PURPOSE: ACCEPT SIDEWALK & TRAFFIC SIGNAL EASEMENT AT 606
EAST MURDOCK AVENUE

PLAN COMMISSION RECOMMENDATION: Approved
BE IT RESOLVED by the Common Council of the City of Oshkosh that the proper
City officials are hereby authorized and directed to accept sidewalk and traffic signal
easement at 606 East Murdock Avenue, per the attached, and the proper City officials are
hereby authorized and directed to execute any and all documents necessary for purposes
of same.

BACKGROUND
The irregularly shaped subject property is 10.49 acres in size and located on the northwest
corner of E. Murdock Avenue and Bowen Street. The subject site is an industrial land use and
is the location of Muza Metal Products.
ANALYSIS
City administration is requesting acceptance of an easement for installation of sidewalk, traffic
signals, and related equipment on the property. The proposed easement will be two feet wide,
running 294 feet along the south property line to the southeast corner of the lot including a 15.2'
x 12' triangular area at the corner of Bowen Street and E. Murdock Avenue. The easement is
necessary to allow for the sidewalk to be moved away from the curb during reconstruction of
this section of E. Murdock Avenue scheduled for later this year. The easement will also allow
for traffic signal equipment to be placed so as to maintain ADA accessible sidewalks and ramps
as well as to create a larger terrace for snow storage. The Department of Public Works will work
with the property owner to have appropriate easement documents signed and recorded at the
Winnebago County Register of Deeds.
FISCAL IMPACT
Accepting the easements as proposed will not result in any additional city service provisions
other than that is already provided in this area.
RECOMMENDATION
The Plan Commission recommended approval of the acceptance of an easement at its June 20,
2017 meeting.

GENERAL INFORMATION
Applicant: City of Oshkosh
Owner: Muza Metal Products, LLC
Actions Requested:
The City of Oshkosh is requesting acceptance of a sidewalk, traffic signal/base/pole, and conduit
easement for installation of sidewalk, traffic signals, and related equipment.
Applicable Ordinance Provisions:

Property Location and Background Information:
The irregularly shaped subject property is 10.49 acres in size and located on the northwest corner
of E. Murdock Avenue and Bowen Street. The site has an industrial land use and is home to Muza
Metal Products.
ANALYSIS
The City's Engineering Division is requesting an easement from Muza Metal for the installation of
sidewalk, traffic signals, and related equipment. The proposed easement will be two feet wide,
running 294 feet along the south property line to the southeast corner of the lot, including a 15.2'
X 12' triangular area at the corner of Bowen St. and E. Murdock Ave.

Staff recommends approval of the acceptance of the proposed easement as requested.
The Plan Commission approved of the acceptance of the easement as requested. The following is
the Plan Commission's discussion on this item.
Mr. Slusarek presented the item and reviewed the site and surrounding area and discussed the
current land use of the property which is industrial. He reviewed the site plan for the proposed
easement and discussed the reason for the request and the dimensions of the easement area.
There was no discussion on this item.
Motion by Propp to approve acceptance of an easement for property located at 606 E. Murdock
Avenue.
Seconded by Borsuk. Motion carried 7-0.
