HomeMy WebLinkAboutMinutes__________________________________ Plan Commission Minutes 1 December 20, 2016 PLAN COMMISSION MINUTES December 20, 2016 PRESENT: David Borsuk, Ed Bowen, Thomas Fojtik, John Hinz, Steve Cummings, Kathleen Propp, John Kiefer, Robert Vajgrt EXCUSED: Jeffrey Thoms, Karl Nollenberger STAFF: Darryn Burich, Director of Planning Services; Jeffrey Nau, Associate Planner; Brian Slusarek, Zoning Code Enforcement Inspector; Deborah Foland, Recording Secretary Chairperson Fojtik called the meeting to order at 4:00 pm. Roll call was taken and a quorum declared present. The minutes of December 6, 2016 were approved as presented. (Vajgrt/Borsuk) I. EXTRATERRITORIAL TWO-LOT LAND DIVISION/CERTIFIED SURVEY MAP AT 5340 STATE ROAD 21 IN THE TOWN OF OMRO The owner/petitioner is requesting a two-lot land division/certified survey map from one existing parcel containing a total of 38.18 acres. Sizes of the proposed lots are as follows: Lot 1 = 5.05 Acres Lot 2 = 33.13 Acres Mr. Slusarek presented the item and reviewed the site and surrounding area and explained the reason for the land division which was to create a residential lot separate from the agricultural use. He stated that the proposed land division will not alter the existing land use patterns and was consistent with the City’s Comprehensive Plan. The proposal has been reviewed by the Department of Public Works and they had no concerns regarding the request and the lot sizes and layouts meet required City standards. He also reviewed the certified survey map for this request. There was no discussion on this item. Motion by Vajgrt to approve an extraterritorial two-lot land division/certified survey map located at 5340 State Road 21 in the Town of Omro. Seconded by Borsuk. Motion carried 7-0. Mr. Bowen arrived at 4:05 pm. II. TWO-LOT LAND DIVISION/CERTIFIED SURVEY MAP AT THE SOUTHEAST CORNER OF POBEREZNY ROAD & WEST RIPPLE AVENUE __________________________________ Plan Commission Minutes 2 December 20, 2016 The owner/petitioner is requesting a two-lot land division/certified survey map from one existing parcel containing a total of 31.81 acres. Sizes of the proposed lots are as follows: Lot 1 = 18.376 Acres Lot 2 = 13.436 Acres Dedicated right-of-way = 0.723 Acres Mr. Slusarek presented the item and reviewed the site and surrounding area as well as the land use and zoning classifications in this area. He explained the reason for the land division which was to create two buildable parcels for future development. He stated that there were no current plans submitted at this time for development of the lots and that the Department of Public Works has reviewed the request and noted that a wetland delineation will be required to be placed on the final certified survey map, (CSM), which has been added as a condition of approval to this request. He reviewed the CSM and stated that the proposed land division is consistent with the City’s Comprehensive Plan and will not alter the existing land use pattern in the area. There was no discussion on this item. Motion by Vajgrt to approve a two-lot land division/certified survey map located at the southeast corner of Poberezny Road and West Ripple Avenue with the following condition: 1. A note be placed on the final CSM that a wetland delineation is required prior to development. Seconded by Kiefer. Motion carried 8-0. IIIA. COMPREHENSIVE LAND USE PLAN MAP AMENDMENT FROM INDUSTRIAL TO RESIDENTIAL FOR PROPERTY LOCATED AT 2521 & 2615 BOWEN STREET The applicant is requesting an amendment to the Recommended Land Use Map in the Comprehensive Plan. The subject area is designated for industrial use; the applicant is requesting a change to a residential land use designation. Mr. Nau presented the item and reviewed the site and surrounding area as well as the land use and zoning classifications in this area. He discussed the history of the previous use of the site and the proposed use of the site for the development of townhomes and storage units. He reviewed the land uses in the surrounding area and discussed Comprehensive Plan land use revisions which are necessary over time and reviewed the map of the current Comprehensive Plan’s land use designations. He also discussed the workshop that was held with the Plan Commission regarding this request previously this year. He continued with discussion on the variety of uses in this area and the changes that have taken place over the years. The proposed new development would provide an additional buffer to the residential uses on the east side of Bowen Street and will not have a negative impact on the surrounding properties. The owner could still develop the site with an industrial use if the land use amendment was not approved. __________________________________ Plan Commission Minutes 3 December 20, 2016 Mr. Bowen asked to clarify that if the zone change was approved to an R-4 Multiple Dwelling District today that it would become the new MR-12 zoning classification in January when the new zoning ordinance takes effect. Mr. Nau explained that the site would go to the UI Urban Industrial zoning district if the zone change was not approved. Mr. Bowen then asked if once the site would go to the MR-12 zoning designation, if this zoning district would permit this use as far as the same density as the R-4 zoning designation. Mr. Nau responded that the R-4 District permits up to 21 units per acre and the proposed townhouse development will have a density of 12 units per acre. Mr. Bowen then questioned if there would be any further review under the new zoning code that would bring this project back to the Plan