the noise is not of hazardous levels and does not cause any annoyances
to the surroundings.
The addition of the Tesia equipment would bring Tesla owners into the area. While the vehicles are charging,
the owners could visit the general area which would bring in revenue for the surroutiding commercial
properties.
