HomeMy WebLinkAbout19. 17-404 AUGUST 8, 2017 17-404 ORDINANCE FIRST READING (CARRIED 6-0 LOST LAID OVER WITHDRAWN ) PURPOSE: APPROVE CLOSURE OF EAST MURDOCK AVENUE FROM HARRISON STREET TO BOWEN STREET AND THE EAST MURDOCK AVENUE /BOWEN STREET INTERSECTION INITIATED BY: DEPARTMENT OF PUBLIC WORKS A GENERAL ORDINANCE OF THE CITY OF OSHKOSH AUTHORIZING A VARIANCE TO SECTION 25-23 OF THE OSHKOSH MUNICIPAL CODE PERTAINING TO STREETS TO REMAIN OPEN TO TRAFFIC DURING THE COURSE OF EXCAVATION WORK. WHEREAS,the City of Oshkosh Municipal Code Section 25-23 requires a passageway of not less than ten(10)feet in the travelled portion of the street to remain open on various streets within the City of Oshkosh, including East Murdock Avenue from Harrison Street to Bowen Street and the East Murdock Avenue/Bowen Street Intersection; and WHEREAS,Domer,Inc.has requested a variance from the terms of section 25-23 for the purposes of providing a safe work area and reducing congestion during construction for up to a one (1) week period during the summer 2017 construction season; and WHEREAS,the timing of the closure is dependent upon progress of the work,weather and other factors, making determination of the specific dates for closure difficult. NOW,THEREFORE the Common Council of the City of Oshkosh do ordain as follows: SECTION 1. that Dorner, Inc. is hereby granted a variance from the provisions of Section 25-23 of the City of Oshkosh Municipal Code to close East Murdock Avenue from Harrison Street to Bowen Street and the East Murdock Avenue/Bowen Street Intersection for purposes of providing a safe work area and reducing congestion during construction for full reconstruction for up to a one (1) week period during the summer 2017 construction season subject to the following conditions: AUGUST 8, 2017 17-404 ORDINANCE FIRST READING CONTD A. Dorner, Inc. shall provide at least seven (7) day notice to the Department of Public Works prior to the anticipated closure of East Murdock Avenue from Harrison Street to Bowen Street and the East Murdock Avenue/Bowen Street Intersection. B. Dorner, Inc. shall provide all necessary and required signage for the closure of the street and detour of traffic. C. Dorner, Inc. shall work with the Department of Public Works to minimize the effects of the street closure upon emergency services and the public. D. The Director of Public Works is hereby authorized to approve such closure, approve such closure with conditions or take such other action as may be necessary and appropriate in consultation with the Police and Fire Chiefs of the City of Oshkosh to protect the health, safety and welfare of the citizens. SECTION 2. This ordinance shall be in full force and effect from and after its passage, publication and placement of the appropriate temporary signage indicating the closure. SECTION 3. Publication Notice. Please take notice that the City of Oshkosh enacted ordinance #17-404 (A GENERAL ORDINANCE OF THE CITY OF OSHKOSH TO APPROVE CLOSURE OF EAST MURDOCK AVENUE FROM HARRISON STREET TO BOWEN STREET AND THE EAST MURDOCK AVENUE / BOWEN STREET INTERSECTION on August 8, 2017. The ordinance allows the temporary closure of East Murdock Avenue from Harrison Street to Bowen Street and the East Murdock Avenue/Bowen Street Intersection,for purposes of providing a safe work area and reducing congestion during construction for full reconstruction for up to a one (1) week period during the summer 2017 construction season. Gohde, Assistant Director of Public Works DATE: August 3, 2017 RE: Approve Closure of East Murdock Avenue from Harrison Street to Bowen Street and the East Murdock Avenue/Bowen Street Intersection BACKGROUND The Common Council awarded Contract 17-05 to Dorner, Inc. of Luxemburg, Wisconsin at their March 28, 2017 meeting. In addition to other streets, this project includes the full reconstruction of East Murdock Avenue, from Bowen Street to Harrison Street. The Contract documents require construction work on East Murdock Avenue, from Harrison Street to Bowen Street, to be completed within eighteen (18) weeks. The Contract documents further allow a closure of the East Murdock Avenue/Bowen Street intersection for up to one (1) week. The Contract documents require that this intersection be open to traffic on temporary pavement for the Race the Lake Bicycle Race (August 13, 2017). A detour route will be posted for the duration of construction on East Murdock Avenue, using Harrison Street and East Nevada Avenue. The intersection closure is anticipated in to begin in early September and last one (1) week. Access to all business will be maintained for the duration of the project. Advanced warning signs will be placed seven (7) days prior to the closure to warn drivers. ANALYSIS Based on the excavation limits needed for utility construction, staff determined the intersection would need to be closed to traffic. The time frame was limited to one (1) week to minimize the impact to the traveling public. Additionally, worker safety and driver safety will be compromised during the construction work if done under traffic. FISCAL IMPACT The closure was included in the Contract documents, so there is no fiscal impact to this ordinance. RECOMMENDATIONS I recommend approval of the closure of East Murdock Avenue, from Harrison Street to Bowen Street, for eighteen (18) weeks and closure of the East Murdock Avenue/Bowen Street intersection, for a period not to exceed one (1) week.
