PURPOSE: APPROVE SPECIFIC IMPLEMENTATION PLAN FOR NEW
PARKING LOT; 227 WEST LINWOOD AVENUE OAKLAWN
ELEMENTARY SCHOOL

WHEREAS,the general development plan for the proposed planned development
at 227 W. Linwood Avenue was previously approved; and
WHEREAS, the applicant has submitted a specific implementation plan for
construction of a new parking lot at 227 W. Linwood Avenue; and
WHEREAS, the Plan Commission finds that the specific implementation plan for
the planned development for construction of a parking lot at 227 W. Linwood Avenue is
consistent with the criteria established in Section 30-387(6) of the Oshkosh Zoning
Ordinance.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that a specific implementation plan for the planned development for
construction of a parking lot at 227 W. Linwood Avenue, Oaklawn Elementary School,
per the attached, is hereby approved with the following conditions:
(1) Base standard modification from the Zoning Ordinance to:
a. Permit a total of 92 surface parking stalls (45 existing stalls and 47 stalls to
be constructed).
b. Reduce the required front yard setback from 30 feet to approximately 13
feet 6 inches for a 6 foot tall solid fence along the west property line.
c. Reduce the required front yard setback for parking lot improvements
from 30 feet to approximately 13 feet 6 inches.
(2) Lights be mounted so fixtures are directed east towards the existing school
building and away from the residential properties to the west.

BACKGROUND
The subject area consists of a single parcel which is approximately 1.07 acres in size. The
proposed parking lot improvements are adjacent to Oaklawn Elementary School (112 Viola
Avenue) and the subject area is currently vacant with the exception of various scrub trees
along the west property line and remaining sections of asphalt and gravel from the former
storage/light industrial use. The subject area was purchased in 2015 by the Oshkosh Area
School District to provide additional parking for staff and visitors. The surrounding area
consists of predominately residential uses with commercial to the south (Fair Acres Shopping
Center) and west along Jackson Street. The subject site is zoned I -PD Institutional Zoning
District with a Planned Development Overlay. The 10 and 20 Year Comprehensive Land Use
Plans recommend commercial uses.
ANALYSIS
The petitioner is proposing to construct a 16,500 square foot asphalt parking lot containing 47
surface parking stalls accessed by a single driveway leading from Viola Avenue to internal 24
foot two-way drive aisles to accommodate the needs of staff and visitors at Oaklawn
Elementary School. Additional site improvements include construction of a storage building
located north of the proposed parking lot for on-site equipment storage needs for the Oshkosh
Area School District. The school currently has an existing 45 stall parking lot east of the facility
and with the additional proposed parking lot, would have a total number of 92 parking stalls.
This additional parking would exceed code requirement maximums of 32 stalls but staff is
supportive of a base standard modification to allow the additional parking spaces as it may
alleviate safety/traffic concerns from staff and visitors parking on the street. The school hosts
multiple community events which add to area parking demand and additional on-site parking

would mitigate impacts on the surrounding neighborhood. The plans as proposed meet the
required setback on the west side; however a base standard modification is required for a
reduced front yard setback which is supportable given the existing school building is currently
located within the setback area. The subject area has been combined with the adjacent school
site to meet the conditions of the General Development Plan. Lighting plans depict two light
fixtures at 20 feet in height with placement to help mitigate potential impacts on the residential
properties to the west. Staff is also recommending that the lights be mounted so fixtures are
directed east towards the existing school building. Landscaping plans submitted exceed code
requirements including trees, shrubs, and perennials with a six foot tall solid fence along the
west property line to screen the parking lot from adjacent residential uses. The fencing will
require a base standard modification for a reduced front yard setback but will provide
adequate vision clearance and final landscape placement and conformance with the zoning
ordinance will be determined during the site plan review process. The parking lot will need to
be designed to ensure drainage is collected and conveyed to the City's storm system or to the
public right-of-way with final storm water management plans to be approved by the
Department of Public Works during the site plan review process.
FISCAL IMPACT
There will be no fiscal impact as the result of construction of an off-street parking lot at this
location will not result in the expansion of city services to the site.
RECOMMENDATION
The Plan Commission recommended approval of the specific implementation plan with
conditions at its June 6, 2017 meeting.

