Dear Mr. Yoder:
This letter is to confirm the lease agreement for an estimated 75 acres (more or less) of two sections of
farm land in the City of Oshkosh's Southwest Industrial Park area within Parcel #'s 133451000 and
1334500000 at $162.50 per acre from the signing of this agreement to October 31, 2019. The lease
property shall solely be used for agricultural purposes. Lessee shall not allow recreation activities on
the leased property. Recreation activities includes, without limitation, hunting, snowmobiling,
motorcycling, or ATVs. Lessee has inspected properties and leases them as is. Lessee cannot sublease
or assign its interests in the leased property.
Payment for each year of farming must be sent by October 31 of 2017, 2018 and 2019, payable to the
City of Oshkosh, mailed to PO Box 1130, Oshkosh, WI 54903-1130. Payment amount each year will be
determined by farmed acreage as verified by United Co-op of Pickett and submitted with payment. As
agreed you will Iease the land for the term from the date this agreement is fully signed until October
31/ 2019.
Should the City of Oshkosh need to access any of the land on these parcels before October 31, 2019, the
lessee will be compensated for any crops that are planted on these parcels at a rate of $300 per acre.
The City of Oshkosh will not be held liable for any damage incurred to crops on these parcels that are
not removed from the leased property by October 31, 2019.
Lessee shall not alter the leased property and agrees to remove all personal property, fixtures, and/or
crops by the end of the lease. Lessee affirmatively agrees that any personal property, fixtures or crops
remaining on the leased property at the termination of the lease should be considered to have no
appreciable value.
As part of this lease agreement lessee will protect/hold harmless the City of Oshkosh against any
incidents, actions, claims or demands of any kind or character related to the leased property arising
during the term of the lease. Lessee further agrees to fully indemnify and refund to the City within 30

days of written demand all such sums the City may be obligated to pay on such actions, claims or
demands.
The dates identified in this agreement are firm and time is of the essence.

Dear Mr. Walter:

farm land in the City of Oshkosh's Northwest Industrial Park area within Parcel #'s 018005101,
018005301, 0180153 & 0180152 at $128.00 per acre from the signing of this agreement to October 31,
2019. The lease property shall solely be used for agricultural purposes. Lessee shall not allow

Have been paid in full, including interest. To clarify the preceding statement, please note the following:
1. The City received a check In the amount of$14,172.76,which comprises the remaining special
assessments due for streets, Including Interest through December 2016,and an estimated
amount for sidewalks because they will not be installed until approximately May 2017.
2. Due to the City's property tax procedures,$4,038,92 of the remaining amount due For street
special assessments will be placed on the property owner's 2016 tax bill. This amount is
Included In the payment received, and the City will therefore credit that amount to the property
owner's account, This amount Is itemized on the tax bill, and the property owner should make
this adjustment when paying property taxes,
3. The balance of the remaining amount due for street special assessments,$5,268.24, which
Includes interest'through December 2016,will be immediately credited to the property account.
4. The balance of the total amount received,$4,865.60,will be held by the City pending the
Installation of sidewalks in or around May 2016, After Installation has occurred,and actual
amounts have been calculated, then the City will refund an amount if the installation is lander-
; budget, or provide notification that amounts are due. The City may take any lawful action to
collect if the Installation Is over-budget and payment is not received. Pefunds will be directed to

the party submitting the estimated amounts.
i 5. There are no other pending special assessments for this property other than those Identified
above.
