PURPOSE: ACCEPT DRAINAGE EASEMENT AT 751 SOUTH WASHBURN
STREET
INITIATED BY: CITY OF OSHKOSH
PLAN COMMISSION RECOMMENDATION: Approved
BE IT RESOLVED by the Common Council of the City of Oshkosh that the proper
City officials are hereby authorized and directed to accept a drainage easement, per the
attached, and the proper City officials are hereby authorized and directed to execute any
and all documents necessary for purposes of same.

BACKGROUND
The subject property is 5.66 acres in size and located on the south side of Abbey Avenue with
access from S. Washburn Street. The site is developed with an 80 -unit apartment complex and
associated parking areas. The City of Oshkosh is requesting acceptance of a drainage
easement to allow for continued storm drainage from the subject property and surrounding
properties and to provide access to the existing drainage swale.
ANALYSIS
There is an existing drainage swale located on the subject property that conveys storm water to
Abbey Avenue from the apartment complex's private storm water management system as well
as from adjacent and surrounding properties. Reconstruction of the parking lot at Fire Station
16 (725 S. Washburn St.) has been proposed and storm drainage will continue into and
through this swale. The City's Engineering Division is requesting an easement at the subject
site to allow for continued drainage from all properties through the existing swale and to
provide access to the City in order to inspect, maintain, and repair the swale when needed.
The proposed easement will be 20 feet wide, running 725 feet along the east property line to
Abbey Avenue. The Department of Public Works will work with the property owner to have
appropriate easement documents signed and recorded at the Winnebago County Register of
Deeds.
FISCAL IMPACT
Acceptance of the storm sewer easement as proposed will not require additional city services.

RECOMMENDATION
The Plan Commission recommended approval of the acceptance of the easement at its July 18,
2017 meeting.

GENERAL INFORMATION

RECOMMENDATION/CONDITIONS
Staff recommends approval of the acceptance of the proposed drainage easement as requested.
The Plan Commission approved of the proposed easement acceptance as requested. The
following is the Plan Commission's discussion on this item.
Mr. Slusarek presented the item and reviewed the site and surrounding area and explained the
reason for the easement request. He discussed the size of the proposed easement and stated that
the Department of Public Works will work with the owner to have appropriate easement
documents signed and recorded once the easement has been approved.
There was no discussion on this item.
Motion by Vajgrt to approve acceptance of an easement for property located at 751 S. Washburn
Street.
Seconded by Hinz. Motion carried 8-0.

The City is proposing to accept a 20 -foot wide by 725 -foot long storm water drainage easement
along the eastern property line of Parcel Number 90614660200 (751 South Washburn Street).
There is an existing drainage swale located on this property that conveys storm water to Abbey
Avenue from not only.the apartment complex's private storm water management system, but
from other surrounding and adjacent properties. With the proposed reconstruction of the
parking lot at Fire Station 16 (725 South Washburn Street), storm drainage will continue into
and through this swale. An easement is being proposed that allows the continued existing
drainage from all properties and will also provide access to the City in order to inspect,
maintain and repair the swale when needed.
