HomeMy WebLinkAbout04. 17-336 JULY 11, 2017 17-336 RESOLUTION (CARRIED 7-0 LOST LAID OVER WITHDRAWN ) PURPOSE: APPROVE AMENDMENT TO PROFESSIONAL SERVICE AGREEMENT WITH AECOM FOR ENVIRONMENTAL ENGINEERING FOR BUCKSTAFF PROPERTY ($25,000.00) INITIATED BY: COMMUNITY DEVELOPMENT BE IT RESOLVED by the Common Council of the City of Oshkosh that an amendment to the professional service agreement with AECOM is hereby for environmental engineering not to exceed $25,000.00 and the proper City officials are authorized and directed to enter into an appropriate agreement for purposes of same and to take those steps necessary to implement the terms and conditions of the agreement as amended. BE IT FURTHER RESLOVED that money for this purpose is hereby appropriated from: Acct. No. 323-0740-6401-06720 CIP Scattered Site TO: Honorable Mayor and Members of the Common Council FROM: Allen Davis, Community Development Director DATE: June 28, 2017 RE: Approve Amendment to Professional Service Agreement with AECOM for Environmental Engineering for Buckstaff Property ($25,000) BACKGROUND As part of the remediation of the former Buckstaff site for the Oshkosh Arena project, the City retained AECOM to submit the WisDNR application materials for an eventual Certificate of Compliance and Voluntary Party Liability Exemption (VPLE) so that both the City and the developer would not be liable for environmental contamination on the site. A part of the documentation that AECOM must submit to the WisDNR are the records for all the handling of impacted materials on the site. The City crews demolished the concrete foundations and hauled the material away to a crushing site. The amount and the time to test and analyze the material was beyond the original scope of the project. The proposed amendment contained within the proposed scope of services is required for the redevelopment of the Buckstaff site. ANALYSIS The proposed amendment is based on an hourly contract, not to exceed $25,000. Specific elements of the original services to be performed for the project are similar to all the Marion Road redevelopment sites, and include: • Complete Voluntary Party Liability Exemption (VPLE) for WisDNR, which the City would want in order to limit any liability for the City or future owner for environmental contamination on the site. • Plan for handling/using contaminated soil and groundwater management. • On-site construction documentation. • Assistance in Site Preparation including bidding documents, bid review and bid award. This work must be completed in concert with redevelopment of the former Buckstaff site into the Oshkosh Arena. The amendment to the agreement is related to time and effort beyond the original scope. The original agreement specified 5 weeks of foundation hauling and no testing of the concrete, bricks and other masonry. The timing turned out to be 13 weeks of hauling and inspections. In addition, WisDNR required laboratory testing and a new application for the Beneficial Reuse of Recycled Concrete. In order to keep the project on schedule, staff directed AECOM to complete those new tasks. FISCAL IMPACT The cost of these professional services will be paid out of the funds the City had set aside for Scattered Sites - Blight Elimination in the 2017 Capital Improvement Program. This project is still under budget by about $50,000, after deducting this amendment, since City crews removed the foundations over the winter, instead of the City awarding the demolition bid to a contractor. RECOMMENDATION Common Council approve an amendment to the professional service agreement with AECOM for Environmental Engineering for Buckstaff in the amount of $25,000.
