Linwood Avenue is consistent with the criteria established in Section 30-387(6) of the Oshkosh Zoning Ordinance. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that the General Development Plan for construction of a parking lot at 220-224 Viola Avenue and 227 W. Linwood Avenue, per the attached, is hereby approved and the following conditions be addressed in the final planned development Site Implementation Plan: 1. Base standard modification from the Zoning Ordinance to allow the number of stalls as proposed, where code requires a maximum of thirty-two (32) parking spaces. 2. A dense landscape buffer and/or a solid fence be installed along the west property line to screen the parking lot from the adjacent residential uses. 3. Lighting fixtures must not exceed 20 feet and petitioner work with City staff on the placement of light fixtures to mitigate potential impacts with adjacent residential uses. 4. TO: Honorable Mayor and Members of the Common Council FROM: Darryn Burich Director of Planning Services DATE: May 18, 2017 RE: Approve General Development Plan for New Parking Lot; 220-224 Viola Avenue and 227 West Linwood Avenue (Oaklawn Elementary School) (Plan Commission recommends approval) BACKGROUND The subject area consists of three parcels which were previously combined into one lot containing approximately 1.07 acres. The proposed parking lot improvements are adjacent to Oaklawn Elementary School (112 Viola Avenue) and the subject area is currently vacant with the exception of various scrub trees along the west property line. The subject area was purchased in 2015 by the Oshkosh Area School District to provide additional parking for staff and visitors. The surrounding area consists of predominately residential uses with commercial to the south (Fair Acres Shopping Center) and west along Jackson Street. The subject site is zoned I -PD Institutional Zoning District with a Planned Development Overlay. The 10 and 20 Year Comprehensive Land Use Plans recommend commercial uses. ANALYSIS The petitioner is proposing to construct an 18,295 square foot asphalt parking lot containing 50 surface parking stalls accessed by a single driveway leading from Viola Avenue to internal 24 foot two-way drive aisles to accommodate the needs of staff and visitors at Oaklawn Elementary School. The school currently has an existing 45 stall parking lot east of the facility and with the additional proposed parking lot, would have a total number of 95 parking stalls. This additional parking would exceed code requirement maximums of 32 stalls but staff is supportive of a base standard modification to allow the additional parking spaces as it may alleviate safety/traffic concerns from staff and visitors parking on the street. The school hosts multiple community events which add to area parking demand and additional on-site parking would mitigate impacts on the surrounding neighborhood. The plans as proposed meet the required setback on the west side; however staff is recommending installation of a dense landscape buffer and/or a solid fence to mitigate any potential conflicts with adjacent City Hall, 215 Church Avenue P.O. Lighting plans depict three light fixtures at 27 feet in height which will be required to be reduced to a maximum of 20 feet as it exceeds code requirements. Staff is concerned with the proposed locations for the fixtures as they are adjacent to the residential uses and will work with the applicant to relocate the light poles or re -angle the lamps to mitigate potential impacts. Landscaping plans have not yet been submitted and will be required to meet code requirements. These issues will be resolved prior to the submittal for a Specific Implementation Plan for this project. The parking lot will need to be designed to ensure drainage is collected and conveyed to the City's storm system or to the public right-of- way with final storm water management plans to be approved by the Department of Public Works during the site plan review process. The three parcels within the subject area have been combined into one lot but will be required to be combined with the adjacent school site. FISCAL IMPACT There will be no fiscal impact as the result of construction of an off-street parking lot at this location will not result in the expansion of city services to the site. RECOMMENDATION The Plan Commission recommended approval of the general development plan with conditions at its May 16, 2017 meeting. West Residential & Commercial SMU Comprehensive Plan Land Use Recommendation Land Use 10 Year & 20 Year Land Use Recommendations Commercial ANALYSIS The petitioner is proposing to construct an 18,295 square foot (0.42 acre) asphalt parking lot which would contain 50 surface parking stalls to accommodate the needs of staff and visitors parking needs at Oaklawn Elementary School. The proposed parking lot is accessed by a single driveway leading from Viola Avenue to internal two-way drive aisles which are 24 feet in width. Based on the existing indoor institutional use, the zoning ordinance requires elementary schools provide 1 parking stall per 2 teachers. According to the Oshkosh Area School District, Oaklawn Elementary School employs a total of 50 teachers (including full-time and part-time), so a minimum of 25 surface parking stalls and maximum of 32 parking stalls would be permitted per the Zoning Ordinance. The school site has an existing parking lot east of the proposed subject area which contains a total of 45 surface parking stalls. The proposed parking lot project would bring the total number of parking stalls to 95. Staff is supportive of a base standard modification to allow additional parking spaces as it may be necessary in order to alleviate safety/traffic concerns as the applicant has stated that staff members and visitors have been forced to park on the street due to lack of parking spaces on site. Additionally, the school hosts multiple community events which add to area parking demand from time to time and adding additional on-site parking will help to mitigate impacts on the surrounding neighborhood. As proposed, the side yard (west) setback is proposed to be 7.75 feet which meets the requirements of the Institutional Zoning District. With that being said, the proposed parking lot abuts a residential use to the west and staff feels the proposed improvements should provide adequate screening to mitigate any potential conflicts. When requesting Specific Implementation Plan approval, staff is recommending the petitioner include installation of a dense landscape buffer and/or a solid fence along the west property line to screen the parking lot from the adjacent residential uses. Additionally, the petitioner has submitted a lighting and photometric plan for the proposed project which calls for the installation of three light fixtures with an overall mounting height of approximately 27 feet. Staff is concerned with the location of the lighting fixtures adjacent to the residential use on the west and plans to work with the applicant to identify locations that serve to mitigate potential impacts. Additionally, the proposed overall mounting height of the lighting fixtures exceeds code requirements and will need to be reduced to a maximum of 20 feet upon Specific Implementation Plan submittal. A landscape plan has not been submitted at this time and will be required prior to Specific Implementation