AN ORDINANCE TO AMEND THE COMPREHENSIVE PLAN OF THE CITY OF
OSHKOSH, WISCONSIN
The Common Council of the City of Oshkosh, Wisconsin, do ordain as follows:
SECTION 1. City Administration, Petitioner, requests a map amendment to the
Recommended 10 Year and 20 Year Comprehensive Plan Land Use maps from an industrial
land use designation to a commercial land use designation for property located at the
northeast corner of Harrison Street and East Custer Avenue, City of Oshkosh, Winnebago
County, Wisconsin.
SECTION 2. The Plan Commission recommended approval of said amendment.
SECTION 3. The City has held a public hearing on this Ordinance, in compliance
with the requirements of Section 66.1001(4)(d), Wisconsin Statutes.
SECTION 4. The Common Council of the City of Oshkosh hereby approves
amending the Comprehensive Plan Land Use Maps changing the land use designation on
the property located at the northeast corner of Harrison Street and East Custer Avenue from
industrial to commercial.
SECTION 5. This Ordinance shall take effect upon passage by a majority vote of the
members elect of the Common Council and publication as required by law.

Comprehensive Land Use Maps, changing the land use designation at the northeast corner
of Harrison Street and East Custer Avenue from industrial to commercial. The full text of

SUBJECT: Approve Amendment to Comprehensive Land Use Maps Changing the Land Use
Designation for Properties Located at the Northeast Corner of Harrison Street and East
Custer Avenue from Industrial to Commercial (Plan Commission recommends
approval)
BACKGROUND
The subject site consists of two lots adjacent to Harrison Street and E. Custer Avenue with the Harrison
Street parcel being vacant with a M-2 Central Industrial District zoning classification and the E. Custer
Avenue parcel containing a vacant manufacturing facility with a C-1PD Neighborhood Business
District with a Planned Development Overlay zoning classification. The Harrison Street parcel is
proposed to be rezoned to C-1PD as a separate request. The lots are bordered by industrial to the
north, mixed industrial and residential to the south, residential and industrial to the east, and single
family residential to the west. In 2012, properties in this general vicinity were rezoned from M-2 to C-
1PD which did not include action to amend the recommended land use map in the Comprehensive
Plan to be consistent with the zone change as there was remaining light industrial use on the site. As a
result, city staff is requesting to amend the land use maps to designate the subject area as suitable for
commercial use to ensure consistency with the zone change that was approved as the likelihood of the
parcel becoming heavy industrial again is remote as the owner is in the process of applying for a
planned development for the site as a separate request.
ANALYSIS
In 2005, the City adopted the 2005-2025 Comprehensive Plan which refined the 10 and 20 -year
recommended land use maps that are a general reference tool for determining appropriate future land
use and growth patterns. The creation of these maps determine recommended uses on a broader scale
and periodically need to be revised to conform to changes in land use patterns and the market. The
industrial designation was placed on the subject area based on the former use of the site as
manufacturing with the corridor to the north being a mix of industrial and commercial uses. The
industrial use of the parcel has diminished and the existing buildings are being proposed to be
redeveloped as multi -family residential as a separate request. The Common Council has already taken
action to change the zoning designation to commercial and this request is a maintenance action given
the existing zoning as it will ensure consistency with the Comprehensive Plan, proposed
redevelopment of the site, and existing land use patterns in the area.
FISCAL IMPACT
Changing the land use maps to reflect the existing zoning in place will have no impact on city services
or require the expansion of city services as this is a center city location with services already being
provided to the area.
RECOMMENDATION
The Plan Commission recommended approval of a Comprehensive Land Use Plan map amendment at
its December 6, 2016 meeting.

