AMENDMENT N0. ?
The CITY OF OSHKOSH, hereinafter referred to as CITY, and BROWN AND CALDWELL, 8383
Greenway Boulevard, Suite 600, Middleton,WI 53582, hereinafter referred to as the CONSULTANT, entered
into an agreement for DESIGN AND RID SUPPORT SERVICES FOR 1'ERNAU AVENUE
WATERSHEDINORTH MAIN STREET AREA DETENTION BASIN on January 14, 2015.
Paragraph C In ARTICLE XI. PAYMENT included the provision that costs for additional services shall
be negotiated and set forth in a written amendment to this AGREEMENT executed by both parties prior to
proceeding with the work covered under the subject amendment.
THEREFORE, the CITY and the CONSULTANT agree to insert the following paragraph after the first
paragraph in ARTICLE Ill. SCOPE OF WORK:
The CONSULTANT shall provide the services described in the CONSULTANT's Amend inent#9 dated
February 15,2015.
The CITY and the CONSULTANT further agree to insert the following bullet point after the first bullet
point in Paragraph A of ARTICLE Xl. PAYMENT:
• Payment for Amendment No. 1 shall be a Time and Materials Sum not to exceed $31,523
(Thirty One Thousand Five Hundred Twenty Three Dollars).
All other terms contained within the January 14, 2015 agreement remain unchanged and In effect.

This Attachment A documents additional scope and tasks requested of Brown and Caldwell (BC) by
the City of Oshkosh (City)for services under the F=ernau Avenue Watershed/ North Main Street Area
DetentionBasl project(City Res. No. 1541; BC Project# x.47344)dated January 14, 2015- This
project is also referred to as "Work unit B" In this amendment.
Scope Changes
Addl.tional Effort#1 - State Peder CountyCouniy Permittin
Changes to the project design required additional state and federal permit applications (Fn addition
to the permits Identified under Task 6 in the original scope of work), Each additional permit and
description is provided below.
1. Stream Realignment and Enclosure Individual Permit(WDNR).
The proposed culvert alignment to convey streamflow from west to east across North Main Street
required a WDNR Individual Permit submittal. BC prepared the Individual Permit application
followingthe guidance as provided on the WDNR's webpage, A list of submittal requirements
and responsibilities under this task Is given below.
BC Performed:
a. Upload the required files on behalf of the City.
b. Prepare the Application form "Water Resources Application for Project Permits" (Form
# 3500-53).
c. Prepare and compile required project plan drawings for altering stream
d. Prepare and compile site maps for permit application.
e, Prepare a narrative description as described_ on the WDNR's Application Checklist
(09/2014).
f, prepare hydrologic and hydraulic computations as described on the WDNR's
Application Checklist(09/2014).
g. Prepare a narrative identifying the sequence of construction events.
h. Attend one(1)face-to-face meeting with the WDNR. It is assumed that the one
meeting will cover Issues related to this task and Task 2 of the amendment,
City;
a. Signed Individual Permit submittal
b. Paid application fee
c. Provided a copy of the deeds or similar proofs of ownership for submittal
d. Was responsible for preparing and publishing Public Notice Newspaper Posting:
e. Submitted prepared documents on the WDNRS website.
2. Utility Structure, Bridge, Wetland General Permit(WDNR)
As proposed, the outlet pipe from the North Main Street Detention Basin passes through a
delineated wetland that was not Identified at the time of the project's original contract. A state
permit application was required for this proposed construction.
RC prepared the General Permit application per instructions under the "Reporting Application"
provided by the WDNR(General Permit Application Checklist,02/13/201.5).

