PLAN COMMISSION MINUTES
April 18, 2017

Chairperson Fojtik called the meeting to order at 4:00 pm. Roll call was taken and a quorum
declared present.
The minutes of April 4, 2017 were approved as presented. (Thoms/Propp)
I. EXTRATERRITORIAL TWO-LOT LAND DIVISION/CERTIFIED SURVEY MAP AT
5850 STATE HIGHWAY 76 IN THE TOWN OF VINLAND
The petitioner is requesting a two-lot land division/certified survey map from one existing parcel
containing a total of 19.32 acres. Sizes of the proposed lots are as follows:
Lot 1 = 4.23 Acres
Lot 2 = 15.09 Acres
Mr. Slusarek presented the item and reviewed the site and surrounding area as well as the land
use and zoning classifications in this area. He discussed the reason for the land division which
was to separate the commercial use from the undeveloped portion of the lot. He stated that the
proposed land division would not alter the land use patterns in the area and is consistent with the
City’s Comprehensive Plan. The Department of Public Works has reviewed the request and noted
that the location of sanitary sewer and other utilities should be shown on the final certified survey
map, (CSM).
Mr. Thoms commented that there was a well located on Lot 2 and questioned if it was currently in
use.
Mr. Nau responded that he was not aware if it was still is use as it was part of the property
previously operated by Golf Central.
Mr. Thoms questioned if the well would cause a problem if it was still actively being used and if
there were any issues with the wetlands depicted on the east side of the CSM.
Mr. Slusarek responded that there were no issues with the wetland area, but he had no further
information on the use of the well.

Mr. Thoms stated that the city should clarify if the well was still in use prior to approving the CSM
for this request.
Mike Goudreau, 4482 Harbor Village Drive, Omro, stated that he was representing the property
owner; however, he did not have any further information on the status of the well on site.
Motion by Propp to approve an extraterritorial two-lot land division/certified survey map for
property located at 5850 State Highway 76 in the Town of Vinland.
Seconded by Hinz.
Mr. Bowen arrived at 4:02 pm.
Mr. Thoms reiterated that the issue with the status of the well should be clarified prior to the
completion of the final CSM.
Motion carried 6-0-1. (Bowen abstained as he was not present for the discussion on this item)
II. EXTRATERRITORIAL THREE-LOT LAND DIVISION/CERTIFIED SURVEY MAP AT
THE 5000 BLOCK OF LEONARD POINT ROAD IN THE TOWN OF OMRO
The petitioner is requesting a three-lot land division/certified survey map from one existing parcel
containing a total of 5.079 acres. Sizes of the proposed lots are as follows:
Lot 1 = 1.653 Acres
Lot 2 = 1.713 Acres
Lot 3 = 1.713 Acres
Mr. Nau presented the item and reviewed the site and surrounding area as well as the land use
and zoning classifications in this area. He discussed the purpose for the land division which was
for the development of single-family residential lots. He reviewed the CSM and discussed the
storm water management feature of various easements and a detention basin located on Lot 1. He
further stated that the land division would not alter the land use patterns in the area and is
consistent with the City’s Comprehensive Plan. The Department of Public Works has reviewed
this request and did not have any concerns with the proposed land division.
Mr. Borsuk questioned if there were any provisions for the operation and maintenance of the
storm water detention pond.
Mr. Nau responded that this aspect would be handled by Winnebago County or the Town of
Omro.
Motion by Thoms to approve an extraterritorial three-lot land division/certified survey map for
property located at the 5000 block of Leonard Point Road in the Town of Omro.
Seconded by Borsuk. Motion carried 7-0.

