Chairman Cummings called the meeting to order at 4:00 pm. Roll call was taken and a quorum
declared present.
The minutes of February 23, 2017 were approved as distributed (Belter/Stam).
Res.17-06 Grant Utility Easement to S&S Auto Body; 6th Avenue & Nebraska Street
Motion by Stam to move Res.17-06
Seconded by Hintz
Mr. Stam inquired if the lateral was rerouted and who paid for it.
Mr. Davis responded the lateral was rerouted and S&S Auto paid for it.
The item was called. Motion carried 4-0.
Res.17-07 Approve Land Disposition of Vacant Lot; Formerly 1909 Jefferson Street to
West 17th Street Properties LLC ($4,700)
Motion by Hintz to move Res.17-07
Seconded by Stam
Mr. Belter inquired what the potential uses were for the property.
Mr. Davis stated the short term use of the property is very limited and the bar adjacent to the
property would be the only potential user. In the long term, it could be combined with other
parcels for a larger redevelopment.

Executive Director’s Report
Mr. Davis provided an update on the former Buckstaff property and stated the contractor is
continuing with construction. The City’s cost for preparing the site for construction came in under
budget and has been a very successful project up to this point. It is on schedule to open this fall.
Mr. Belter inquired about the status of the site since it looks like the foundation has been done for
about one month.
Mr. Davis stated the contractors have been working on site preparations that have to do with
storm water.
Mr. Cummings stated there was some concern about the façade of the building and inquired if
changes were made to the original plans.
Mr. Davis stated we received a copy of the plans submitted to the State which included a new
façade. Plan Commission and Council will have to approve amendments to the façade and a sign
package at a future meeting.
Mr. Davis provided an update on 1017 Bowen Street and pictures were presented of the completed
project.
Ms. Brandt stated there have been several showings and plans to hold an open house in the month
of June.
Mr. Davis stated the DNR has reported they will be able to increase the grant award to almost
$800,000 so that more riverwalk will be able to be installed in 2017 west of Oregon Street towards
Boatworks. The next DNR grant for 2018 was submitted which could construct the riverwalk to
Boatworks depending upon bids.
Mr. Davis stated the approval of a TIF and planned development for the Granary will be decided
at the next Council meeting.
Mr. Davis stated Mr. Burns provided an update on the Miles Kimball building and windows will
be cut in beginning in June.

PURPOSE:APPROVE LEASE AGREEMENT WITH H&M COMMERCIAL
LLC; 43 EAST 7TH AVENUE
BE IT RESOLVED by the Redevelopment Authority of the City of Oshkosh that a
Lease Agreement with H&M Commercial LLC to lease the warehouse portion of the
property at 43 East 7th Avenue is hereby approved and the proper officials are hereby
authorized to execute a Lease Agreement with substantially the same terms as attached
hereto, and to carry out all actions necessary to implement the Redevelopment
Authority’s obligations to implement the terms and conditions of the Lease Agreement.

SUBJECT:17-08 Approve Lease Agreement with H&M Commercial, LLC; 43 E. 7th
Avenue
Background
The RDA entered into an agreement with CHAMCO to acquire 43 E. 7th Avenue by
August, 2017. The previous owner is also the current occupant/tenant. The tenant has
inquired if the RDA would consider extending the lease for their continued occupancy.
Analysis
The proposed lease would be for 2 years. The lease rate would be $5,000 per month with
the tenant responsible for all costs of the warehouse area. The RDA would be responsible
for the office space that the tenant does not want to use. The attached Lease Agreement
provides more specifics. The cost per square foot is on the low side of the market range,
but the tenant is also responsible for maintenance of the building and property, not the
RDA. The lease payments will help generate funding for the eventual demolition of the
building.
The RDA will acquire the property as part of the Southshore Redevelopment Plan and
will be combined with the block to the south. Since the agreement for the acquisition, the
RDA has also obtained the shop and bowling alley on the block. In addition, the Concept
Plan for the Sawdust District has been developed, and the block is designated as a major
redevelopment site. While redevelopment begins with the Arena to the south, the
building will be demolished for redevelopment. The proposed 2 year lease, with a 6
month early termination, would allow the RDA to demolish the site in concert with the
redevelopment of the block.
RECOMMENDATION
The RDA approves the proposed Lease Agreement with H&M Commercial, LLC; 43 E.
7th Avenue for $5,000 per month.
Lease Agreement
This LEASE AGREEMENT ("Lease") made and entered into this ____ day of
July, 2017 is by and between the Redevelopment Authority of the City of Oshkosh
(RDA), a separate body politic, ("Lessor"),with its principal offices located at 215
Church Avenue,PO Box 1130,Oshkosh, Wisconsin 54901 and H&M Commercial LLC,
(H&M)("Lessee"), a Wisconsin limited liability company, with its principal offices at N69
W25986 Brighton Drive, Sussex, Wisconsin 53089.
AGREEMENT
1.The RDA owns the real property at 43 East 7th Avenue, within the City of
Oshkosh, Winnebago County, Wisconsin.
2.H&M seeks to lease the 38,184 sq. ft. warehouse at 43 East 7th Avenue,
Oshkosh, Wisconsin ("Leased Property"). H&M will not lease the attached 1,335
sq. ft. office building. The RDA may separately lease the office building at its
discretion, with written notice to H&M.
3.This Lease shall commence July 27, 2017.The initial lease term shall be for two
(2) years.Either party may terminate the Lease upon a six (6) month written
notice to the other party.The lease may be extended monthly at the end of the
initial 2 year term.
4.During the term of this Lease, the RDA shall be allowed reasonable access to the
Leased Property for any purpose related to any municipal or police power
function, to meet its obligations under this Lease, or to function in its capacity as
the owner of the Leased Property. The RDA shall make all reasonable efforts to
not materially disrupt H&M's allowed use of the Leased Premises.
5.Lease Amount. The lease amount shall be FIVE THOUSAND DOLLARS AND
NO/100 ($5,000)per month due on the 10th of the month.Payment shall be
mailed to:

