HomeMy WebLinkAbout09. 17-251 MAY 23, 2017 17-251 RESOLUTION (CARRIED 7-0 LOST LAID OVER WITHDRAWN ) PURPOSE: APPROVE AMENDMENT TO ENGINEERING SERVICES AGREEMENT WITH MCMAHON GROUP FOR DESIGN & PREPARATION OF CONSTRUCTION DOCUMENTS FOR THE URBAN RECONSTRUCTION OF NORTH MAIN STREET (FROM NEW YORK AVENUE TO MURDOCK AVENUE) ($79,511.00) INITIATED BY: DEPARTMENT OF PUBLIC WORKS WHEREAS, the City and McMahon Group previously entered into a professional services agreement in which McMahon Group would provide the City with services related to the design and preparation of construction documents for the urban reconstruction of North Main Street from New York Avenue to Murdock Avenue; and WHEREAS, additional services requested included design changes due to implementation of the Federal Highway Administration's new sidewalk policy,historical studies and Section 106 review, preparation of Section 4(f) evaluations, design changes resulting from changes to the Wisconsin Department of Transportation's design procedures, and direct purchase of traffic signals and related equipment for the New York Avenue, Harrison Street, and North Main Street intersection. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that the proper City officials are authorized and directed pursuant to Section 12-16 of the Municipal Code to enter into an amended agreement with McMahon Group. BE IT FURTHER RESOLVED that an amendment to the agreement with McMahon Group is approved and said City officials are authorized and directed to take those steps necessary to implement the terms and conditions of the final agreement. BE IT FURTHER RESOLVED that money for this purpose is hereby appropriated from: Acct. Gohde, Assistant Director of Public Works SM DATE: May 18, 2017 RE: Amendment to Engineering Services Agreement for Design and Preparation of Construction Documents for the Urban Reconstruction of North Main Street (from New York Avenue to Murdock Avenue) / McMahon Group (McMahon) ($79,511) BACKGROUND A professional services agreement for engineering services for the design and preparation of construction documents for the urban reconstruction of North Main Street from New York Avenue to Murdock Avenue with McMahon was approved by the Common Council on March 26, 2013. During the course of this project, additional engineering -related services were requested by City staff. ANALYSIS The additional services requested included design changes due to implementation of the Federal Highway Administration's new sidewalk policy, historical studies and Section 106 review, preparation of Section 4(f) evaluations, and design changes resulting from changes to the Wisconsin Department of Transportation's design procedures. Staff also requested plan changes to allow the City to direct purchase the traffic signals and related equipment for the New York Avenue, Harrison Street, and North Main Street intersection. This allowed the intersection to be opened to traffic in July, instead of October. FISCAL IMPACT Staff has reviewed the amendment and the costs. The amount of this amendment is $79,511. This will raise the total agreement amount to $301,011 (not to exceed). Funds for this project were included in the Street, Storm Sewer, Sanitary Sewer, and Water Main sections of the 2013 Capital Improvement Program (CIP). $217,000 was budgeted in the CIP. Adequate funds exist within other 2017 CIP projects to cover the difference. RECOMMENDATIONS Chapter 12 of the Municipal Code of the City of Oshkosh provides that professional services of a specialized nature, including engineering services, may be procured without the use of formal, sealed quotes. I have reviewed the amendment and, in accordance with Section 12-16 of the Code, I am hereby recommending the Common Council approve this amendment. Approved, Mar A.
