PURPOSE: APPROVE OPTION TO PURCHASE FROM DYNAMIC
DRINKWARE LLC FOR VACANT LOT ON SOUTH SIDE OF
BADGER AVENUE /SOUTHWEST INDUSTRIAL PARK
INITIATED BY: DYNAMIC DRINKWARE LLC
BE IT RESOLVED by the Common Council of the City of Oshkosh that the option
to purchase submitted by Dynamic Drinkware LLC to acquire the vacant lot on the south
side of Badger Avenue, identified as Site 1 on the attached map, is hereby accepted and
the proper officials are hereby authorized and directed to execute any and all documents
necessary for purposes of same.

Res 17-96 Approve Option to Purchase from Dynamic Drinkware LLC
for a Land Locked Vacant Lot off Badger Avenue, Southwest Industrial Park
BACKGROUND
The applicant is interested in obtaining a 6 -month Option to Purchase on two parcels in the Southwest
Industrial park in order to perform their due diligence required for the environmental and engineering
research and analysis needed to determine the feasibility of their project.
ANALYSIS
The applicant is exploring an addition to the Avalon building and would like to perform a geo-technical
investigation and a wetland delineation on the parcels, prior to purchase. The attached map identifies
the Avalon parcel, and both City -owned parcels. The City -owned parcels contain about 9 acres. The
1.8 acre parcel located along Badger is suspected to include a wetland. The land locked parcel is about
7.3 acres in size.
The applicant has proposed basic terms for a possible option including a 6 -month option until
September 15, 2017. The proposed purchase price would be $26,000 per acre, in accordance with the
current prices of other parcels in the SWIP.
FISCAL IMPACT
The land is currently owned by the City and has no value. The sale of the land and possible expansion
of the factory would result in a property value increase and employment increase.
RECOMMENDATION
The City authorizes staff to execute the Offers to Purchase.
