HomeMy WebLinkAbout17. 17-186 MARCH 28, 2017 APRIL 11, 2017 17-163 17-186 ORDINANCE FIRST READING SECOND READING (CARRIED 7-0 LOST LAID OVER WITHDRAWN ) PURPOSE: AMEND VARIOUS SECTIONS OF CHAPTER 30 ZONING ORDINANCE INITIATED BY: COMMUNITY DEVELOPMENT PLAN COMMISSION RECOMMENDATION: Approved A GENERAL ORDINANCE OF THE CITY OF OSHKOSH AMENDING VARIOUS SECTIONS OF THE ZONING ORDINANCE TO IMPROVE IMPLEMENTATION OF THE ORDINANCE WHICH BECAME EFFECTIVE JANUARY 1, 2017, INCLUDING, BUT NOT LIMITED TO: COMMUNICATION TOWERS AS A PERMITTED USE IN HEAVY INDUSTRIAL DISTRICTS; VEHICLE ACCESS STANDARDS; OFF-STREET PARKING AND TRAFFIC CIRCULATION; ACCESS EASEMENTS; FENCE STANDARDS AND MATERIALS; FACADES ON NEW PRINCIPAL STRUCTURES; AND ELECTRONIC MESSAGE BOARD SIGNS The Common Council of the City of Oshkosh do ordain as follows: SECTION 1. That Section 30-42(G) regarding the table for multi-family residential requirements is hereby amended as follows: Minimum Garage Door Setback to Alley (if applicable) — 10 feet Minimum Parking Required — See Article III SECTION 2. That Section 30-62(D) regarding uses in heavy industrial districts is hereby amended by creating new subsection (13) to allow communication antenna as a permitted use in heavy industrial zoning districts and renumber existing subsections (13) and (14) as (14) and (15) respectively. That Section 30-62(E) regarding communication antennas as a conditional use in the heavy industrial zoning district is hereby deleted and existing paragraphs (F) and (G) are renumbered (E) and (F) respectively. SECTION 4. That Section 30-79(C)(6) regarding land use regulations for multi-use buildings is hereby repealed and recreated to read: The residential and the commercial space shall be occupied by the same tenant and no portion of the live/work building shall be rented or sold separately. SECTION 5. That Section 30-172(N) regarding vehicle access standards is hereby amended by creating new subsection (1) regarding number of driveways permitted for single family and two family uses, and renumber existing subsections (1) and (2) to (2) and (3) respectively. (1) Single Family uses are limited to one driveway per lot unless otherwise regulated in this Code. Two-family uses are permitted two driveways per lot unless otherwise regulated in this Code. SECTION 6. That Section 30-175(J) regarding off-street parking and traffic circulation is hereby amended by creating new subsection (3) regarding no parking in setback areas and renumber existing subsection (3) to (4). (3) There shall be no parking in designated setback areas or outside of site plan approved parking spaces, except in the driveways of single and two family dwellings. SECTION 7. That Section 30-175(x) is hereby amended to create new subsection (2) regarding vehicular access easements across side and rear yard setbacks and renumber existing subsections (2) and (3) to (3) and (4) respectively. MARCH 28, 2017 APRIL 11, 2017 17-163 17-186 ORDINANCE FIRST READING SECOND READING CONT'D (2) Vehicular access easements across side and rear yard setbacks of adjoining parking and loading facilities in the I; NMU; SMU; UMU; CMU; RMU; SP; UI and HI districts, across side and rear yards of parking and loading facilities of uses allowed by conditional use permit in RH; SR-2; SR-3; SR-5; SR-9; DR-6 and TR-10 districts, and across side and rear yard setbacks of multi-family developments in MR-12; MR-20 and MR-36 districts may be approved provided a cross access easement is approved by the City Attorney and filed with the Register of Deeds. SECTION 8. That Figure 30-192c Fencing Standards is hereby amended by deleting reference to 8 foot fence and amend 6 foot fences to 4 foot fences in front or street yards. See attached Exhibit A for revised Figure 30-192c. SECTION 9. That Section 30-192(E)(1)(b)(iii) regarding fence materials in specific zoning districts is hereby deleted and existing subsections (iv) and (v) are renumbered (iii) and (iv) respectively. SECTION 10. That Section 30-192(E)(1)(b)(iv) regarding fencing materials is hereby repealed and recreated to read as follows: (iv) Galvanized and coated chain link fences shall have a minimum 9 gauge thickness, and a top rail support is required. Galvanized and coated chain link fences shall not be permitted in front or street yards and shall not extend toward the street beyond the front of the building. SECTION 11. That Section 30-241(F)(5) and (5)(a) regarding facades on new principal structures is hereby repealed and recreated to read as follows: (5) Facades. Designs that result in blank walls on the front fagade are not permitted and shall meet the regulations for front facades of existing buildings as outlined in subparagraph (D)(6)(b) above. MARCH 28, 2017 APRIL 11, 2017 17-163 17-186 ORDINANCE FIRST READING SECOND READING CONT'D (a) On corner lots, either the front or street side fagade shall meet the minimum 25 percent window or door area requirement. SECTION 12. That new Section 30-280(A)(2) is hereby created to read as follows and renumber existing subsections (2) thru (7) to (3) thru (8) respectively. (2) No more than one (1) electronic message board is allowed on a lot. SECTION 13. That Figure 30-290b Permitted Sign Characteristics for Permanent Business Signs by Zoning District is hereby revised by (a) amending the 'electronic message boards' section to include specific zoning districts where one electronic message board would be permitted to read as follows;and (b) amending the footnotes by creating new number 12. Maximum of one (1) electronic message board per lot. Electronic Message Boards (in addition to maximum permitted signage area)12 _ One electronic message board is permitted per lot in MF, INS, SMU, UMU, CMU, RMU, BP, UI and HI districts. SECTION 14. This Ordinance shall be in full force and effect from and after its passage and publication. SECTION 15. Publication Notice. Please take notice that the City of Oshkosh enacted Ordinance #17-186 AMEND VARIOUS SECTIONS OF CHAPTER 30 ZONING ORDINANCE on April 11, 2017. The Ordinance updates provisions to improve implementation of the Zoning Ordinance, including, but not limited to: communication towers as a permitted use in heavy industrial districts;vehicle access standards; off-street parking and traffic circulation; access easements; fence standards and materials; facades on new principal structures; and electronic message board signs.
