AMENDMENT NO. 1
The CITY OF OSHKOSH, hereinafter referred to as CITY, and BOARD OF REGENTS OF THE UNIVERSITY
OF WISCONSIN ON BEHALF OF THE UNIVERSITY OF WISCONSIN -MILWAUKEE ("University"), Department of
Anthropology -Sabin 290, PO Box 413, Milwaukee, WI 53201, hereinafter referred to as the CONSULTANT, entered into
an agreement for ARCHAEOLOGICAL INVESTIGATIONS FOR CALENDAR YEAR 2017 CAPITAL IMPROVEMENT
PROJECTS on December 29, 2016.
Paragraph C in ARTICLE VIII. PAYMENT included the provision that costs for additional services shall be
negotiated and set forth in a written amendment to this AGREEMENT executed by both parties prior to proceeding
with the work covered under the subject amendment.
THEREFORE, the CITY and the CONSULTANT agree to insert the following paragraph after the third
paragraph in ARTICLE III. SCOPE OF WORK:
The CONSULTANT shall provide the services described in the CONSULTANT's letter dated June 29, 2017.
The CITY and the CONSULTANT further agree to insert the following bullet point after the first bullet point in
Paragraph A of ARTICLE VIII. PAYMENT:
Payment for Amendment No. 1 shall be a Time and Materials Sum not to exceed $40,000 (Forty
Thousand Dollars).
All other terms contained within the December 29, 2016 agreement remain unchanged and in effect.

Contract 17-04 Bay Shore Drive
Dear Mr. Ferris,
The follow scope of work, incorporated under Task Order 5, details the additional archaeological
investigations for Contract 17-04 owing to the inadvertent discoveries during archaeological monitoring.
Authority 6- Guidelines
Both WisStat 44.40 (WisDNR permit) and WisStat 157.70 are applicable to the project.
All archaeological investigations conform to the standards and procedures documented in the Guide for Public
Archeology in Wisconsin, the statewide professional standards accepted and endorsed by the Wisconsin
Historical Society and the Wisconsin Archeological Survey.
Scope of Work
Item 1: Archaeological Monitoring
Task Order 3 covered up to five days on on site monitoring as required by the WHS. Monitoring was
initiated on May 15, 2017, has continued (although somewhat discontinuous) through June 30, 2017 and is
expected to conclude the week of July 3, 2017.
Item 2: InadvertentArchaeological Discoveries
Archaeological materials were encountered at two locations: 1) Eveline Street and Bayshore Drive intersection;
2) south side of Bay Shore Drive at Canniff Court. Archaeological materials were documented and recovered.
The archaeological materials will be subjected to laboratory analysis. The results of the field and laboratory
investigations will be detailed in a formal report of investigations for submittal to the Wisconsin Historical
Society.
Item 3: Human Burial Discoveries
Human remains were encountered at two locations within the project: 1) Eveline Street and Bay Shore Drive
intersection (isolated fragment); and 2) south Bay Shore Drive ROW at 1253 Bay Shore Drive (two partially
in situ features/burial pits). The recovery of human remains necessitates execution of a Burial Contract with

the Wisconsin Historical Society, the appropriate field recovery/excavation of human remains that cannot be
appropriately preserved in place, skeletal analysis of the human remains, and documentation of the
investigations and findings in a formal report of investigations.