Background Information Property Location and Type:

ANALYSIS
Use/Site Design
The petitioner is proposing to construct a 16,500 square foot asphalt parking lot which would
contain 47 surface parking stalls to accommodate the needs of staff and visitors at Oaklawn
Elementary School. The proposed parking lot is accessed by a single driveway leading from Viola
Avenue to internal two-way drive aisles which are 24 feet in width. Additional site improvements
include construction of a storage building (approximately 450 square feet in size) located north of
the proposed parking lot to meet on-site equipment storage needs of the Oshkosh Area School
District. The remaining subject area will be graded, seeded with turf grass, and new landscaping
will be added around the proposed parking lot improvements.
As proposed, the side yard (west) setback is approximately 7.75 feet which meets the
requirements of the Institutional Zoning District. With that being said, the proposed surface
parking lot location will also require a base standard modification to reduce the required front
yard setback from 30 feet to approximately 13.57 feet as proposed. Staff is supportive of the base
standard modification because the existing school building is currently located within the
required 30 foot setback area and the proposed parking lot improvements will not increase the
existing nonconforming setback situation.
During General Development Plan review, City staff recommended a condition be included to
require the subject area be combined with the adjacent school site (112 Viola Avenue). The
applicant has since worked with City staff to complete a lot combination request. Staff is in the
process of updating records to reflect the lot combination request and believes the intent of the
original condition has been met.
Parkin
Based on the existing indoor institutional use, the zoning ordinance requires elementary schools
provide 1 parking stall per 2 teachers. According to the Oshkosh Area School District, Oaklawn
Elementary School employs a total of 50 teachers (including full-time and part-time); and a
minimum of 25 surface parking stalls and maximum of 32 parking stalls would be required per
the zoning ordinance. The school site has an existing parking lot east of the proposed subject area
which contains a total of 45 surface parking stalls. The proposed parking lot project would bring
the total number of parking stalls to 92. Staff is supportive of a base standard modification to
allow additional parking spaces as it may be necessary in order to alleviate safety/traffic concerns
as the applicant has stated that staff members and visitors have been forced to park on the street
due to lack of parking spaces on site. Additionally, the school hosts multiple community events
which adds to area parking demand from time to time and adding additional on-site parking will
help to mitigate impacts on the surrounding neighborhood.
Lightmg
The petitioner has submitted a lighting and photometric plan for the proposed project which calls
for the installation of two light fixtures with an overall mounting height of 20 feet. Staff worked
with the petitioner on the placement of lighting to help mitigate potential impacts to the
residential properties west of the subject area. Staff is recommending as a condition of approval
that lights be mounted so fixtures are directed east towards the existing school building and away
from the residential properties to the west.
ITEM- Oaklawn Parking Lot SIP
Landscaping
A landscape plan has been submitted and is required to meet zoning ordinance requirements.
Based on the proposed improvements a total of 349 points are required by the zoning ordinance
and the petitioner is proposing a total of 401 points through a combination of deciduous and
shade trees, shrubs, and perennials. Due to the proposed parking lot abutting a residential use to
the west, City staff recommended adequate screening be provided to mitigate any potential
conflicts. Staff has worked with the petitioner and a six foot tall solid fence will be installed along
the west property line to screen the parking lot from the adjacent residential uses. The proposed
fencing will require a base standard modification to reduce the required front yard setback from
30 feet to approximately 13 feet 6 inches, as proposed. Staff is supportive of the reduced setback
requirement because it should provide adequate vision clearance for vehicles backing out of 300
Viola Avenue and exiting the proposed parking lot. The landscape plan will be further reviewed
for conformance with the zoning ordinance and final landscape placement will be determined
during the Site Plan Review Process.
Stormwater Management
The Department of Public Works reviewed the plans and noted the proposed parking lot will
need to be designed to ensure drainage of the parking lot collect and convey to the City's storm
system and the runoff from an extreme rain event (like a 100 -year) be directed to the public right-
of-way. Final storm water management plans will be required to be reviewed and approved by
the Department of Public Works during the Site Plan Review Process.
FINDINGS/RECOMMENDATION/CONDITIONS
In its review and recommendation to the Common Council on an application for a Planned
Development district, staff recommends that Plan Commission make the following findings
based on the criteria established by Chapter 30-387 (C)(6):
(a) The proposed Planned Development project is consistent with the overall purpose and
intent of this Chapter.
(b) The proposed Planned Development project is consistent with the City's
Comprehensive Plan and other area plans. (It is the responsibility of the City to determine
such consistency.)
(c) The proposed Planned Development project would maintain the desired relationships
between land uses, land use densities and intensities, and land use impacts in the environs
of the subject site.
(d) Adequate public infrastructure is or will be available to accommodate the range of
uses being proposed for the Planned Development project, including but not limited to
public sewer and water and public roads.
(e) The proposed Planned Development project will incorporate appropriate and adequate
buffers and transitions between areas of different land uses and development
densities/intensities.
(f) The proposed Planned Development project design does not detract from areas of
natural beauty surrounding the site.
(g) The proposed architecture and character of the proposed Planned Development project
is compatible with adjacent/nearby development.

