HomeMy WebLinkAbout48. 17-163 MARCH 28, 2017 17-163 ORDINANCE FIRST READING (CARRIED LOST LAID OVER WITHDRAWN ) PURPOSE: AMEND VARIOUS SECTIONS OF CHAPTER 30 ZONING ORDINANCE INITIATED BY: COMMUNITY DEVELOPMENT PLAN COMMISSION RECOMMENDATION: Approved A GENERAL ORDINANCE OF THE CITY OF OSHKOSH AMENDING VARIOUS SECTIONS OF THE ZONING ORDINANCE TO IMPROVE IMPLEMENTATION OF THE ORDINANCE WHICH BECAME EFFECTIVE JANUARY 1, 2017, INCLUDING, BUT NOT LIMITED TO: COMMUNICATION TOWERS AS A PERMITTED USE IN HEAVY INDUSTRIAL DISTRICTS; VEHICLE ACCESS STANDARDS; OFF-STREET PARKING AND TRAFFIC CIRCULATION; ACCESS EASEMENTS; FENCE STANDARDS AND MATERIALS; FACADES ON NEW PRINCIPAL STRUCTURES; AND ELECTRONIC MESSAGE BOARD SIGNS The Common Council of the City of Oshkosh do ordain as follows: SECTION 1. That Section 30-42(G) regarding the table for multi-family residential requirements is hereby amended as follows: Minimum Garage Door Setback to Alley (if applicable) — 10 feet Minimum Parking Required — See Article III SECTION 2. That Section 30-62(D) regarding uses in heavy industrial districts is hereby amended by creating new subsection (13) to allow communication antenna as a permitted use in heavy industrial zoning districts and renumber existing subsections (13) and (14) as (14) and (15) respectively. That Section 30-62(E) regarding communication antennas as a conditional use in the heavy industrial zoning district is hereby deleted and existing paragraphs (F) and (G) are renumbered (E) and (F) respectively. SECTION 4. That Section 30-79(C)(6) regarding land use regulations for multi-use buildings is hereby repealed and recreated to read: The residential and the commercial space shall be occupied by the same tenant and no portion of the live/work building shall be rented or sold separately. SECTION 5. That Section 30-172(N) regarding vehicle access standards is hereby amended by creating new subsection (1) regarding number of driveways permitted for single family and two family uses, and renumber existing subsections (1) and (2) to (2) and (3) respectively. (1) Single Family uses are limited to one driveway per lot unless otherwise regulated in this Code. Two-family uses are permitted two driveways per lot unless otherwise regulated in this Code. SECTION 6. That Section 30-175(J) regarding off-street parking and traffic circulation is hereby amended by creating new subsection (3) regarding no parking in setback areas and renumber existing subsection (3) to (4). (3) There shall be no parking in designated setback areas or outside of site plan approved parking spaces, except in the driveways of single and two family dwellings. SECTION 7. That Section 30-175(x) is hereby amended to create new subsection (2) regarding vehicular access easements across side and rear yard setbacks and renumber existing subsections (2) and (3) to (3) and (4) respectively. MARCH 28, 2017 17-163 ORDINANCE CONTD (2) Vehicular access easements across side and rear yard setbacks of adjoining parking and loading facilities in the I; NMU; SMU; UMU; CMU; RMU; SP; UI and HI districts, across side and rear yards of parking and loading facilities of uses allowed by conditional use permit in RH; SR-2; SR-3; SR-5; SR-9; DR-6 and TR-10 districts, and across side and rear yard setbacks of multi-family developments in MR-12; MR-20 and MR-36 districts may be approved provided a cross access easement is approved by the City Attorney and filed with the Register of Deeds. SECTION 8. That Figure 30-192c Fencing Standards is hereby amended by deleting reference to 8 foot fence and amend 6 foot fences to 4 foot fences in front or street yards. See attached Exhibit A for revised Figure 30-192c. SECTION 9. That Section 30-192(E)(1)(b)(iii) regarding fence materials in specific zoning districts is hereby deleted and existing subsections (iv) and (v) are renumbered (iii) and (iv) respectively. SECTION 10. That Section 30-192(E)(1)(b)(iv) regarding fencing materials is hereby repealed and recreated to read as follows: (iv) Galvanized and coated chain link fences shall have a minimum 9 gauge thickness, and a top rail support is required. Galvanized and coated chain link fences shall not be permitted in front or street yards and shall not extend toward the street beyond the front of the building. SECTION 11. That Section 30-241(F)(5) and (5)(a) regarding facades on new principal structures is hereby repealed and recreated to read as follows: (5) Facades. Designs that