PLAN COMMISSION RECOMMENDATION: Approved with condition BE IT RESOLVED that the extraterritorial preliminary plat known as Sandhill Farms in the Town of Omro, is hereby approved with the following condition: 1. Approval of the plat be subject to approval of a sanitary sewer system to serve the site. TO: Honorable Mayor and Members of the Common Council FROM: Darryn Burich Director of Planning Services DATE: August 17, 2017 RE: Approve Extraterritorial Preliminary Plat / Sandhill Farms; Town of Omro (Plan Commission recommends approval) BACKGROUND The petitioner is requesting approval of an extraterritorial preliminary plat within the City's 3 - mile jurisdiction area including 82 lots and 3 outlots. The property is located in a developing residential area in the Town of Omro approximately three miles west of the Oshkosh City limits. The residential lots in this area are served by the Algoma Sanitary District #1 for water and sanitary sewer services. ANALYSIS The plat is located in an area that is identified as appropriate for residential use within a developing area of the Town of Omro that the City will not likely expand into based on existing boundary agreements and development patterns. The Department of Public Works has reviewed the proposed plat and did not have concerns other than that outlot 3 appears to be within the proposed road right-of-way. The Plan Commission recommended that a condition be added that the request was subject to approval of a sanitary sewer system and staff has confirmed that the development will be served by Omro sanitary service. Applicable Ordinance Provisions: Requirements governing platting are located within Section 30-441 of the City of Oshkosh Subdivision Regulations. Property Location and Type: The property is located in a developing residential area in the Town of Omro approximately three miles west of the Oshkosh City limits. The residential lots in this area are served by the Algoma Sanitary District #1 and private wells. The plat includes 82 lots and 3 out lots. Because the plat is extraterritorial, the City's Subdivision Regulations pertaining to physical design requirements do not apply and the plat needs to be reviewed on the basis of being consistent with the City's Comprehensive Plan. In this case, the plat is located in an area that the City's land use plan identifies as appropriate for residential use. The plat is located in a developing residential area of the Town of Omro that based on existing development patterns and boundary agreements; the City will likely not expand into this area. The Department of Public Works reviewed the proposal and did not have concerns other than that out lot 3 appears to be within the proposed road right-of-way. RECOMMENDATION/CONDITIONS Staff recommends a finding that the proposed extraterritorial preliminary plat is consistent with the City's Comprehensive Plan and be approved. The Plan Commission approved of the extraterritorial preliminary plat as requested. The following is the Plan Commission's discussion on this item. Mr. Slusarek presented the item and reviewed the site and surrounding area as well as the plat map depicting the layout and the City's Comprehensive Plan Land Use map. The plat is extraterritorial therefore it needs to be reviewed on the basis of being consistent with the City's Comprehensive Plan which shows residential use for this area. Mr. Thorns questioned if staff anticipates any impact from storm water runoff toward the lake that would negatively impact the city resulting from the development of this area. Mr. Burich responded that the development would have to meet storm water management requirements for the Town or Winnebago County as it was not within city limits. Mr. Thorns then questioned since the city provides ambulance services to this area, if the additional services necessary would be an issue. Mr. Burich replied that all items that come forward for approval are reviewed by a staff team comprised of various city departments that include the Police and Fire Departments. Issues such as this are addressed during discussions and there was no indication that providing services to this area would be an issue. Steve Gohde, Assistant Director of Public Works, stated that he questioned that the area was served by the Algoma Sanitary District as he did not feel this was correct. Mr. Thorns suggested that a condition be added to this request regarding the approval of the sanitary sewer system that would serve the area. This would allow the item to proceed to the Common Council without being delayed to further investigate the issue.