6.H&M has had sufficient access to the Leased Property and as a result is or
should reasonably be aware of all aspects related to its condition. The RDA
makes no express or implied promises or warranties related to the condition of
the Leased Property.
7.H&M shall be responsible for:
a.Payment of personal property taxes.
b.All utility payments (i.e. Wisconsin Public Service,City sewer, water,
storm water)
c.Grass cutting and snow removal
d.General building maintenance associated with operating that portion of
the building as a warehouse (ie roof repairs, water pipe leaks/repairs,
furnace, etc.)
e.Improvements necessary to the warehouse incidental to the warehouse
use.
8.H&M shall have all necessary insurance with sufficient limits which will cover its
employees, actions and property on the Leased Property. H&M shall hold the RDA
harmless from any accident or incident involving H&M, its employees or agents, or
any dispute with H&M or any 3rd party resulting from any action of H&M, its agents
or assigns,occurring during the term of this Lease.H&M shall provide a copy ofits liability insurance to the RDA, with the RDA listed as an additional insured on
the policy.
9.H&M shall not allow any encumbrance to be filed on or against the Leased
Property, including mortgages, easements, or similar restrictions unless
otherwise explicitly allowed in writing by the RDA.
10.RDA shall be responsible for costs associated with the unoccupied office space.

BACKGROUND
The vacant parcel on the southwest corner of Jackson and Marion is part of the Marion
Road Redevelopment Site. The RDA granted an option to Oshkosh Bier Brewing in 2016.
The option expires July 20, 2017. The applicant is requesting a 5 month extension on the
option.
ANALYSIS
Mr. Fulbright has been working on the proposed Brewery/tap house over the last year.
He has not submitted final plans for Plan Commission, City Council or RDA approval.
No other potential developers have approached staff on the prospect of developing the
parcel, or obtaining an option.
RECOMMENDATION
The RDA grants a 5-month extension to the option for Oshkosh Bier Brewing.

WHEREAS, the Redevelopment Authority and Oshkosh Common Councilpreviously approved a conditional use permit/planned development for an urban green
space at the corner of Central Street and West Parkway Avenue with one of the
conditions being the Redevelopment Authority approve the continued use of the
community garden on a yearly basis.
NOW, THEREFORE, BE IT RESOLVED by the Redevelopment Authority of theCity of Oshkosh that the Authority hereby approves continuing the urban green spaceat the corner of Central Street and West Parkway Avenue for the 2017 calendar year,with conditions as noted in the previous approval.

Avenue to David Kozlowski and Geraldine Kozlowski ($3,500)
BACKGROUND
The RDA acquired the property as a blighted, partially burned out structure, over a year
ago. The City has since removed the asbestos, demolished the structure and regraded
and seeded the site. The City continues to cut the grass and remove the snow. The City
has also been marketing the property over the last several months. A neighbor has
submitted an offer for the vacant lot.
ANALYSIS
Staff has received little interest in the corner lot parcel due to the proximity to the railroad
tracks and Broad/Waugoo intersection. The typical assessed value for the property
would be over $5,000.
The proposed buyers live in the house to the south on Broad Street. They plan to combine
the property with their exiting parcel.
RECOMMENDATION
The RDA approves the land disposition of vacant lot;formerly 503 Waugoo Avenue to
David Kozlowski and Geraldine Kozlowski for $3,500.