result in blank walls on the front fagade are not permitted and shall meet the regulations for front facades of existing buildings as outlined in subparagraph (D)(6)(b) above. That new Section 30-280(A)(2) is hereby created to read as follows and renumber existing subsections (2) thru (7) to (3) thru (8) respectively. (2) No more than one (1) electronic message board is allowed on a lot. SECTION 13. That Figure 30-290b Permitted Sign Characteristics for Permanent Business Signs by Zoning District is hereby revised by (a) amending the 'electronic message boards' section to include specific zoning districts where one electronic message board would be permitted to read as follows;and (b) amending the footnotes by creating new number 12. Maximum of one (1) electronic message board per lot. Electronic Message Boards (in addition to maximum permitted signage area)12 _ One electronic message board is permitted per lot in MF, INS, SMU, UMU, CMU, RMU, BP, UI and HI districts. SECTION 14. This Ordinance shall be in full force and effect from and after its passage and publication. SECTION 15. Publication Notice. Please take notice that the City of Oshkosh enacted Ordinance #17-XXX AMEND VARIOUS SECTIONS OF CHAPTER 30 ZONING ORDINANCE on April 11, 2017. The Ordinance updates provisions to improve implementation of the Zoning Ordinance, including, but not limited to: communication towers as a permitted use in heavy industrial districts;vehicle access standards; off-street parking and traffic circulation; access easements; fence standards and materials; facades on new principal structures; and electronic message board signs. (2) The commercial component of the live/work building is limited to the following land uses, but only if such uses are also permitted by right or by conditional use permit in the applicable zoning district: (a) Office (b) Personal or Professional Service (c) Indoor Sales or Service (d) Artisan Production Shop (e) Indoor Maintenance Service (3) Employees who are not residents of the unit are permitted. (4) The commercial use is subject to the regulations of the applicable land use category in Section 30-78. (5) Both uses are subject to the nonresidential density, intensity, and bulk requirements of Article II. (6) The residential and the commercial space shall be occupied by the same tenant, and no portion of the live/work building shall be rented or sold separately. (7) Minimum required parking: The parking requirements of each individual land use shall apply. (8) Live/Work Buildings shall comply with the design standards for commercial uses and mixed uses. See Section 30-243. Section 30-80: Industrial Land Uses (A) Light Industrial: Facilities where all operations, with the exception of loading, are conducted entirely within an enclosed building. Such land uses are not associated with nuisances such as odor, noise, heat, vibration, and radiation which are detectable at the property line, and do not pose a significant safety hazard (such as danger of explosion). Examples include, but are not limited to manufacturing of clothing, furniture, cabinetry, electronic components, and mass-produced arts and crafts. Industrial land uses may conduct indoor sales as an accessory use provided that the requirements of Section 30-78(C) are complied with. -------------------------------- ------ City of Oshkosh Chapter 30-Page 156 Municipal Codes to City of Oshkosh Zoning Ordinance Municipal Code -------------------------------------------------------------- (1) Traffic into and out of all off-street parking, loading, and traffic circulation areas serving 6 or more parking spaces shall be forward-moving, with no backing into public streets. (2) Parking, loading, and traffic circulation areas serving less than 6 parking spaces may back into local streets, but shall not back into collector or arterial streets. Refer to Section 30-175(N)(6) regarding backing into streets. Traffic control devices shall be required as determined by the Department of Public Works. (K) Depiction on Required Site Plan. Any and all proposed driveways and other access points on the subject property shall be depicted as to their location and configuration on the site plan required for the development of the subject property. (L) Surfacing. (1) Driveways shall follow the surfacing requirements of Section 30-175(5). (2) Driveways shall be surfaced in accordance with this Chapter within 365 days of building permit issuance. If not dust-free during