ALLEN DAVIS Executive Director STEVE CUMMINGS Chairman REDEVELOPMENT AUTHORITY OF THE CITY OF OSHKOSH Oshkosh City Hall, Room 404 4:00 pm January 12, 2017 1)ROLL CALL 2)NEW BUSINESS 17-01 APPROVE ACQUISITION OF A PORTION OF BUCKSTAFF PROPERTY AT 1118 SOUTH MAIN STREET (ACQUIRE LOT 2 OF CSM 7081 ONLY) 3)ADJOURNMENT REDEVELOPMENT AUTHORITY OF THE CITY OF OSHKOSH, WISCONSIN JANUARY 12, 2017 17-01 RESOLUTION (CARRIED________LOST________LAID OVER________WITHDRAWN________) PURPOSE:APPROVE ACQUISITION OF A PORTION OF BUCKSTAFF PROPERTY AT 1118 SOUTH MAIN STREET (ACQUIRE LOT 2 OF CSM 7081 ONLY) WHEREAS,in 2015 the Redevelopment Authority and Common Council approved of the spot blight designation for the Buckstaff property at 1118 S Main Street; and WHEREAS, it is in the best interests of the citizens of the City of Oshkosh to acquire a portion of the Buckstaff property, that being Lot 2 of the attached certified survey map no. 7081, to assist in the elimination and prevention of blighting influences and promote urban renewal; and WHEREAS, said acquisition is in compliance with a settlement agreement entered into by the City of Oshkosh,Oshkosh Furniture LLC & Oshkosh Industries Inc.and Martin Cowie (owners), and FirstMerit Bank relating to a law suit filed by the City of Oshkosh relative to the nuisance conditions on the proeprty; and WHEREAS, the property to be acquired includes land and building foundations, exclusive of equipment and fixtures, and is described as: Lot 2 of CSM 7081, recorded as Doc. No. 1712374 in the Winnebago County Register of Deeds Office, 3rd Ward, City of Oshkosh, Winnebago County, Wisconsin. NOW, THEREFORE, BE IT RESOLVED by the Redevelopment Authority of the City of Oshkosh that the Authority certifies that in order for said purpose to be accomplished, it is necessary for the property described above to be acquired pursuant to the terms of the settlement agreement with the City of Oshkosh. It is further determined by the Authority that acquisition of said property is hereby determined necessary pursuant to the provisions of Chapter 66 of the Wisconsin Statutes. BE IT FURTHER RESOLVED that the proper Redevelopment Authority officials are authorized and directed to purchase said property and execute all documents necessary to consummate this transaction. City Hall, 215 Church Avenue P.O.Box 1130 Oshkosh, WI 54903-1130 920.236.5000 http://www.ci.oshkosh.wi.us TO:RDA members FROM:Allen Davis, Community Development Director DATE:January 6, 2017 RE:Acquisition of Portion of Buckstaff Property Acquisition of Lot 2 of Buckstaff Property The owners demolition contractor has removed the buildings on the southern half of the Buckstaff property (Lot 2 as shown on CSM 7081). Pursuant to the settlement agreement between the owner, the Bank and the City of Oshkosh, the RDA can take possession of the land and foundations on Lot 2. The RDA is being asked to acquire only Lot 2 at this time in order to permit City crews to start work on the removal of the foundations. Buckstaff Demolition Buckstaff demolition is proceeding, and City staff is preparing the site for redevelopment,on or before March 5, 2017. City crews may start the week of January 9th on the demolition/removal of the foundations on the south part of the Buckstaff property.The target date for foundation removal is March 1, 2017. The balance of the Buckstaff demolition in the north part of the site will continue by the private contractor. The private contractor anticipates demolishing the remaining buildings by April, 2017. City crews will also remove the foundations of the remaining buildings later this spring. Public Improvements The 2017 Oshkosh Capital Improvement Program does not contain any of the possible Public Improvements that may be needed for the Buckstaff Redevelopment/Arena project. Staff has identified the following possible Public Improvements for the Buckstaff Redevelopment/Arena: Main Street Sidewalk and streetlights –11th Ave. to South Park Improve Traffic Signals at South Park/South Main Install Traffic Signals at 11th/South Main Reconstruct South Park east of Main Street to railroad r/w. Reconstruct 11th Ave east of Main Street to railroad r/w. 2 No design has been started for the public improvements. Design could start later this spring with bidding and construction in the summer of 2017. The preliminary cost estimate for all the public improvements ranges from $3 million to $4 million. Staff is planning to submit a WEDC Grant application for a small portion of the public improvements. Tax Increment Finance Plan Staff is anticipating that a Tax Increment Finance Plan will be needed to finance the public improvements needed for the redevelopment of the Buckstaff/Arena site. In addition to the public improvement costs, the Arena designer/builder has identified some extraordinary private development costs for the site,due to the condition of the soils and fill material on the site: Remediation –Required by Wisconsin Department of Natural Resources,including soil removal and land filling and/or encapsulating contaminates. Geo pier installation –necessary to support the Arena structure weight due to the poor soils. Geo grid installation –necessary to support concrete and asphalt surfaces on the site due to the poor soils. Stormwater management measures –necessary due to the high groundwater levels. The above referenced extraordinary private development costs may need to be added to the TIF Plan, similar to other TIF plans such as the Marion Road and the Best Western Premier Hotel projects.Ehlers and Associates has started work on the TIF Plan for the project. Timeline The timeline remains in flux until an actual decision is made on awarding of the D-League franchise to the Oshkosh group.