Commission or if it would be an allowed use by-right. Mr. Nau replied that the development would require review by the Site Plan Review Committee only. Mr. Bowen stated that this development received positive feedback at the workshop and approval without further review by the Commission would be acceptable for the right project but for the wrong project, it could have a negative impact. He questioned if it would make sense to approve the site with an R-4PD zoning classification today as this needs to be well thought out and he would feel better with another chance for the Plan Commission to review the final development plans. Mr. Burich indicated that the Commission needed to consider the land use amendment first and if a planned development was placed on the zoning classification, it would require additional review for approval. He further discussed the upgraded standards of the new zoning ordinance that was meant to address these issues as far as building design, materials and other features of the development. IIIB. ZONE CHANGE FROM M-2 CENTRAL INDUSTRIAL DISTRICT TO R-4 MULTIPLE DWELLING DISTRICT FOR PROPERTY LOCATED AT 2521 & 2615 BOWEN STREET The applicant is also requesting a zone district change from M-2 Central Industrial to R-4 Multiple Dwelling District for the same area as the Comprehensive Land Use map amendment. Mr. Nau presented the item and stated that the proposed zone change was in conjunction with the Comprehensive Land Use amendment and discussed the certified survey map that was currently under review for this site. He explained that the R-4 zoning designation would be an extension of this zoning district from the north which is also currently zoned the same. He again discussed the density of the development which is 12 units per acre where 21 units was permitted. He stated that the development should not have any negative impacts on the industrial properties in the area and reviewed the site plan for the layout of the site. The layout provides the necessary buffer __________________________________ Plan Commission Minutes 4 December 20, 2016 requirements from the residential uses and the R-4 zoning classification being requested is not in the new zoning map therefore the zoning classification would change to MR-12 on January 1, 2017 when the new zoning ordinance takes effect. If the land use amendment is approved, the zoning classification will be consistent with the Comprehensive Plan. He reviewed photos of conceptual renderings of the development and discussed the townhomes and storage units proposed for the site. He also reviewed the current conditions of this site and discussed that the proposed development would be more consistent with the rest of the surrounding neighborhood. Motion by Vajgrt to approve a comprehensive land use plan map amendment from industrial to residential for property located at 2521 & 2615 Bowen Street. Seconded by Borsuk. Motion carried 8-0. Motion by Vajgrt to approve a zone change from M-2 Central Industrial District to R-4 Multiple Dwelling District for property located at 2521 & 2615 Bowen Street. Seconded by Borsuk. Mr. Bowen stated that he would like to see this site with a planned development overlay on it however it may be a good opportunity to see how well the new zoning ordinance performs and would like to think that the upgraded standards for new development will address issues that were previously covered within the process for a planned development review. Mr. Burich commented that this is a more transitional area and at this location it would be a good test of the effectiveness of the new zoning ordinance as far as the upgraded development standards. Mr. Bowen commented that the proposed development would be better than what was and still is on site currently. Mr. Borsuk commented that with the newer projects coming through under the new ordinance that staff could follow the development for selected projects and report back to the Commission on if things are working out as planned. Mr. Burich responded that staff will be checking into the developments as they proceed and report back to the Commission if issues are coming up and that there would be some fine tuning of the zoning ordinance in time after staff has a chance to see what needs to be adjusted. Mr. Cummings stated that this development will clean up the area and improve aesthetics as this is considered a gateway to the city. Mr. Bowen commented that it would make sense to review with Tom Karrels, the architect for this project, how the process worked and follow up with him for input. Motion carried 8-0. __________________________________ Plan Commission Minutes 5 December 20, 2016 PLANNING DIRECTOR’S REPORT Mr. Burich stated that the University’s Intramural Recreational Field Complex project that was approved a few months ago has been experiencing some issues with the conditions related to the storm water management requirements and staff from the City, the University, and their consultants has been trying to work things out. Currently UW-O, the DOA, the consultants and city staff have been working on the matter however the item may come back to Plan Commission at a future date for modification of the conditions if necessary. Buck Barker, representing the Rettler Corporation, stated that he was present to discuss the issues. Mr. Burich indicated that if the request would come back to the Plan Commission for action that would be the time to discuss the issues. At this point the parties involved were still trying to resolve the matter. There being no further business, the meeting adjourned at approximately 4:32 pm.
