HomeMy WebLinkAboutAECOM Proposal No. 604363 AECOM AECOM 558 North Main Street Oshkosh,W1 54901 aecom.com Date April 25, 2017 AECOM Proposal No. OPP-604363 Mr.Allen Davis Director of Community Development City of Oshkosh 215 Church Avenue Ohskosh,Wisconsin 54903-1130 Proposal for Environmental Consulting Services Related to the Proposed Site Development of the city of Oshkosh Parking Lot Located at 0 State Street,Oshkosh,Wisconsin Dear Mr.Davis: AECOM Technical Services, Inc.(AECOM)appreciates the opportunity to submit this proposal to the City of Oshkosh(City)for professional environmental engineering services related to pursuing a Voluntary Party Liability Exemption(VPLE)for the City Parking Lot located at 0 State Street,Oshkosh,Wisconsin(Subject Property). We understand that the City is considering a property transaction associated with parking lot and obtaining a VPLE prior to the property transaction that will benefit the planned redevelopment and assist with the property transfer. AECOM was previously retained to complete a Phase I Due Diligence Environmental Site Assessment(ESA)and Phase II ESA at this site. The Phase I ESA report identified the Subject Property as an irregular-shaped property utilized as an asphalt- paved city parking lot. Historical research performed as part of the Phase I ESA indicated the site and surrounding properties were incorporated into the City of Oshkosh since at least 1890 and owned by the City since around 1969. Sanborn Fire Insurance Maps(Sanborn)used in the Phase I ESA indicated that the Subject Property was formerly occupied by a paint shop,bicycle shop,an auto repair shop and residences. The Phase I ESA identified the following RECs: • A 1949 Sanborn map indicated a 120-gallon gasoline UST was located under the sidewalk adjacent to State Street and Lot 3.The lack of information pertaining to the UST's status and/or potential adverse impacts to the Subject Property is considered a REC. • A 1949 Sanborn map indicated a 150-gallon gasoline UST was located under the Subject Property.The lack of information pertaining to the UST's status and/or potential adverse impacts to the Subject Property is considered a REC. • Historical land use as an auto repair shop prior to the transfer of the property to the City of Oshkosh in 1968 is consider a REC due to lack of information pertaining to the historic use as a auto repair shop. The Phase II ESA indicated that there are Polynuclear Aromatic Hydrocarbons(PAH)and Volatile Organic Compounds(VOC)impacts in the soil and groundwater, particularly in the central area of the parking lot located in the former auto repair facility. These laboratory testing results indicate a release to the subsurface environment has occurred. Some of the detected PAHs and VOCs are above State of Wisconsin soil and groundwater standards. In accordance with State of Wisconsin hazardous substances spill law,and with permission from the City,the results of the investigation were forwarded to the Wisconsin Department of Natural Resources(WDNR), On October 5, 2016 the State of Wisconsin sent a letter outlining the City's responsibilities for addressing the contamination. The following actions are required by the WDNR to be performed by the City unless an exception is granted by the WDNR. K:\Proposal\City Of Oshkosh\Opp-640363_State Street Vple\Opp-640363_State Street Vple Proposal.Docx 1/8 AECOM * Hire an environmental consultant within 30 days of receipt of the responsibility letter. ^ Submit a work plan for completing the site investigation within 60 day of the responsibility letter. ° Initiate the site investigation within 90 days of submitting the site investigation work plan. * Submit a Site Investigation Report to the WDNR 60 days after receipt of the laboratory data. * Submit a Remedial Actions Option report 60 days after submitting the Site Investigation Report. On November 3, 2016,The City emailed Kevin Mc Night of the WDNR informing him that AECOM was in the process of being retained to address the issue and requested a 90 day extension on submittal of the Work Plan. On November 9, 2015 at 8:55 AM,the City received an email approval response from Kevin Mc Night, VVUNR. A subsequent meeting with City Staff and the Developer indicated that a VPLE will be pursued and if granted would promote site redevelopment and initiate a property transfer. This proposal presents our understanding of this project,site knowledge,current and previous VPLE experience onseveral City ofOshkosh sites, This proposal outlines our recommended scope ofwork and estimated fee for submitting a request for a VPLE for the site development and full filling the WDNR requirements related tothe subsurface release requirements. Project t Inderstanding The City of Oshkosh is considering promoting site redevelopment by applying for a site VPLE. The VPLEis avital part ofBrownfield Redevelopment, AEC0K4has successfully assisted the City inobtaining several VPLEsinthe Marion/Pearl Redevelopment area, AECOMiscurrently working with the City inpursuing e VPLEotthe Former Buck Staff Property. Based oncurrent and previous VPLEexperience,vvepropose the following scope ofwork tasks: Task A: Preparing aVPLEApplication and Lease Liability Clarification Request Task Complete Additional Subsurface Investigation(if requinad). Task C: Prepare aWork Plan and Soil and Groundwater Management Plan Task D: Interface with Regulatory Agencies Task E: Provide On-Site Construction Documentation Task F: Prepare aReport for Certification nfCompletion(CO()ofVPLE. This proposal assumes that the City will pay all WDNR fees associated with obtaining the VPLE. We anticipate a$250 application fee,$700 Liability Clarification fee,$2,000 deposit for WDNR review fees and approximately$1O.000for VPLEInsurance fee. The City will provide the$250 plus$2,000 for technical oversite and$700 checks for the WDNR review fees and submit the applications. The anticipated scope of work will include up to eight(8)hydraulic probes,collection of one to two soil samples for VOCs and PAHs, installation of three(3)groundwater monitoring wells,four(4)quarters of groundwater monitoring and groundwater laboratory analysis for VOCs and H4Hs. Asoil sample for DRO, PV{lCplus naphthalene,and lead for landfill waste acceptance profile. AEC()K4will provide esummary report ofthe subsurface investigation for submittal to the WDNR and incorporation into the Soil and Groundwater Management Plan. This information will be submitted to the WDNR and incorporated into the Soil and Groundwater Management Plan. Task C: FnB�:)a[e@Work Plan and Soil and Groundwater Management Plan AECOM will prepare a Work Plan and Soil and Groundwater Management plan that take into consideration the proposed site development,results ofthe subsurface investigation and likely VVDNRrequirements for the VPLE, The plan will also include a Sanitary Discharge Permit Application for disposal of the impacted groundwater generated during construction, The plan will be submitted to the WDNR for review and approval and incorporated into the contractor construction documents. 