the permitted 365 days, a minimum aggregate base of 4 inches is required. (M) Nonconforming Driveways. (1) Nonconforming driveways shall comply with all of the regulations and requirements of Article V for nonconforming structures. (a) Legally established driveways located on properties containing single or two family land uses that do not conform to current performance standards shall be permitted to be reconstructed provided the reconstructed driveway is not dimensionally expanded. (2) Shared driveways (driveways located on multiple lots and typically situated over lot lines) that existed prior to the adoption of this Chapter may remain legal driveways. No new or reconstructed shared driveways may be established unless cross-access easements are recorded with the Register of Deeds. (N) Design of Single and Two Family Residential Driveways. (1) Single-family uses are limited to one driveway per lot unless otherwise regulated in this code. Two-family uses are permitted two driveways per lot unless otherwise regulated in this code. ----------------------------------- ------ City of Oshkosh Chapter 30-Page 322 Municipal Codes City of Oshkosh Zoning Ordinance Municipal Code -------------------------------------------------------------- (2) Off-Street Parking Areas Abutting Residential Districts. Any off-street parking area shall provide a solid fence, solid wall, or dense hedge/evergreen shrub border at least 5 feet high along all lot lines abutting a residential district, except in required front yards. Where the parking area abuts an alley, a 5-foot green area, as required in Subsection (1)(a) above, may be substituted for the required fence, wall, or hedge. (3) Off-Street Parking Areas Abutting Other Off-Street Parking Areas. (a) Except for single family and two family dwelling units, any off-street parking area abutting another off-street parking area shall provide a 5- foot minimum green area between the lot line and the parking area. This green area shall be landscaped with a combination of shrubs, trees, and ground cover. (b) Where either or both adjoining properties are less than 60 feet in width, parking areas on either property which is less than 60 feet in width may be constructed to the lot line without a parking area setback or green area required. (4) Landscaping used to meet these requirements shall count toward the landscaping required for paved areas in Article IX. (J) Locational Prohibitions for Off-Street Parking Areas. (1) On a lot containing a single family or two family dwelling unit, off-street parking shall not be located between the principal structure and a street right- of-way, except within residential driveways leading to a legal parking space. (2) No private parking shall occur on street terraces, publicly-owned driveways, or any other areas located within a public right-of-way. (3) There shall be no parking in designated setback areas or outside of site plan approved parking spaces, except in the driveways of single and two family dwellings. (4) In the RMU district, parking is prohibited in the waterfront yard. (K) Setbacks. (1) The distance from an off-street parking area to the property line of an abutting property shall meet the required setbacks for principal buildings. (3) In the SMU and UI districts, the parking area setback may be reduced to 5 feet from rear and side property lines if a 5-foot landscaped buffer is provided and if any additional bufferyard requirements are met. (4) Existing parking areas that do not meet the requirements of this Chapter may be maintained or repaired at their setback as of the effective date of this Chapter. (L) Parking Space Design for Single and Two Family Uses. (1) Legal Spaces. (a) Parking spaces must be provided either within a garage, in a driveway, or as uncovered parking spaces meeting the requirements of this Section. See Figures 30-175b and 30-175c. Permits are not required for temporary fencing. Temporary fencing shall be permitted for the following purposes: (1) The use of wood or plastic snow fences for the purposes of limiting snow drifting between November 1 and April 1. (2) The protection of excavation and construction sites and the protection of plants during grading and construction, in association with an active building permit. (E) Design and Materials. (1) Materials. (a) Fences shall be constructed using the following materials: (i) Naturally resistant or treated wood (ii) Brick or masonry (iii) Natural stone (iv) Wrought