HomeMy WebLinkAbout18. 17-403 AUGUST 8, 2017 17-403 ORDINANCE FIRST READING (CARRIED 6-0 LOST LAID OVER WITHDRAWN ) PURPOSE: APPROVE CLOSURE OF WEST MURDOCK AVENUE FROM ALGOMA BOULEVARD TO VINLAND STREET INITIATED BY: DEPARTMENT OF PUBLIC WORKS A GENERAL ORDINANCE OF THE CITY OF OSHKOSH AUTHORIZING A VARIANCE TO SECTION 25-23 OF THE OSHKOSH MUNICIPAL CODE PERTAINING TO STREETS TO REMAIN OPEN TO TRAFFIC DURING THE COURSE OF EXCAVATION WORK. WHEREAS,the City of Oshkosh Municipal Code Section 25-23 requires a passageway of not less than ten(10)feet in the travelled portion of the street to remain open on various streets within the City of Oshkosh, including West Murdock Avenue from Algoma Boulevard to Vinland Street; and WHEREAS,Domer,Inc.has requested a variance from the terms of section 25-23 for the purposes of providing a safe work area and reducing congestion during construction for installation of a relay water main, water laterals, and various storm sewer and sanitary sewer spot repairs for up to a six(6) week period during the summer 2017 construction season; and WHEREAS,the timing of the closure is dependent upon progress of the work,weather and other factors, making determination of the specific dates for closure difficult. NOW,THEREFORE the Common Council of the City of Oshkosh do ordain as follows: SECTION 1. that Dorner, Inc. is hereby granted a variance from the provisions of Section 25-23 of the City of Oshkosh Municipal Code for purposes of providing a safe work area and reducing congestion during construction for installation of a relay water main,water laterals,and various storm sewer and sanitary sewer spot repairs for up to a six(6)week period during the summer 2017 construction season subject to the following conditions: AUGUST 8, 2017 17-403 ORDINANCE FIRST READING CONTD A. Dorner, Inc. shall provide at least seven (7) day notice to the Department of Public Works prior to the anticipated closure of West Murdock Avenue from Algoma Boulevard to Vinland Street. B. Dorner, Inc. shall provide all necessary and required signage for the closure of the street and detour of traffic. C. Dorner, Inc. shall work with the Department of Public Works to minimize the effects of the street closure upon emergency services and the public. D. The Director of Public Works is hereby authorized to approve such closure, approve such closure with conditions or take such other action as may be necessary and appropriate in consultation with the Police and Fire Chiefs of the City of Oshkosh to protect the health, safety and welfare of the citizens. SECTION 2. This ordinance shall be in full force and effect from and after its passage, publication and placement of the appropriate temporary signage indicating the closure. SECTION 3. Publication Notice. Please take notice that the City of Oshkosh enacted ordinance #17-403 (A GENERAL ORDINANCE OF THE CITY OF OSHKOSH TO APPROVE CLOSURE OF WEST MURDOCK AVENUE FROM ALGOMA BOULEVARD TO VINLAND STREET) on August 8,2017. The ordinance allows the temporary closure of West Murdock Avenue from Algoma Boulevard to Vinland Street,for purposes of providing a safe work area and reducing congestion during construction for installation of a relay water main,water laterals,and various storm sewer and sanitary sewer spot repairs for up to a six(6) week period during the summer 2017 construction season. Gohde, Assistant Director of Public Workss'"i DATE: August 3, 2017 RE: Approve Closure of West Murdock Avenue from Algoma Boulevard to Vinland Street BACKGROUND The City awarded Contract 17-12 to Dorner, Inc. (Domer). The project includes the installation of a relay water main, water laterals, and various storm sewer and sanitary sewer spot repairs. Dorner requested that City staff review an option to close West Murdock Avenue, from Algoma Boulevard to Vinland Street, to complete the work. The Contract provides that West Murdock Avenue remain open to traffic. Dorner determined that only one (1) traffic lane, with flaggers restricting traffic movements, can be maintained on West Murdock Avenue to ensure worker and driver safety during the water main work. Under the open to traffic conditions, the construction is anticipated to last six (6) weeks. Dorner has proposed to close West Murdock Avenue, from Algoma Boulevard to Vinland Street, for the six (6) week construction window to all vehicle traffic. Access to properties within the construction limits will be maintained except for short durations during pavement operations. A detour route will be posted using Algoma Boulevard, Walter Street, West Snell Road, Jackson Street, Irving Avenue, Wisconsin Street, Witzel Avenue, Sawyer Street, and Oshkosh Avenue. However, we recognize that local, non-commercial traffic will identify and use different routes around the construction area. The closure is anticipated to start in August. Advanced warning signs will be placed seven (7) days prior to the closure to warn drivers. The abutting property owners received letters on May 11, 2017 regarding Construction Access Agreements and a follow-up mailer for the properties that did not return their signed Construction Access Agreement on June 16, 2017. Domer also will be hand -delivering a construction notice to the abutting properties on Thursday, August 3rd and Friday, August 4, 2017. This notice included information about the request for closure of West Murdock Avenue. Please see the attached letter and detour map from Domer for additional information. ANALYSIS Based on the traffic volumes and close proximity of the excavation limits to traffic, there is a high likelihood of substantial traffic backups if only one (1) lane is available for traffic. Additionally, worker safety and driver safety will be compromised during the construction work if done under traffic. The proposed detour route uses roadways identified as truck routes. FISCAL IMPACT There are no changes to the Contract costs as a result of the closure. Domer Inc. & Vinton Construction Company, Inc. are concerned for the safety of their workers and safety of the public under the current requirement to keep a lane of traffic open in each direction. During the water main installation, there are numerous locations that Donner Inc. will need to install the new water main or water services under the existing 48" storm sewer which is on average 10' deep. To excavate under the storm sewer, we need to sit with the excavator on both sides of the storm sewer main to excavate under the storm sewer main in order to install of the water main. Each piece of water main is 20' long. At that length, it's going to be difficult to keep one lane of traffic open, let alone 2 lanes of traffic. Where we need to tie in the water mains at each intersection, we will need to keep the water main side of the storm sewer open, while installing the water main branch to make the tie in at each intersection. This will not allow traffic to flow. When we excavate, or pull the water services across Murdock Avenue, we will need to have the water main side of Murdock Avenue open, while our machines are excavating on the home side of Murdock Avenue to install the service. Vinton Construction Company, Inc. has concerns that while they are restoring the pavement, working with their long handle floats, a car could hit the handles and injure their workers. Vinton Construction Company, Inc. has 2 different methods of repair that must be done during the paving process. They will start with the panel repairs and then proceed with the full lane pavement. There are so many panel repairs to do, that the traffic pattern would look a lot like Road America in Elkhart Lake, than a continuous traffic pattern. Dorner Inc. would hire Storm Companies, Inc. to set up a detour from West Snell Road to Algoma Boulevard to Oshkosh Avenue to Sawyer Street to Wisconsin Avenue to Jackson Avenue, including arrows at the Murdock/Jackson and Murdock/Algoma intersections. "An Equal Opportunity Employer" There are only businesses at the end of the construction area Dorner Inc. would work from 7 am to 7 pm to perform out work in a shorter time frame to reduce inconvenience to these property owners. Dorner will maintain access to the homeowners' driveways. Dorner Inc. would like to start the project on Monday, August 14th.