PURPOSE:DETERMINATION OF NECESSITY; ESTABLISH FAIR MARKET
VALUE; AUTHORIZE PURCHASE –645 JEFFERSON STREET
WHEREAS, the Redevelopment Authority previously approved the Near East
Neighborhood Redevelopment Area; and
WHEREAS, it is in the best interests of the citizens of the City of Oshkosh to
acquire property within the boundaries of said Redevelopment Area to assist in the
elimination and prevention of blighting influences and promote urban renewal; and
WHEREAS, the property and interest to be acquired includes land and buildings,
if any, exclusive of equipment and fixtures both movable and immovable, and is
described as:
645 Jefferson Street
East half of Lot 3 Block 72 of Leach’s Map, 4th Ward, City of Oshkosh, Winnebago
County, Wisconsin (tax #904-0225-0000)
NOW, THEREFORE, BE IT RESOLVED by the Redevelopment Authority of the
City of Oshkosh that the Authority certifies that in order for said purpose to be
accomplished, it is necessary for the property described above to be acquired. It is further
determined by the Authority that acquisition of said property is hereby determined
necessary pursuant to the provisions of Chapters 32 and 66 of the Wisconsin Statutes.
BE IT FURTHER RESOLVED that the value of the property to be acquired, as
described above, is hereby established at FORTY TWO THOUSAND FIVE HUNDRED
DOLLARS AND 00/100 ($42,500.00). Money for this purpose is appropriated from City
Community Development Block Grant funds.
BE IT FURTHER RESOLVED that the proper Redevelopment Authority officials
are authorized and directed to purchase said property and execute all documents
necessary to consummate this transaction.

Purchase –645 Jefferson Street $42,500
BACKGROUND
The RDA was approached by the property owner regarding their willingness to sell the
vacant building and lot to the City for future redevelopment. The parcel adjoins the
Jefferson Street redevelopment site that the RDA assembled over a number of years. The
Jefferson Street site is under option for another 15 months. This parcel could be added to
the Jefferson Street site in order to increase the likelihood of redevelopment.
ANALYSIS
The building is similar in style and condition to the other structures acquired and
demolished by the RDA over past number of years. The proposed purchase price would
be similar to the acquisition price of 50 cents on the dollar for the other parcels acquired.
The Jefferson Street site would benefit from additional space for the overall
redevelopment. The number of units could be increased and reduce the overall project
cost per unit. In addition, it is possible that the Main Street parcel to the west could be
combined with the Jefferson Street site and provide the prospect of access and mixed use
commercial and residential on the Main Street side of the site.
Asbestos removal and demolition would likely cost another $15,000 to $25,000. CDBG
funds are available and programmed for this type of blight removal/redevelopment
project.
RECOMMENDATION
The RDA makes a Determination Of Necessity; Establishes Fair Market Value;
Authorizes Purchase of 645 Jefferson Street for $42,500

PURPOSE:APPROVE LAND DISPOSITION OF A REMNANT SLIVER OF
LAND EAST OF DAWES STREET TO ANNEX 71, LLC
WHEREAS,based on how the Marion and Pearl Redevelopment Area was
redeveloped, a remnant sliver of land is owned by the Redevelopment Authority east of
Dawes Street; and
WHEREAS,the former Lamico property is being redeveloped and the developer
requested that the remnant sliver of land be combined with their parcel.
NOW,THEREFORE BE IT RESOLVED by the Redevelopment Authority of the
City of Oshkosh that the vacant remnant sliver of land East of Dawes Street is hereby
declared surplus and the proper officials are hereby authorized and directed to execute
any and all documents necessary to transfer said property to the developer of the former
Lamico property, Annex 71, LLC.

SUBJECT:17-14 Approve Land Disposition of A Remnant Sliver of Land East of
Dawes Street to Annex 71, LLC
BACKGROUND
The RDA owns a sliver of land east of Dawes Street in close proximity to the Lamico
buildings and the vacated railroad right of way. Annex 71 is a student housing
development firm that is proposing to construct a new student housing building on the
Lamico property.
ANALYSIS
The sliver of land is unbuildable on its own. Combined with the Lamico property, Annex
71 would use the land as part of the site. The land disposition would put the property on
the tax roll and provide the buyer with a slightly larger parcel. The property is being sold
“as is” so that there is no remaining RDA liability.
RECOMMENDATION
The RDA approves the Land Disposition of a remnant sliver of land east of Dawes
Street to Annex 71, LLC