The City signed the permit application,submitted and paid the application fee.
3, US Army Corp of Engineers Waterway Permitting(Federal)
The proposed culvert alignment to convey streamflow from west to east across North Main Street
also required a permit from the USACE. For budgeting purposes BC directly forwarded the permit
documentation to the USACE. BC budgeted up to 4 hours to respond to USACE additional
requests for Information.
4. Wisconsin Department of Transportation
The project required construction within the Jackson Street(USH 45) right-of-way. BC prepared
the "Application/Permit To Work On Highway Right-Of-Way". The City signed the permit
application,submitted and paid the application fee.
5. Winnebago County Erosion Control Permit
The project required a county erosion control permit for the portion of the project outside the city
limits. This area encompasses the construction at Jackson Street and east to the detention
basin. RC prepared the Winnebago County Erosion Control and Stormwater Management
Application Form for submittal by the City. The City signed the permit application,submitted and
paid the application fee.
Additional Effort#2: Qes
Jgn of North Main StreetCrossln Culy
The City requested a new crossing at North Main Street to convey the North Fernau channel. The
new crossing will improve the hydraulics of the current channel configuration, but will require an
east-west box culvert across North Main Street, and then a bend to the south to daylight Just south of
the existing WPS driveway.
BC:
J.. Prepared 60%, 90%and final construction plan sheets (included within the Fernau Avenue
Watershed-North Main Street Area Detention Basin design package) limited to:
a. Two(2) plan and profile sheets
b. One (J.)sheet with culvert cross and abandoned stream sections
C. The 60% and 90% plan sheets were reviewed by the City.
2. BC incorporated specifications related to the culvert construction into the project's Special
Conditions document.
3. BC prepared final plans.
4. Survey services were conducted to prepare the necessary drainage easement description to be
located on the WPS property(east side of North Main Street).
Additional Effort#3: Engin-Bering Services Related to a Basin Un,derdralnSyatem
The design, bid and construction services related to the permanent underdraln/ dewatering system
and the clay liner for the North Main Street Detention Basin were performed by another engineering
firm (AECOM)under a separate agreement between tho.Clty and AECOM. BC budgeted time to moot
with AECOM to coordinate design issues and provide necessary Information so that AECOM can
conduct the design. AECOM provided separate plan drawings and Special Conditions, with
appropriate professional engineer's or professional geologist's seals to the City. As requested by the

City,AECOM's plan drawings and Special Conditions for the underdraln/dewatering system and the
clay liner were referenced In BC's North Main Street Area Detention Basin Construction Drawings
and Special Conditions, for bidding and construction purposes.
BC pians referred to the clay liner and underdrain system as being designed and specified by
AECOM.
Information shown on BC plan sheets relating to the underdraln system and associated clay liner will
be for informational and clarification purposes only and will reference the plan drawings provided by
AECOM. BC shall have no responsibility for the adequacy of the design nor the performance of the
constructed clay liner and underdraln system.
Additional Effort#4:Changes to the„(,iv1,I— nd Layout Prolect Aspects
The project design budget was based on the assumption that no regulatory wetlands existed on the
project site(assumption #9 of original agreement). In October, 2015 field Inspections did delineate
regulatory wetlands which resulted in the re-alignment of the detention basin. Under this effort BC:
1.. Redrafted the basin grading plan to avoid disturbance of the delineated wetlands.
2. Re-modelled the detention facility to verify performance for storage volume and peak flow
control
3. Re-modelled the detention facility to verify performance for pollution reduction (Total
Suspended Solids and Total Phosphorus).
The project design was conducted in accordance with assumption # 1.5 of the original agreement
regarding use of BC CAD standards. On January 20, 2016 City requested the CAD standards to be
revised per City of Oshkosh Standards. BC conducted.this conversion.
Schedule
Additional Effort I (Permitting): The target date for submittal of WDNR permits Is January 22,
2016
Additional Efforts 2, 3 and 4 (Design): The target date for completion of this task is to meet the
scheduled bid advertising date of February 16, 2016.
Budget Amendment
All work will be conducted under the terms and conditions as described in the Fernau Avenue
Watershed/ North Main Street Area Retention Basin agreement dated January 14, 2016, The
Amendment budget is provided below.

Assumptions
:1) AECOM will provide hard copy and PDF format plan sheets for the permanent underdrain
system and clay liner directly to the City.
2) All plan sheets and specifications provided byAECOM will be Identified as products of AECOM
signed and sealed by appropriate Registered Engineer from AECOM.
3) BC is not responsible for designing or reviewing the permanent underdrain system and clay
liner design Including details and calculations, or any other plan drawings or Special
Conditions(specifications)provided by AECOM, BC will review the plan drawings and Special
Conditions for the permanent underdrain system and clay liner for conflicts with features of
the plan drawings prepared by BC.
4) AECOM will review BC's Inlet and outlet structure details and provide any coordination that
may be necessary to confirm the compatibility of these structures with the clay liner and
underdrain system.
5) BC prepared Special Conditions for application to Work Unit B and submitted the Special
Conditions to the City. The City will assemble the Special Conditions in a manner that will
result In the least complicated document for bidding, BC is not responsible for Special
Conditions submitted by AECOM.
6) AECOM will be responsible for the underdrain and clay finer related bid items, bid item
descriptions,and quantities, for the Proposal Form to be prepared by the City,
7) AECOM will be responsible for the underdrain and clay liner related Special Conditions,
8) It is understood that City will compile the following into a single contract bid package:
a) BC work products for the facility to be described as Work Unit B Detention Basin
b) Work products from AECOM for the Work Unit B clay finer and underdrain system
c) Work products from AECOM for a similar facility to be described as Work Unit A Detention
Basin
9) The contractor will have a single point of contact during construction as designated by the
City of Oshkosh, The point of contact will coordinate construction support activities among
the City, Contractor, BC and AECOM. BC will not be responsible for coordinating work of
AECOM.
