HomeMy WebLinkAbout08. 17-228 MAY 9, 2017 17-228 RESOLUTION (CARRIED 7-0 LOST LAID OVER WITHDRAWN ) PURPOSE: APPROVE ACCEPTING EASEMENTS AT ATLAS AVENUE AND GLOBAL PARKWAY INITIATED BY: CITY OF OSHKOSH PLAN COMMISSION RECOMMENDATION: Approved BE IT RESOLVED by the Common Council of the City of Oshkosh that the proper City officials are hereby authorized and directed to accept two drainage access easements, per the attached, and the proper City officials are hereby authorized and directed to execute any and all documents necessary for purposes of same. TO: Honorable Mayor and Members of the Common Council FROM: Allen Davis Director of Community Development DATE: May 3, 2017 RE: Approve Accepting Easements at Atlas Avenue and Global Parkway; Southwest Industrial Park (Plan Commission recommends approval) BACKGROUND The subject site consists of a vacant City -owned property along Atlas Avenue near the corner of Global Parkway and contains a portion of the storm water detention facilities for the first phase of the Southwest Industrial Park. The general area consists of vacant/undeveloped and industrial uses. ANALYSIS The City is requesting acceptance of two drainage access easements to improve access to storm water detention facilities located on the subject site. The City is responsible for the maintenance of these facilities which requires access for inspection, mowing, and other tasks. The proposed easements will provide flatter access points from the right-of-way onto the property to perform these tasks and the proposed easements are located within the setback area of the property and will not reduce the buildable area of the lot. The two easements will be located on the southwest and eastern corners of the property and the Department of Public Works will have appropriate easement documents signed and recorded at the Winnebago County Register of Deeds. FISCAL IMPACT There are no additional costs to the City anticipated as a result of the acceptance of easements. Applicable Ordinance Provisions: N/A Property Location and Background Information: The subject site consists of a vacant City -owned property along Atlas Avenue near the corner of Global Parkway. The general area consists of vacant/undeveloped and industrial uses. ANALYSIS The subject property contains a portion of the storm water detention facilities for the first phase of the Southwest Industrial Park. The City is responsible for the maintenance of these facilities, which requires access for inspection, mowing, and other tasks. The proposed easements will provide flatter access points from the right-of-way onto the property. The proposed easement along the southwest corner of the property is 30 feet wide at the right-of- way and will run 263.89 feet to the north. The easement along the eastern corner of the property is 32 feet wide at the right-of-way and will run 112.84 feet to the north. The proposed easements are located within the setback area of the lot and will not reduce the buildable area of the lot. The Department of Public Works will have appropriate easement documents signed and recorded at the Winnebago County Register of Deeds. RECOMMENDATION/CONDITIONS Staff recommends approval of the acceptance of the proposed easements as requested. The Plan Commission approved of the acceptance of the proposed easements as requested. The following is the Plan Commission's discussion on this item. Mr. Slusarek presented the item and reviewed the site and surrounding area. He discussed the purpose for the easement request and reviewed the location and size of the proposed easements. There was no discussion on this item. Motion by Nollenberger to accept drainage access easements for property located at Atlas Avenue and Global Parkway. Seconded by Borsuk. Motion carried 8-0. Item I —Accept Easentent — Intersection Arboretum/Congress/Suntntit Easement Description The proposed easements are adjacent to land, owned by the City, which contain a portion of the storm water detention facilities for the first phase of the Southwest Industrial Park. The City is responsible for the maintenance of these facilities, which requires access for inspection, mowing and other tasks. The slope of the ground, within the land currently owned by the City, is too steep adjacent to the Right of Way to allow for safe vehicle access. The proposed easements will provide a flatter access point from the right of way onto the property. The easements are located within the setback areas of the lots and will not reduce the buildable area of the lot. I - 2 c 0.