(h) The proposed Planned Development project will positively contribute to and not
detract from the physical appearance and functional arrangement of development in the
area.
(i) The proposed Planned Development project will produce significant benefits in terms
of environmental design and significant alternative approaches to addressing
development performance that relate to and more than compensate for any requested
exceptionsibase standard modifications variation of any standard or regulation of this
Chapter.
(j) For Planned Development projects that are proposed to be developed in phases, the
applicant can provide a timeline for development and can demonstrate that the project
would be successful even if all phases were not or could not be completed.
Staff recommends approval of the Planned Development for a Specific Implementation Plan and
the findings listed above with the proposed following conditions:
1. Base standard modification from the Zoning Ordinance to:
a. Permit a total of 92 surface parking stalls (45 existing stalls and 47 stalls to be
constructed).
b. Reduce the required front yard setback from 30 feet to approximately 13 feet 6
inches for a 6 foot tall solid fence along the west property line.
c. Reduce the required front yard setback for parking lot improvements from 30 feet
to approximately 13 feet 6 inches.
2. Lights be mounted so fixtures are directed east towards the existing school building and
away from the residential properties to the west.
The Plan Commission approved of the planned development for a specific implementation plan
as requested with conditions noted. The following is the Plan Commission's discussion on this
item.
Ms. Williams presented the item and reviewed the site and surrounding area as well as the land
use and zoning classifications in this area and stated that the site has had the parcels combined
with the school property since the last meeting to meet the condition of the general development
plan. She further stated that the use was consistent with the City's Comprehensive Plan and
reviewed the site plan. She discussed the number of parking stalls and the addition of a storage
building north of the proposed parking lot with the remaining area to be turf grass and
landscaping around the parking lot improvements. She also discussed the base standard
modification for the front yard setback, the number of parking stalls required and the number
proposed which will exceed the maximum number of stalls. Staff was supportive of a base
standard modification to allow the additional parking stalls as it was a traffic and safety concern
with the on -street parking due to insufficient on-site parking stalls. She reviewed the lighting
plans and stated that the light poles have been relocated to avoid any negative impact on the
residential property to the west. She reviewed the landscape plan which meets code
requirements and discussed the six foot fence to be installed along the west property line for
screening purposes for the residential properties which will also require a base standard
modification for the side yard setback. The site will need to meet code requirements for storm
water management and both the landscaping and storm water plans will be reviewed during the

site plan review process. She reviewed photos of examples of the storage facility and the
conditions recommended for this request.
Mr. Thorns questioned if the school district was exempt from the standards of the requirement
that the exterior materials for the storage building having to match the exterior of the principal
structure.
Ms. Williams responded negatively and stated that the exterior materials for the storage building
would have to meet those requirements.
Mr. Borsuk questioned if the exterior materials match the existing structure as it did not appear
that it met that requirement.
Ms. Williams replied that the photo displayed is for reference purposes only and is not the
structure to be constructed at Oaklawn School. The photo was taken at Emeline Cook School and
was provided for example purposes only and although the school is constructed of brick the
materials are only required to be compatible with the existing structure and not necessarily
constructed of brick. She further commented that the school system has been sensitive to the
City's design standards in the past.
Motion by Vajgrt to approve a specific implementation plan for a new parking lot for property
located at 227 W. Linwood Avenue with the following conditions:
Base standard modification from the Zoning Ordinance to:
a. Permit a total of 92 surface parking stalls (45 existing stalls and 47 stalls to be
constructed).
b. Reduce the required front yard setback from 30 feet to approximately 13 feet 6 inches for a 6
foot tall solid fence along the west property line.