PURPOSE:DECLARE AND APPROVE DISPOSITION OF SURPLUS PROPERTY
FOR FUTURE REDEVELOPMENT AUTHORITY ACQUISITIONS TO
HABITAT FOR HUMANITY OF OSHKOSH RESTORE
WHEREAS, Habitat for Humanity of Oshkosh ReStore has requested that its
volunteers be allowed to remove from the properties cabinets, windows, fixtures, and any
other salvageable goods for the sole purpose of reuse to be resold in their ReStore; and
WHEREAS, the cost to the RDA to advertise and solicit proposals for removal of the
property, or for the RDA to remove the property either through the use of city employees
or contractors, exceeds the value of the property to be removed, resulting in the property
having no or a negative value; and
WHEREAS, Section 12-17(A)of the City of Oshkosh Municipal Code provides that
where property has no apparent value, the RDA may dispose of such property by any
appropriate means.
NOW, THEREFORE, BE IT RESOLVED by the Redevelopment Authority of the City
of Oshkosh that pursuant to Section 12-17(A)of the City of Oshkosh Municipal Code that
cabinets, windows, fixtures, and any other salvageable goods and remaining personal
property located within the structures is hereby declared to be surplus property with no
apparent value and that the request to remove such property by Habitat for Humanity of
Oshkosh ReStore is hereby approved for calendar years 2017 through 2019,with the
following conditions:
1)That Habitat for Humanity of Oshkosh ReStore coordinate all activities to
remove salvageable items and secure the property, at Habitat for Humanity of
Oshkosh ReStore’s expense, with the Community Development Department.
2)That before entering the property, Habitat for Humanity of Oshkosh ReStore
and all volunteers and/or employees of Habitat for Humanity of Oshkosh
ReStore execute appropriate waivers of liability;
3)That Habitat for Humanity of Oshkosh ReStore file with the City Clerk a
Certificate of Insurance in the amount of $2,000,000.00 showing Redevelopment
Authority of the City of Oshkosh as an additional insured.

SUBJECT:17-15 Declare and Approve Disposition of Surplus Property to Habitat for
Humanity of Oshkosh Restore
BACKGROUND
Habitat for Humanity approached the RDA several years ago and inquired whether their
volunteers and staff could remove salvageable material from RDA structures about to be
demolished. The RDA approved their proposal, and this action would continue the
arrangement for another 5 years.
ANALYSIS
As part of the City’s blight elimination and redevelopment programs, the RDA acquires
and demolishes structures. The material is hauled to the landfill and the City pays the
tipping fees based on the weight of the load. Habitat has removed many items and
materials from structures for their use, which saves the RDA and City in landfill tipping
fees at, so their offer and work has saved the City money.
RECOMMENDATION
The RDA declares and approves the Disposition of Surplus Property to Habitat for
Humanity of Oshkosh Restore.
EXECUTIVE DIRECTOR’S REPORT
Update on Buckstaff property:Construction continues on site and is reported to be on
schedule.The City recently opened and awarded bids for the infrastructure work
around the arena. Construction on the streets, utilities and signals is planned to start by
the end of July, 2017.
Update on Healthy Neighborhood Initiative:
1017 Bowen Street house –The project is budgeted to be about $100,000, with an asking
price of $122,500.Multiple interested parties have toured the property, but none have
made an offer. The RDA may want to consider retaining a real estate agent at this
point.
Update in South Shore Redevelopment Area:
Morgan District –Final design and bidding is being prepared for the next riverwalk
section, west of the Oregon Street Bridge.The City obtained almost $800,000 in grant
funds for the next phase of the riverwalk, west towards Boatworks. The new grant will
install the trail, and all riverwalk improvements on top of the sheet pile, and continue
with the trail west to the “lagoon”.City staff also submitted another riverwalk grant
application to WisDNR for the section from the Boatworks to the “lagoon”. We hope to
hear on this grant award in late 2017 for construction to start in 2018.
Pioneer Area –Mr. Art Dumke continues to work with City staff to explore multiple
development options and funding scenarios.
The Granary –The RDA parcel on the southwest corner of 6th and Nebraska has been
submitted as part of the Granary Site Plan and TIF application. The Plan Commission
and City Council approved the site plans, TIF Plan and Development Agreement for the
site.
Update on Marion & Pearl Redevelopment Area:
Jackson/Marion Parcel:Mr. Andy Dumke continues to develop more specific building
and site plans. He is also working on tenant occupancy and a financing plan.His option
expires on September 20, 2018.