iron (v) Vinyl (vi) Galvanized and/or coated chain link (vii) Any other material of comparable quality as approved by the Director of Community Development, or designee. (b) Rules Related to Specific Materials. (i) Permanent chicken wire fences or snow fences shall not be used with residential uses. (ii) Non-corrugated, solid metal fences are permitted in the UI and HI zoning districts. (iv) Barb wire fencing or similar security fencing shall be permitted only on the top of security fencing when located at least 6 feet above the ground and shall be permitted only in the I, UI, and HI districts. (a) With the exception of fences used for required screening, any fence located in the front yard shall be a maximum of 50 percent opaque, meaning that the spaces between the pickets are equal to or greater than the width of the pickets. See Figure 30-192a. (b) A fence that includes pre-woven or interwoven privacy fence slats and that is at least 90 percent opaque shall be considered a solid fence. (c) Fences shall be architecturally compatible with the design and materials of the principal building. Design details shall be substantially the same (but need not be identical) as those of the principal building. Industrial uses shall be exempt from this requirement. Any and all fences, landscape walls, or decorative posts shall be erected so as to locate visible supports and other structural components toward the subject property, i.e. with the finished side facing outward. (I) Maintenance. Any and all fences, landscape walls, or decorative posts shall be maintained in a structurally sound and attractive manner. (a) A new principal structure's front fagade and primary entrance shall be oriented to the primary street. (b) On corner lots, the principal structure may be oriented to the side street provided it meets the requirements for fagades under Section (5), below. (c) Front entrances shall be identified by a stoop, entrance platform (with or without stairs), or porch. Full front and wraparound porches that incorporate the front entrance are also permitted. (4) Porches, Decks and Patios. Porches, decks, and patios shall meet the regulations for existing buildings in Subsection (C), above. (5) Fagades. Section 30-242: Multi-Family Uses These standards apply to all multi-family buildings and structures constructed after the effective date of Chapter. These standards also apply to Apartments with Limited Commercial land uses. (A) Exterior Materials. Multi-family buildings shall be clad in Class I, II or III materials. Class IV materials are prohibited. (1) Materials of comparable quality may be substituted for any class of material or be used as a decorative element if the material can be removed or replaced with a permitted exterior material, as determined by the Director of Community Development, or designee. (2) Standing seam metal roofs shall be prohibited. (B) Building Entrance. A sign or component of a sign that displays words, lines, logos, graphic images, or symbols, which may be changed electronically to provide different information, and which includes computer signs, electronic reader boards, video screens, LCD signs, electronic time and temperature signs, and other signs with electronically-controlled changing or moving displays. (1) Unless otherwise prohibited by this Chapter, electronic message boards may be integrated into the design of any Permanent Business Sign or Institutional Information Sign, as permitted by Figure 30-290a. (2) No more than one (1) electronic message board is allowed on a premises. (3) Permitted electronic message board area shall be in addition to the total permitted sign area for a given site. (4) Messages and non-text images shall not change appearance more than once every 10 seconds, and transitions between messages shall be via instantaneous change. Use of electronic message boards for images, text, or lighting that change appearance in a manner not permitted above shall be considered flashing, scrolling, or animated signs, which are prohibited per Section 30-294. (5) Electronic message boards shall be equipped with photosensitive equipment which automatically adjusts the brightness and contrast of the sign in direct relation to the ambient outdoor illumination. (6) Electronic message boards shall comply with the lighting requirements of Section 30-190. (7) Electronic message boards shall be maintained so as to be able to display messages in a complete and legible manner.
