HomeMy WebLinkAbout22. 17-484 SEPTEMBER 12, 2017 SEPTEMBER 26, 2017 17-460 17-484 ORDINANCE FIRST READING SECOND READING (CARRIED 6-1 LOST LAID OVER WITHDRAWN ) PURPOSE: AMEND SECTION 16-49(E) PERTAINING TO RESIDENTIAL RENTAL INSPECTIONS TO PERMIT DELINQUENT FEES TO BE PLACED UPON PROPERTY TAX BILLS AS SPECIAL CHARGES INITIATED BY: DEPARTMENT OF COMMUNITY DEVELOPMENT A GENERAL ORDINANCE OF THE CITY OF OSHKOSH AMENDING SECTION 16- 49(E) OF THE OSHKOSH MUNICIPAL CODE PERTAINING TO RESIDENTIAL RENTAL INSPECTION FEES TO PERMIT DELINQUENT FEES TO BE PLACED UPON PROPERTY TAX BILLS AS SPECIAL CHARGES The Common Council of the City of Oshkosh do ordain as follows: SECTION 1. That Section 16-49(E) of the Oshkosh Municipal Code pertaining to residential rental inspection fees is hereby amended as follows: (E) The Department shall charge a fee for the residential rental unit inspection as approved within the fee schedule adopted by the Common Council. Inspection Fees shall be collected as a special charge as provided in §66.0627 of the Wisconsin Statutes and entered on the tax roll if unpaid, or may be collected in any other manner allowed by law. The enactment of this ordinance shall constitute notice to property owners of such charge. SECTION 2. This ordinance shall be in full force and effect from and after its passage, publication and placement of the appropriate signage. SECTION 3. The ordinance amends the residential rental inspections ordinance to specifically permit delinquent fees to be placed upon the tax roll and collected as a special charge. TO: Honorable Mayor and Members of the Common Council FROM: Allen Davis, Community Development Director DATE: September 7, 2017 RE: AMEND SECTION 16-49(E) PERTAINING TO RESIDENTIAL RENTAL INSPECTIONS TO PERMIT DELINQUENT FEES TO BE PLACED UPON PROPERTY TAX BILLS AS SPECIAL CHARGES BACKGROUND The City of Oshkosh enacted a Residential Rental Inspection Ordinance and Rental Inspection program in the past year. One element of the Ordinance is the cost recovery of City staff time for this activity which required a Rental Inspection Fee charged for all rental inspections. Up to this point, the bills to the landlords for the inspections require payment in 30 days. This Ordinance Amendment would allow the City to place any unpaid rental inspection fees as a special charge and placed on the property tax bill. ANALYSIS State Statutes permit municipalities to collect charges for current services provided to individual properties through a special charge which may be included on the tax roll for payment if delinquent at the time tax bills are prepared and sent to property owners. Municipal Code specifically allows other delinquent fees to be placed on the property tax roll as a special charge. Examples of these fees are long grass and weeds, junked vehicles, other junk and debris, and other code related inspections. This code amendment would bring the rental inspection fee into conformance with the other City Codes by applying this method of fee collection. FISCAL IMPACT The rental inspection services are based on the recovery of City costs for the inspections and administration of the rental inspection program. Currently, the City invoices the landlords for the inspections after the inspections are completed. If a landlord would not pay the inspection fee, the City would attempt to collect the fees, and could eventually turn over the uncollected bills to a collection agency which would incur reduction in the revenue earned. It also ensures that the revenue is received and compensated to the City when the service is performed. RECOMMENDATION The Common Council adopt the ordinance change as proposed to allow delinquent inspection fees to be collected as a special charge.