Plan submittal and approval. The landscape plan will be required to show internal parking lot landscape islands and will need to meet the point totals based on the surface parking lot proposal. The Department of Public Works reviewed the plans and noted the proposed parking lot will need to be designed to ensure drainage of the parking lot collect and convey to the City's storm system and the runoff from an extreme rain event (like a 100 -year) be directed to the public right- of-way. Final storm water management plans will be required to be reviewed and approved by the Department of Public Works during the Site Plan Review Process. Lastly, the applicant has worked with City staff to obtain a lot combination for the three parcels within the subject area but prior to the project commencing; the Oshkosh Area School District will be required to combine the subject area with the adjacent school site at 112 Viola Avenue. FINDINGS/RECOMMENDATION/CONDITIONS In its review and recommendation to the Common Council on an application for a Planned Development district, staff recommends that Plan Commission make the following findings based on the criteria established by Chapter 30-387 (C)(6): (a) The proposed Planned Development project is consistent with the overall purpose and intent of this Chapter. (b) The proposed Planned Development project is consistent with the City's Comprehensive Plan and other area plans. (It is the responsibility of the City to determine such consistency.) (c) The proposed Planned Development project would maintain the desired relationships between land uses, land use densities and intensities, and land use impacts in the environs of the subject site. (d) Adequate public infrastructure is or will be available to accommodate the range of uses being proposed for the Planned Development project, including but not limited to public sewer and water and public roads. (e) The proposed Planned Development project will incorporate appropriate and adequate buffers and transitions between areas of different land uses and development densities/intensities. (f) The proposed Planned Development project design does not detract from areas of natural beauty surrounding the site. (g) The proposed architecture and character of the proposed Planned Development project is compatible with adjacent/nearby development. (h) The proposed Planned Development project will positively contribute to and not detract from the physical appearance and functional arrangement of development in the area. (i) The proposed Planned Development project will produce significant benefits in terms of environmental design and significant alternative approaches to addressing development performance that relate to and more than compensate for any requested exceptions/base standard modifications variation of any standard or regulation of this Chapter. (j) For Planned Development projects that are proposed to be developed in phases, the applicant can provide a timeline for development and can demonstrate that the project would be successful even if all phases were not or could not be completed. Staff recommends approval of the Planned Development for a General Development Plan and the findings listed above with the proposed following conditions: 1. Base standard modification from the Zoning Ordinance to allow the number of stalls as proposed, where code requires a maximum of thirty-two (32) parking spaces. 2. Oshkosh Area School District will be required to combine the subject area with the adjacent school site (112 Viola Avenue). The Plan Commission approved of the general development plan as requested with conditions noted. The following is the Plan Commission's discussion on this item. Ms. Williams presented the item and reviewed the site and surrounding area as well as the land use and zoning classifications in this area. She stated that the staff report refers to the lots as three parcels which is in error as the three parcels have been combined into one lot and is located adjacent to Oaklawn Elementary School. The proposed use is consistent with the City's Comprehensive Plan and she reviewed the site plan for the parking lot which would create 50 additional parking stalls. The number of stalls would exceed the maximum permitted by the Zoning Ordinance but is supported by staff as a base standard modification as it would alleviate safety/traffic concerns with the on street parking which is due to the lack of adequate parking on site. She discussed that the school hosts community events that adds to the parking demand and that landscaping or fencing would be required along the west side to provide screening for the residential uses. Landscaping plans will be required to meet code requirements at the time of the specific implementation plan review and storm water management plans will require review and approval by the Department of Public Works during the site plan review process. Lighting plans were also discussed which will be required to be relocated and reduced in height to mitigate potential impacts on the adjacent residential uses. The owner will also be required to combine this parcel with the school site property. Ms. Williams also reviewed the conditions recommended for this request. Ms. Propp questioned if the extra area to the north of the proposed parking lot will be grass. Ms. Williams responded that the school has plans for a future storage building north of the parking lot which will need to be submitted with the specific implementation plan for review however the remaining area is planned to be turf grass. Motion by Vajgrt to approve a general development plan for a new parking lot for property located at 220-224 Viola Avenue and 227 W. Linwood Avenue (Oaklawn Elementary School) with the following conditions: 1. Attached please find two (2) copies of the Stormwater Management Report, two (2) 24"x36", two(2)11"x17", and one (1) compact disk of the site plan. Below is a narrative of the proposed work. According to the January 24, 2017 City of Oshkosh Zoning Map, the site is currently zoned IPD which matches the Oaklawn Elementary School zoning. The property is currently vacant and is not in use. The proposed use of the property is to install a fifty (50) space parking lot, mainly for the use of school staff and for special events held at Oaklawn Elementary School, This will help keep parked cars off of the street in front of Oaklawn Elementary School. The proposed work includes installation of a 18,295 SF (0.42 acres) asphalt parking lot. The parking lot will be bordered by curb and gutter. Three (3) LED parking lot lights will be installed (photometrics attached to the site plan). The storm water runoff will be conveyed to the City storm sewer (see Stormwater Management Report). The setbacks of the proposed parking lot are as follows (located on Sheet C2.0); west side: 7.75 Feet from the property line to the back of curb, East side: 23.3 feet from the property line to the back of curb. South side: 12.9 feet from the property line to the back of curb; this allows the south parking lot line to line up with the south building line of Oaklawn Elementary School, North side: 91.96 feet from the property line to the back of curb. Since the property is currently zoned IPD, I do not believe we need to have the property re -zoned. If I am mistaken, please let me know and I will submit a rezoning application.
