PURPOSE: APPROVE ENGINEERING SERVICES AGREEMENT WITH CH2M
HILL ENGINEERS, INC. FOR PHOSPHORUS PRELIMINARY
COMPLIANCE ALTERNATIVES PLAN ($249,805.00)

BE IT RESOLVED by the Common Council of the City of Oshkosh that the proper
City officials are hereby authorized to enter into and take those steps necessary to
implement an appropriate professional services agreement with CH2M HILL Engineers,
Inc. for a phosphorus preliminary compliance alternatives plan in the amount of two
hundred forty-nine thousand eight hundred five dollars ($249,805.00)

CH2M HILL Engineers, Inc. (CH2M HILL) ($249,805)
BACKGROUND
On September 27, 2016 a settlement was approved with the Wisconsin Department of Natural Resources (WDNR)
regarding the Wastewater Pollution Discharge Elimination System (WPDES) permit related to the discharge limits for
phosphorus. The settlement set an interim permit limit of 0.8 mg/1 for phosphorus, which is achievable using our existing
treatment technology. This limit is likely to change with the completion of a study that is underway to determine the
Total Maximum Daily Load (TMDL) for dischargers to the upper Fox River, Wolf River, and Lake Winnebago. The limit
could easily become less than the wastewater treatment plant's (WWTP) current capability for phosphorus removal.
There are options available that can be used in place of WWTP facility upgrades. These options include adaptive
management, water quality trading, and the multi -discharger variance. The permit requires that an evaluation of these
options be investigated and submitted to the WDNR no later than December 31, 2017.
ANALYSIS
CH2M HILL has been providing technical support for both the WPDES permit negotiations and the analysis of modeling
being used in the TMDL process. They also have extensive experience in evaluating options for meeting phosphorus
limits for facilities in northeastern Wisconsin. This level of experience and knowledge will assist them in providing an
effective and efficient evaluation of the options required by the WPDES permit for Water Quality Based Effluent Limits
for phosphorus.
FISCAL IMPACT
This work will be funded with Wastewater Utility funds approved in the 2016 and 2017 Operating Budgets of the
Wastewater Utility.
RECOMMENDATIONS
Chapter 12 of the Municipal Code of the City of Oshkosh provides that professional services of a specialized nature, including
engineering services, may be procured without the use of formal, sealed quotes. I have reviewed the agreement and, in
accordance with Section 12-16 of the Code, I am hereby recommending the Common Council approve this agreement.
