HomeMy WebLinkAbout18. 17-286 JUNE 13, 2017 17-286 RESOLUTION (CARRIED 7-0 LOST LAID OVER WITHDRAWN ) PURPOSE: APPROVE THE SALE OF FERMENTED MALT BEVERAGES AT LEACH AMPHITHEATER BY PARKS DEPARTMENT STAFF INITIATED BY: PARKS DEPARTMENT BE IT RESOLVED by the Common Council of the City of Oshkosh that pursuant to Sec. 125.06(6) of the Wisconsin Statutes, the proper Parks Department staff are authorized to sell fermented malt beverages at Leach Amphitheater in accordance with the regulations established by Chapter 125 of the Wisconsin Statutes and Chapter 4 of the Oshkosh Municipal Code. TO: Honorable Mayor and Members of the Common Council FROM: Ray Maurer, Parks Director DATE: June 8, 2017 RE: Approve Sale of Fermented Malt Beverages at Leach Amphitheater by Parks Department Staff BACKGROUND Since 2009 when the Parks Department assumed programming for the Leach Amphitheater, staff has collaborated with the Oshkosh Convention and Visitor's Bureau (OCVB) to secure Special Class "B" Licenses to allow Parks Department staff to sell fermented malt beverages at city -sponsored events at the Leach Amphitheater. This was done as state law permits non- profits and Convention and Visitor Bureaus to secure Special Class "B" Licenses. ANALYSIS With the current change in leadership at the OCVB, I was contacted by Lynn Peters, Interim Executive Director, asking about the history of this collaboration. During that conversation, we discussed Section 125.06(6) of the Wisconsin Statutes which provides that employees of the municipality can sell fermented malt beverages in parks when authorized by the legislative body. This is the same process that the City has utilized to authorize City employees to sell fermented malt beverages at Lakeshore Municipal Golf Course as well as Reetz Concession stands. We agreed that this is the best option for the sales at the Leach Amphitheater at city - sponsored events. FISCAL IMPACT There will be a small savings to the city, $100-$200, as we have paid the $10 per event fee in the past for the Special Class "B" Licenses. RECOMMENDATION Staff recommends the Common Council adopt the resolution.