0eHverab|ea AECOM will prepare one draft copy of the Soil and Groundwater Management Plan and Sanitary Discharge Permit Application for review and comment. All comments and recommendations will be based on prior experience and communication of requirements from the WDNR. We anticipate the Developer will provide the plans in AutoCAD or PDF format. Please note,based on recent VPLE documentation experience,we anticipate significant project management time will bgrequired torequest various approvals. Soi| Menagement We propose to have an AECOM representative on site to observe and identify the excavation of areas containing impacted soil requiring disposal. This will beaccomplished through visual and olfactory observations (sheen,petroleum product,stained soils and petroleum odors)and field screening of the soils excavated for obvious signs nfcontamination, The AECOMfield staff will use uphoto ionization detector (PID)to field screen the excavated soils. PID field screening readings of 15 instrument units(equivalent to ppm)or higher will be considered contaminated and hauled to Waste Management's Valley Trail Facility, Nonpetroleurn impacted fill soils/solid waste that can be reused for site fill will be segregated and reused. Nonpetroleum/solvent impacted fill soils/solid waste deemed not usable as backfill material will be hauled tnthe Valley Trail Facility for disposal. The contaminated soil disposed of in a landfill requires manifesting,which needs a signature by an authorized representative of the City. To expedite the processing of the landfill profile acceptance applications and soil removal activities for this project,the City will delegate authority to AECOM to sign the waste profile application and transportation manifests on behalf of(acting as an agent for)the City. It is understood that the City will remain the responsible party for all final decisions regarding management and disposal of contaminated materials encountered during this project. By authorizing this proposal,the City will also be authorizing Paul F.Timm and his designees of AECOM to act as the authorized agent for the City for completing the waste profile and transportation manifests,as needed,to dispose the contaminated soil under this contract. CnntaminetE�,d GroundvvatorManegenoent We anticipate that the impacted groundwater removed from the project excavations will be collected and pumped into the Oshkosh sanitary sewer system under the conditions that will be provided in the temporary discharge permit obtained by AECOM. AECOM proposes to be on site periodically to make sure the contractor is discharging groundwater in accordance with the anticipated temporary discharge permit. UndergroundUd|ities We anticipate utilities running through the solid waste fill and petroleum impacted areas could create routes of less resistance for gases and liquids to migrate into and from the site. In compliance with anticipated permit requirements, utilities entering and leaving the project area limits will have a trench plug. Trench plugs will be placed where the utility line enters a structure. AECOM proposes to document the location,construction and size ofeach trench plug, Vapor Mitigation(C)ptiona|) A vapor barrier comprised of an impermeable liner and passive venting system will likely not be required below structure slabs and foundations to prevent the migration of moisture and vapors produced by the solid waste fill and/or petroleum impacts left in place. If required,this vapor barrier will likely consist of a polyethylene(PE)geomembrane sealed at the seams,providing a continuous barrier between the subsoil and floor slab. The passive venting system could be comprised of perforated piping between the building foundations,floor slab,and subsoil. AECOM Please note this requirement maybe not be necessary in vehicle storage areas that are design for non- permeant residence. AECUMproposes tosubmit this approach for VVDNRapproval. These components include the paved parking lot, lined storm water bio filters/pave drain, 16 Inches of soil covering fabric warning barrier under landscape areas and building base slab. Please note based on recent VPLE documentation experience,we anticipate additional field and project management time will berequired todocument construction activities. Deliverables: AECOM field notes will be summarized in the VPLE Certificate of Completion(COC)Application Report. Task F� Prepare Report of Certificate QfCorRpLGbon (COC) 0ƒVPLE!: AECOMwill prepare one draft COC request for review. The report will include all pertinent field, laboratory, VVDNRcorrespondence information and arequest for COC. Final review comments will boincorporated for submission toVVDNR. Please note based on recent VPLE,COC review comments,and additional information requests from the WDNR we anticipate additional significant time and effort will be needed to complete this task. This work will likely require 3 weeks to complete once initiated. Groundwater Monitoring will continue for 1year. Task C� Prepare aWork Plan and Soil and Groundwater Management Plan, AECDk4estimates this will take 1week toprepare and 1week for VVDNRreview and approval. Task E�Site Construction and Documentation for VPLE. AECOMestimates this tobe approximately 1Oto 11 weeks after AECOM is retained. AECOM also anticipates field work will be approximately 4 weeks. Task F': Complete Site Documentation and submit the VPLELoVVDNRfor review. This will happen after construction is completed (anticipated for late 2017)and after the 1 year of groundwater monitoring is completed. Final approval from WDNR will likely take several months,and is anticipated for late 2018 or early 2019.