III. TWO-LOT LAND DIVISION/CERTIFIED SURVEY MAP AT THE NORTHEAST
CORNER OF HARRISON STREET & E. NEVADA AVENUE
This item was withdrawn from the agenda at the request of the petitioner.
IV. THREE-LOT LAND DIVISION/CERTIFIED SURVEY MAP AT THE SOUTHEAST
CORNER OF STATE STREET & WASHINGTON AVENUE (105 WASHINGTON
AVENUE, STATE STREET PARKING LOT)
The petitioner is requesting a three-lot land division/certified survey map from two existing
parcels containing a total of 0.969 acres. Sizes of the proposed lots are as follows:
Lot 1 = 0.233 Acres
Lot 2 = 0.582 Acres
Lot 3 = 0.154 Acres
Mr. Nau presented the item and reviewed the site and surrounding area as well as the land use
and zoning classifications in this area. He reviewed the CSM depicting the layout of the proposed
lots and discussed the reason for the request which was to acquire a portion of the City’s State
Street parking lot for the development of parking garages and surface parking for the Washington
Avenue apartments. He also discussed the Walker Parking Study findings that confirmed that this
parking lot was underutilized and the land disposition to Discovery Properties was a separate
action item on this agenda. He explained that a portion of the lot will be retained by the City and
would remain as public parking. He also explained that this request would not alter the land use
patterns and was consistent with the City’s Comprehensive Plan and all lots would meet the
dimensional requirements that were in place prior to January 1st when the item was submitted. He
discussed the reason that the parcels could not be combined and that the Department of Public
Works has reviewed the request and noted that a WPS and cross-access easement be required on
the final CSM as well as the release of a city storm sewer easement. He also reviewed the
conditions recommended for this request.
Mr. Thoms questioned if the number of parking stalls for the Washington Avenue apartments
would meet code requirements.
Mr. Nau responded that there would be 41 parking stalls provided which will meet the zoning
ordinance standards for the required number of parking stalls.
Mike Goudreau, 4482 Harbor Village Drive, Omro, stated that he was one of the owners of
Discovery Properties who completed the Washington Building’s rehabilitation from office use to
luxury apartments and that the building renovations have been completed and the apartments are
in the process of becoming occupied. He explained their need to construct the garage structures
for use in conjunction with the apartments as it was necessary for the marketability of the
development.

Motion by Thoms to approve a three-lot land division/certified survey map for property located at the
southeast corner of State Street and Washington Avenue (105 Washington Avenue, State Street
parking lot) with the following conditions:
1. Proposed Lots 1 and 2 shall be deed-restricted together (or similar instrument).
2. All required easements shall be placed on the final CSM per approval by the Department of Public
Works.
Seconded by Borsuk. Motion carried 7-0.
VA. LAND DISPOSITION PORTION OF CITY PARKING LOT (STATE STREET LOT) IN
THE 300 BLOCK OF STATE STREET
VB. GRANT CROSS ACCESS EASEMENT TO PROPERTY AT 300 STATE STREET
Two actions are requested as part of this request:
A: Land disposition of a portion of the State Street parking lot;
B: Granting of a cross access easement to 300 State Street to access portions of the State Street
parking lot to be disposed.
Ms. Williams presented the item and reviewed the area proposed to be disposed of to the property
owners of 105 Washington Avenue as well as the area for the cross access easement behind the
structure at 300 State Street. She reviewed these areas further and explained the reason for these
requests which were part of the implementation of the TID #30 Project Plan for the adaptive reuse
of 105 Washington Avenue from office use to residential apartments. The land disposition will
provide the property owner with adequate area to construct garage and surface parking for the
apartment use and the cross access easement will provide continued access to 3-4 parking stalls
adjacent to the commercial building at 300 State Street.
Mr. Bowen questioned how many parking stalls in the State Street parking lot were permit parking
and how many were public parking.
Mr. Nau responded that he did not have information on this aspect.
Ms. Williams added that the completion of the Walker Parking Study resulted in that there were
only ten vehicles utilizing the parking stalls within this lot per day and that the City was retaining
20 parking stalls for this continued use. The land disposition was also previously approved by the
Parking Utility.
Mr. Bowen then questioned if the parking stalls adjacent to 300 State Street were usable parking
stalls.

Ms. Williams responded affirmatively and explained that the cross access easement was
approximately 40’ by 40’ with a 28’ drive aisle and would provide adequate access to the parking
stalls via Waugoo Avenue.
Motion by Borsuk to approve a land disposition of a portion of a City parking lot, (State Street lot),
located in the 300 block of State Street and to grant a cross access easement to property located at 300
State Street.
Seconded by Thoms. Motion carried 7-0.
There being no further business, the meeting adjourned at approximately 4:20 pm. (Borsuk/Hinz)