GENERAL INFORMATION

Action(s) Requested:
City staff is requesting an amendment to the Recommended 10 and 20 -Year Land Use Maps in the
Comprehensive Plan. The subject area is designated for industrial land use designation; the applicant
is requesting a change to a commercial land use designation.
Property Location and Background Information:
The subject area consists of two lots located within the City of Oshkosh, adjacent to Harrison Street and
East Custer Avenue. 0 Harrison Street (triangular tract of land) is a vacant lot approximately 0.21 acres in
size and is zoned as M-2 - Central Industrial District (and also subject of zone change request to C-1PD
under separate item). The eastern portion of the lot contains a portion of pavement from recently vacated
Mount Vernon Street. The second parcel, 300 East Custer Avenue, contains a vacant manufacturing
facility on approximately 4.98 acres zoned C-1PD - Neighborhood Business District with a Planned
Development Overlay. The lots are bordered by industrial to the north, mixed industrial and residential
to the south and residential and industrial to the east, and single family residential to the west.
On March 6, 2012 the Plan Commission recommended approval to rezone properties generally
located north of East Custer Avenue, south of Nevada Avenue, east of Mount Vernon Street & west of
Broad Street from M-2 Central Industrial to C-1 Neighborhood Business with a Planned Development
Overlay and M-1 Light Industrial with a Planned Development Overlay. At that time, the request did
not include action to amend the Recommended 10 and 20 -Year Land Use Map in the Comprehensive
Plan to be consistent with the zone change that was being recommended for approval due to the
presence of remaining light industrial use on the site. As a result, city staff is requesting to amend the
10 and 20 -Year Land Use Maps in the Comprehensive Plan to designate the subject area as suitable for
commercial to ensure consistency with the zone change that was approved.
The subject area is located on the southern transitional boundary of a broader industrial area
characterized by a mixture of light industrial/storage and commercial/retail uses to the north and
residential uses to the east, west and south. The subject area historically contained general
manufacturing uses that have given way to lighter industrial uses such as contractors' yards and
storage. The likelihood of the subject area becoming heavy industrial again seems remote given the
proposed future use of the subject area (separate action on this agenda) and the availability of green
field industrial lands in the community.

ANALYSIS
In March of 2005, the City adopted the 2005-2025 Comprehensive Plan, an update to the previous plan
from 1993. Part of the update entailed refining the 20 -Year Recommended Land Use Map and the
creation of a 10 -Year Land Use Map. The Land Use section of the plan states that, the maps are used to
give the community a better idea of how land in the city will be used in the future. The future land use maps
were created using a variety of resources. These resources include the existing land use map and special area
plans, aerial photography, land use maps of adjoining communities, soils and environmentally sensitive areas
map (which help to understand development limitations), utility and facility service area maps, and existing and
future transportation corridors. The maps show the general location and type of land uses within the city and on
the city's periphery. The maps are to be used as a basis for making general land use decisions relative to the
City's land use control regulations. Land use designations will be evaluated in terms of their consistency with
these maps and other applicable elements of this Plan and all other applicable Ordinances.
These land use maps are intended to be used as a general reference tool for determining appropriate
future land use and growth patterns. When creating these maps, recommended uses were
determined on a broader scale rather than a parcel by parcel basis. Staff realizes that sections of the
Comprehensive Plan, including mapping portions, need to be updated or revised periodically to,
conform to changes in land use patterns, or in this case, to accommodate logical requests.
Looking at the current 10 and 20 -Year Land Use Maps in the Comprehensive Plan, the industrial
designation was likely placed on the subject area based on the former use of the site as
manufacturing, and the fact that the corridor to the north is a mix of industrial and commercial uses.
Since 10 and 20 -Year Land Use Maps in the Comprehensive Plan was created, the industrial use of the
subject area has diminished and the existing buildings are currently being proposed to be
redeveloped as multi -family residential (separate action on this agenda).
The Plan Commission and Common Council have already taken action to change the zoning
designation to commercial and this request is more of a maintenance action given the existing zoning.
Staff's request will ensure consistency with the Comprehensive Plan, proposed multi -family

RECOMMENDATION/CONDITIONS
Staff recommends approving the amendment to the Comprehensive Land Use Map as proposed.
The Plan Commission approved of an amendment to the Recommended 10 and 20 -Year Land Use
Maps in the Comprehensive Plan as requested. The following is the Plan Commission's discussion on
this item.
Ms. Naudziunas presented the item and reviewed the site and surrounding area as well as the land
use and zoning classifications in this area. She stated that the property was rezoned from M-2 Central
Industrial District to CAPD Neighborhood Business District with a Planned Development Overlay in
2012 however the Comprehensive Plan was not updated after the zone change was approved. The
proposed land use map amendment would make the land use consistent with the zone change and
explained the purpose of the Comprehensive Plan land use maps. The existing land use designation
was based on the previous use of the site and the site is proposed for redevelopment as a multi -family
apartment development.
Mr. Burich added that this action is a cleanup item from the zone change in 2012 as the land use map
was not amended to be consistent with the new zoning designation.
Mr. Thoms inquired if this map amendment was approved, if the new zoning classification for this
area would be adopted appropriately with the update of the Zoning Ordinance.
Mr. Burich responded that the zoning classification for this area would be UMU-PD which will be
consistent with the new and existing zoning as well as the land use of the site.
Motion by Vajgrt to approve a comprehensive land use plan map amendment for properties located at
the northeast corner of Harrison Street and E. Custer Avenue.
Seconded by Thoms. Motion carried 9-0.
