PLAN COMMISSION RECOMMENDATION: Approved
A GENERAL ORDINANCE OF THE CITY OF OSHKOSH AMENDING SECTION 30-
32 OF THE OSHKOSH MUNICIPAL CODE PERTAINING TO ZONING DISTRICTS.
The Common Council of the City of Oshkosh do ordain as follows:
SECTION 1. That Section 30-32 of the Oshkosh Municipal Code pertaining to
Zoning Districts and the map therein described is hereby amended by changing the
district character of the properties at 460, 474 and 482 Marion Road from UI -Urban
Industrial and I -Institutional with a Planned Development Overlay to UMU-Urban
Mixed Use with a Planned Development Overlay, per the attached map.
SECTION 2. This Ordinance shall be in full force and effect from and after its
passage and publication.
SECTION 3. Publication Notice. Please take notice that the City of Oshkosh
enacted Ordinance #17-222 APPROVE ZONE CHANGE / 460, 474 & 482 MARION
ROAD / FROM UI -URBAN INDUSTRIAL AND I -INSTITUTIONAL WITH A
PLANNED DEVELOPMENT OVERLAY TO UMU-URBAN MIXED USE WITH A
PLANNED DEVELOPMENT OVERLAY on April 25, 2017. The Ordinance changes the
zoning on the property referred to as the Lamico site and the existing City water tower
site to an Urban Mixed Use District with a Planned Development Overlay. The full text
of the Ordinance may be obtained at the Office of the City Clerk, 215 Church Ave. and

Mixed Use District with a Planned Development Overlay (Plan Commission
recommends approval)
BACKGROUND
The subject area included in the zone change request consists of three parcels totaling
approximately 5.48 acres located within the Pearl/Marion Road Redevelopment Area at 460,
474 and 482 Marion Road. The subject area currently contains vacant industrial buildings and
a municipal water tower owned by the City of Oshkosh. Prior land uses on the subject site
included the former Lamico crutch factory. The surrounding area consists of multiple -family
residential and commercial uses to the north, commercial and institutional uses and vacant
Redevelopment Authority -owned land to the east, multiple -family residential to the south,
and multiple -family residential to the west. The 10 and 20 Year Comprehensive Land Use
Plans have the subject property slated for mixed downtown uses.

The petitioner is requesting the zone change from the existing zoning classifications of UI
Urban Industrial District and I -PD Institutional District with a Planned Development to the
UMU-PD Urban Mixed -Use District with a Planned Development Overlay to allow the site to
be reconfigured and developed. The development plan is to demolish the existing structures
on the former Lamico property and construct a multiple -family apartment complex and
associated amenities for student housing. The City is currently in the process of constructing a
new water tower on land adjacent to the subject site replacing the existing tower located
within the subject area which will be demolished. City staff is working with the applicant to
reconfigure the land by swapping land area to meet the long term development needs of the
applicant and the City. Once the land has been redistributed, staff proposes to rezone the
future water tower site back to its original institutional zoning designation. The zone change
request is consistent with the City's Comprehensive Plan land use recommendation and the

planned development overlay is beneficial to the petitioner and community as it provides
flexibility for the development as well as the ability to grant public review and oversight of the
plans to ensure compliance with development and planning policies.
FISCAL IMPACT
The subject property is in a developed center city area with services already provided to the
area so there should little or no fiscal impact. Any infrastructure expansion costs needed to
service the development would be addressed through development agreement.
RECOMMENDATION
The Plan Commission recommended approval of a zone change at its April 4, 2017 meeting.

GENERAL INFORMATION

Actions Requested:
The applicant requests a zone change from the existing UI Urban Industrial District and I -PD
Institutional District with a Planned Development Overlay to UMU-PD Urban Mixed -Use
District with a Planned Development Overlay (PD).
Applicable Ordinance Provisions:
The Zoning Ordinance does not establish criteria relative to appropriateness of changing zoning
from one classification to another but relies on the Comprehensive Plan and good planning
principles. The purpose of this request is to make the entire subject area one zone district to
allow the owner to move forward with redevelopment of the development area.
Property Location and Type:
The subject area included in the zone change request consists of three parcels totaling

ANALYSIS
The petitioner requests a zone change from the existing UI Urban Industrial District and I -PD
Institutional District with a Planned Development Overlay (PD) to UMU-PD Urban Mixed -Use
District with a Planned Development Overlay. The purpose of the rezoning request is to allow the
existing site to be reconfigured and developed by the applicant. The applicant is proposing, as a
separate action item on this agenda, to demolish the existing structures on the former Lamico
property and construct a four-story multiple -family apartment complex and associated site
amenities which will be marketed for students attending the University of Wisconsin -Oshkosh.
Furthermore, the City of Oshkosh is currently in the process of constructing a new water tower on
land adjacent to the subject area which will replace the existing water tower located within the
subject area. Once the new water tower has been constructed, the existing water tower will be
demolished by the city. At this time City staff is working with the applicant to reconfigure the land
within the subject area to meet the long term development needs of the applicant and City. Once
the existing water tower has been demolished, City staff will work with the applicant to obtain
authorization to swap land with the applicant. Once land has been redistributed, City staff
proposes to rezone the future water tower site back to I -PD Institutional District with a Planned
Development Overlay. It is anticipated this will take place in 2018 prior to the applicant finalizing
construction of the proposed four-story multiple -family apartment complex.
The rezone request is consistent with the Comprehensive Plan's mixed downtown land use
recommendation as the UMU district allows residential uses by -right. The Planned Development
designation is beneficial to the petitioner as it provides the flexibility needed to allow for
development of the subject property. The Planned Development designation is beneficial to the
community as it provides the ability to address items that do not meet code dimensional standards
and grants public review and oversight of development plans to ensure compliance with
development and planning policies.
RECOMMENDATION/CONDITIONS
Staff recommends approval of the zone change from UI Urban Industrial District and I -PD
Institutional District with a Planned Development Overlay to UMU-PD Urban Mixed -Use
District with a Planned Development Overlay District (PD) as requested.
The Plan Commission approved of the zone change as requested. The following is the Plan
Commission's discussion on this item.

Ms. Williams presented the item and reviewed the site and surrounding area as well as the land
use and zoning classifications in this area. She stated that the proposed zone change was
consistent with the City's Comprehensive Plan and discussed the construction of the new water
tower that is currently underway and that the existing tower would be demolished once it is
complete. She also explained the land swap that will take place between the city and the
developer once this project is complete which will result in a new lot configuration and
discussed the benefits of the planned development overlay to the petitioner and the community.
Mr. Thorns questioned if the zone change is consistent with the City's Comprehensive Plan if
the proposed development for the site would not be approved.
Ms. Williams responded affirmatively.
Motion by Nollenberger to approve a zone change from UI Urban Industrial District and I -PD
Institutional District with Planned Development Overlay to UMU-PD Urban Mixed Use
District with Planned Development Overlay for property located at 460, 474 and 482 Marion
Road.
Seconded by Borsuk. Motion carried 8-0.
