PURPOSE:DECLARE AND APPROVE DISPOSITION OF SURPLUS PROPERTY
FOR FUTURE REDEVELOPMENT AUTHORITY ACQUISITIONS TO
HABITAT FOR HUMANITY OF OSHKOSH RESTORE
WHEREAS, Habitat for Humanity of Oshkosh ReStore has requested that its
volunteers be allowed to remove from the properties cabinets, windows, fixtures, and any
other salvageable goods for the sole purpose of reuse to be resold in their ReStore; and
WHEREAS, the cost to the RDA to advertise and solicit proposals for removal of the
property, or for the RDA to remove the property either through the use of city employees
or contractors, exceeds the value of the property to be removed, resulting in the property
having no or a negative value; and
WHEREAS, Section 12-17(A)of the City of Oshkosh Municipal Code provides that
where property has no apparent value, the RDA may dispose of such property by any
appropriate means.
NOW, THEREFORE, BE IT RESOLVED by the Redevelopment Authority of the City
of Oshkosh that pursuant to Section 12-17(A)of the City of Oshkosh Municipal Code that
cabinets, windows, fixtures, and any other salvageable goods and remaining personal
property located within the structures is hereby declared to be surplus property with no
apparent value and that the request to remove such property by Habitat for Humanity of
Oshkosh ReStore is hereby approved for calendar years 2017 through 2019,with the
following conditions:
1)That Habitat for Humanity of Oshkosh ReStore coordinate all activities to
remove salvageable items and secure the property, at Habitat for Humanity of
Oshkosh ReStore’s expense, with the Community Development Department.
2)That before entering the property, Habitat for Humanity of Oshkosh ReStore
and all volunteers and/or employees of Habitat for Humanity of Oshkosh
ReStore execute appropriate waivers of liability;
3)That Habitat for Humanity of Oshkosh ReStore file with the City Clerk a
Certificate of Insurance in the amount of $2,000,000.00 showing Redevelopment
Authority of the City of Oshkosh as an additional insured.

SUBJECT:17-15 Declare and Approve Disposition of Surplus Property to Habitat for
Humanity of Oshkosh Restore
BACKGROUND
Habitat for Humanity approached the RDA several years ago and inquired whether their
volunteers and staff could remove salvageable material from RDA structures about to be
demolished. The RDA approved their proposal, and this action would continue the
arrangement for another 5 years.
ANALYSIS
As part of the City’s blight elimination and redevelopment programs, the RDA acquires
and demolishes structures. The material is hauled to the landfill and the City pays the
tipping fees based on the weight of the load. Habitat has removed many items and
materials from structures for their use, which saves the RDA and City in landfill tipping
fees at, so their offer and work has saved the City money.
RECOMMENDATION
The RDA declares and approves the Disposition of Surplus Property to Habitat for
Humanity of Oshkosh Restore.
